Appl..No. 3808:
Matter of the Application of GUNTER MORCHEL for Variances
to the Zoning Ordinance, Article X, Section 100-102 for
permission to construct addition with an insufficient rear yard /
setback and lot coverage in excess of maximum limit of 30% (as
disapproved), Article XXIV, Section 100-244B, and Article XXIV,
Section 100-242(A) concerning extension of nonconforming side
and front yard setbacks. Lot area is nonconforming at
approximately 9961 sq. ft. in this General Business (B) Zone
District. Property Location: Corner of the South Side of the
Main Road and the East Side of Sigsbee Road, Mattituck, NY;
County Tax Map District 1000, Section 143, Block 2, Lot 1 (or 1
and 30).
At a Meeting of the Zoning Board of Appeals held on
June 29, 1989, the following action was taken:
WHEREAS, at a public hearing held on June 29, 1989,
opportunities were given for individuals and/or their agents to
be heard, and no appearances either in behalf of or against the
application were personally made; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is situated at the intersection
of the southerly side of the Main Road (State Route 25) and the
easterly side of Sigsbee Road, generally located in the Business
District, Hamlet of Mattituck, Town of Southold.

2. The property in question:
(a) contains a total nonconforming lot area of
approximately 9,961 square feet, nonconforming lot width
{frontage} along the southerly side of the Main Road of 48.52
feet, conforming lot frontage along the easterly side of Sigsbee
Road of of 163.50 feet, (when including that section of the Old
Main Road which although abandoned by the Town may or may not
have been conveyed to the applicant/owner; See Survey dated
June 23, 1983 prepared by Roderick VanTuyl, P.C., and Survey
dated September 27, 1972 prepared by Otto W. VanTuyl, L.S.};
(b) is identified on the Suffolk County Tax Maps as
District 1000, Section 143, Block 2, 1 (possibly 1 and 30);
(c) is improved with a partial two-story and partial
one-story building situated with setbacks from the northerly
property line at 29+- feet, from the westerly property line at
19-11/2+- feet, easterly property line at 10+- inches, and
southerly property line at 36+- feet, all as shown on the Survey
map prepared June 23, 1983 by Roderick VanTuyl, P.C. for the
property owner;
(d) is bounded on the easterly side by the Mattituck
Bowling Lanes, along the westerly side of Sigsbee Road by
Dickerson's Marine Sales, along the northerly side of the Main
Road by Magic Fountain (sales), and along the southerly side by
a single-family dwelling, all located in the "B" General
Business Zone District.
3. For the record, it is also noted that set-back
variances were granted under Appeal No. 1163 on March 7, 1968
and No. 1142 on October 11, 1967 allowing frontyard reductions
to 25 feet from the Main Road and to 19 feet from Sigsbee Road.
4. By this application, the property owner requests
permission to construct a 16 ft. extension at the southerly end
of the existing structure which would extend the present
nonconforming easterly 10-inch side yard setback and extend the
nonconforming frontyard setback at 19-1/2 feet, as well as
reduce the southerly rear yard setback from 36 feet as exists to
20 feet.
5. In considering this application, the Board also finds
and determines:
(a) that it is the burden of the landowner to prove that
the area restrictions as applied to his land imposes

"significant economic injury," and no testimony has been
submitted by the landowner to substantiate the same;
(b) that the relief requested is substantial in relation
to the requirements, being variances of 42 percent, and more, in
relation to the setbacks as proposed, and for total lot coverage
of 42+- percent {instead of the maximum-permitted by the
requirement at 30 percent};
{c) that the relief requested is not the minimal necessary
and therefore an alternative method may be available for
appellant to pursue other than the requested variances;
(d) that there is more than one occupancy of the building
in question and together with the nonconformities of the land
area, width and depth, will by a grant of this variance be
adversely affecting the safety, health, welfare, comfort,
convenience and/or order of the town;
(e) that proof of ownership by the applicant concerning
the northerly portion of the premises, formerly a part of the
Old Main Road, has not been furnished in the record;
(f) that the interests of justice will be served by
denying the relief, as applied.
Accordingly, on motion byMr. Dinizio, seconded by
Mr. Grigonis, it was
RESOLVED, to DENY the relief, as applied, in the Matter of
Appeal No. 3808 in the Application of GUNTER MORCHEL for a
16-ft. by 26-ft. addition for accessory storage incidental to
the existing legal principal uses of the land.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis, Sawicki and Dinizio. This resolution was duly adopted.

0-243. Nonconforming buildings with nonconforming uses.
~. A nonconforming building containing a nonconforming use
shall not be enlarged, reconstructed or structurally altered or
moved unless the use of such building is changed to a
conforming use.
I. A nonconforming building containing a noncon/orming use
which has been damaged by fire or other causes to the extent
of more than fifty percent (50%) of its fair value shall not be
repaired or rebuilt unless the use of such building is changed
to a conforming use.
9-244. Nonconforming lots.
~. This subsection is intended to provide minimum standards for
granting of a building permit for lots made nonconforming or
continued in a state of nonconformance by the adoption of this
Article and that were singly and separately owned as of the
effective date of this Article.
A nonconforming lot separately owned and not adjoining any
lot or land in the same ownership at the effective date of this
Article and not adjoining any lot or land in the same
ownership at any time subsequent to such date may be used,
or a building or structure may be erected on such tot for use,
in accordance with all the other applicable provisions of this
chapter, provided that proof of such separate ownership is
submitted in the form of an abstract of title showing the
changes of title to said lot, which abstract shall be in the usual
form, shall be certified by an attorney or a company regularly
doing such work in Suffolk County or by a corporation duly
licensed to examine and ensure title to real property in Suffolk
County and shall contain a certification that no contiguous
property was owned by an owner of the property involved
since the date of any previously applicable Zoning Law. Such
lot shall be granted relief for front side and rear yard
dimensions as follows:

C. In the ease of single and separate ownership of a nonconform-
ing lot located in a subdivision plat, approved after April 9,
1957, by the Planning Board of the Town of Southold and filec~
with the County Clerk of Suffolk County, relief for all frorw

extent that such front, side and rear yard and area dimensions
were required at the time the map was originally filed with
the County Clerk of Suffolk County.
§ 100-245. Repairs and maintenance.
Notwithstanding any of the foregoing regulations, nothing in this
Article shall be deemed to prevent normal maintenance and repair of
any building or the carrying out upon the issuance of a building
permit of major structural alterations or demolitions necessary in the
interest of public safety.
§ 100-246. Involuntary moves.
Sections 100.241A and B and § 100-243A, herein are not intended
to apply to involuntary movements of uses or structures as a result of
condemnation actions or other litigation.

Dear Mr. Morchel,
The Planning Board has reviewed your letter and revised
site plan which were submitted on June 13th. The following
items were requested in our April 28th letter and were not
included with the June 13th submission:
Proposed grade.
Existing grades are shown, but the proposed grade
after construction of the addition and the extension
of the blacktop must be shown also.
Drainage calculations.
The capacity of the drl;well shown on the site plan
must be sufficient to handle the volume of stormwater
rllnoff that is being generated by the site. These
calculations must be shown.
Parking calculations.
Parkinq needs must be related to the amount of floor
area per use. Office and sales floor area are noted,
but the remainder of the floor area is not specified
as to amount of floor space being devoted to a
specific type of use (e.g. 5,000 square feet of
manufacturing and storage space).
4. Landscaping plan.
The relationship between the plantings and the dr~welt
at the southern end of the property are not clearly
defined. Is the drywell to be surrounded by plantings
or by blacktop?

The discrepancies amoung the survey, the application
and the tax map regarding the boundaries of your
property still need to be clarified.
According to the Tax Assessor's records, you do not
own the portion of the property that lies between the
front of the building and Main Road. However, there is
a record of three quit claim deeds that were executed
by the then Supervisor of Southold Town for the
abandonment of Old Main Road to three separate
parties: Frank and Joseph Pumillo, John and Ann
Skuro, and Ernest and Harold Wilsberg. There is also a
record of the deeds being recorded. It would be
appreciated if you would submit a copy of your
property deeds for the entire si%~.
The Board's April 28th comments to the Zoning Board of
Apepals still stand. It would be appreciated if the above-noted
information could be submitted before the June 29th hearing date
of the Board of Appeals.

Dear Mr. Morchel:
At our Special Meeting held on Wednesday, May 31, 1989, the
Board has authorized a scheduling of your variance application
for a public hearing at our next hearings calendar, provided you
are able to submit, within the next several days, calculations
as to total building coverage on the lot.
As you may know, on January 10, 1989, the Southold Town
Board adopted the new Master Plan Zoning Maps, and your property
has been re-designated "B" General Business. Under Article X,
Section 100-102, and Bulk Schedule of the Zoning Code,
properties located in the "B" General Business are limited to a
maximum building coverage of 30 percent of the total lot area.
Since all files must be updated under the new zoning
regulations, an Amended or New Notice of Disapproval from the
Building Inspector is necessary requiring variances in the
following areas:
1. Excessive lot coverage, Article X, Section
100-102, Bulk Schedule. (Please furnish your calculations first
to the Building Inspector and later to our office.)
2. Extension of nonconforming sideyard and frontyard
setbacks, Article XXIV, Section 100-242(A).
3. Insufficient rear yard setback - Article X,
Section 100-102, Bulk Schedule, and/or Article XXIV, Section
100-244(B).

Attached please find a letter that is being forwarded to
Mr. Morchel regarding his site plan application.
There is additional information pertaining to this case
that may be of use to your Board in your determination:
The site as developed is not in conformance with any
of the bulk requirements for the General Business zone
except lot depth. Applicant is requesting to
increase the degree of non-conformity £urther, in
terms of additional lot coverage, front, side and rear
yard setbacks.
The Planning Board is generally not in favor of
increasing the degree of nonconformity.
In this case, however, it would be in favor of the
proposal provided the applicant was required to
install curbing and landscaping inthe front yard at
the intersection of State Route 25 and Sigsbee Road.
This intersection is located on a busy section of Main
Road. It is felt that traffic safety would be improved
by the addition of curbing at this otherwise poorly
defined intersection.'
Further, the addition of landscaping (shrubs, grass
and a street tree) in the front yard would both
ameliorate the extensive paving onsite and bring the
site into closer compliance with the landscaping
requirements. This site could never meet the 35%
landscaping requirement of the current code, but it
culd meet the front yard landscaping required by
Section 100-212 of the Zoning Code.
In addition, Section 100-213 requires that there be a
25 foot landscape buffer between the General Business
zone and adjoining residential zones. The proposed
addition to the applicant's building will bring the
building within 20 feet of a residential zone. It is
strongly recor~nended that, it the variance is granted,
the applicant be required to supplement the existing
wooded vegetation with evergreen trees.

The above-referenced site plan was reviewed by the Planning
Board.
The site, as built, does not conform to the bulk
requirements of the General Business district. This site plan
was reviewed in conjunction with your application to the Zoning
Board of Appeals for permission to expand a nonconforming
building on a nonconforming lot.
If the Zoning Board decides to grant the variance that you
have requested, the site plan should be revised to include the
following information:
Topographic information.
The property slopes downward from State Route 25.
Indicate existing (and proposed) change in grade from
the front to the rear, particularly where the proposed
addition will be placed.
Drainage information.
Stormwater runoff from the proposed addition and
the proposed extension of the pavement must be
contained onsite. Show location and capacity of
drywells.
Parking calculations.
Indicate the floor area devoted to each of the
existing uses (e.g. office space, manufacturing space,
storage space.) Show parking spaces on the site plan.
4. Landscaping plan.
Be
Elevation drawing showing facade of proposed building,
location of overhead doors,if any.
Also, it would be appreciated if you could clarify a minor
discrepancy between the application form and the site plan. The
site plan indicates that the land area is 9,961 square feet.
The application states that the land area is 10,120 square
feet.

Quit Claim Deeds for SCTM ~ 1000-143-2-30
As per our conversation of Wednesday, April 26, 1989, the
Town Board minutes were researched regarding a section of State
Route 25 that was abandoned by Southold Town to Gunter Morchel.
The attached copy of the minutes does not make any
reference to the issuance of quit claim deed to Mr. Morchel.
The Tax Assessor's office has no record of this property's
existance, even though the Suffolk County Tax Map indicates the
existance of this property.
Mr. Morchel has submitted applications to the Zoning Board
of Appeals and to the Planning Board which incorporate Lot 30
within the boundaries of his property.
It would seem prudent to resolve this problem so that the
question of ownership of this lot is clear. Please advise what
action the Planning Board can take if any to resolve this
discrepancy in the records.
