Matter of DR. PAUL AND ELLEN MITCHELL. Variance to the
Zoning Ordinance, Article III A, Section 100-30 A.3, and 280-A
Access for Right of Way, for permission to construct a single
family dwelling with insufficient front Yard setback in this
R-40 Zone District. Property Location: 1015 Munn Lane, Orient,
County Tax Map No. 1000, Section 017, Block 02, Lot 08.
WHEREAS, a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of DR.
AND ELLEN MITCHELL, under Appeal No. 3860; and
PAUL
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Main Road 25, Town of Orient, and is identified on the
Suffolk County Tax Maps as District 1000, Section 017, Block 02,
Lot 08.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30A.3, 280-A Access of
Right-of-Way, for permission to construct a one family dwelling,
with insufficient front yard setbacks.

3. Article III A, Section 100-30A.3, no building or
premises shall be used and no building or part thereof shall be
erected or altered in the Low-Density Residential R-40 District
unless the same conforms to the requirements of the Bulk
Schedule and of the Parking Schedule, with the same force and
effect as if such regulations wee set forth herein in full.
(A) 280-A Access of Right-of Way.
4. Subject premises for the proposed dwelling is known
and referred to as being on 1,3756 Acres, the proposed house,
with decks and catwalk will be 5,890+- sq. ft., the proposed
location of the house will be 40+- ft. away from the west
Property line, 15+- ft. from the north property line, 115+- ft.
from the south property line, and 165+- ft. from the high water
mark.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed one family dwelling in any
other location on the premises will require other variance
relief;
(c) that the area chose for the dwelling is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of DR. PAUL AND ELLEN MITCHELL as applied under
Appeal No. 3860 for the placement of a one family dwelling with
setback and a 280-A access Right-of-Way, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. That within the findings of the Board that it is our
understanding that the Department of Environmental Conservation
(DEC) and the Town Trustees are dealing with the erosioD control
aspects of this construction, and we suggest that all possible
precautions be used in the construction of this one family
dwelling.
A. Setback for the one family dwelling as shown on
Site Plan, By Garrett A. Strang, Dated 3/28/89
B. It is understood that the erosion control aspects
of this project have been mandated by the other agencies of the
Town and the State, however, it is the suggestion of this Board
that a retaining wall may be deemed necessary on the side of the
proposed dwelling that is closest to the property line (15')
sideyard, and that the distance of this wall not exceed the
distance of the dwelling.
2. 280-A, Access be granted from the unpaved access to
the edge of the property line, a distance of approximately
(525'+-), subject to the following improvements:
(a) after construction a minimum of 2 inch 3/4 stone
blend at a minimum width of eight feet and a suggested width of
ten feet, after completion it is to be inspected by Members of
the Zoning Board before a certificate of Occupancy (C.O.) is
granted for the property.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and
Dinizio (Absent was, Joseph Sawicki and Serge Doyen, Fishers
Island). This resolution was duly adopted.

1. STRICT APPLICATION OF THE ORDINANCE would produce pr~tical difficulties or unn~s-

It would prohibit my client from constructing a single family
residence similar to those existing on neighboring properties.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because
the majority of the surrounding properties are developed with
Principal Dwellings and accessory structures and enjoy the
use of an existing common right-of-way. My client has deeded
rights to travel over the same right-of-way.
In addition my clients' property is required to have two (2)
front yards in addition to the required setback from Long
Island Sound. This condition is not shared by all properties
in the immediate vicinity.
3 The Var,once would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
as previously noted, the majority of the surrounding properties
are developed with improvements compatible and comparable to that
proposed in this application.

that and what is involved and how long a process

MR. GARRETT: That is simply a
recommendation from them concerning any areas
that they feel could be minimized in the
construction of the dwelling. We don't have a
cliff or a lip or anything of that nature. So I
don't know of anything they're going to be

concerned with. I tend to think probably not
much.
We are not bound to wait for their
decision. We think we will have it within the
next two weeks. It's something that you know,
if we were 165 feet in the area and 70 feet lip
of the bluff. We are not concerned with it in
this situation. We deal with soil and water
whenever it concerns anything on the water,
usually on the Long Island Sound.
That's the primary reason.

Dear Mr. Goehringer and Members of the Board:
This is in response to comments of Suffolk County Soil
and Conservation District (letter of October 2, 1989).
First, both Southold Town Trustees and New York State
Department of Environmental Conservation, as a requisite
of approval, have required that we provide for erosion
control during and after construction. This will be
done via use of hay bales and restoration of the site
upon completion of construction.
Second, the site plan submitted includes the topographic
data. It is my clients' intention not to change any of
the grades, but to work with the existing land contours.
Third, the extent of the landscaping is limited to res-
toration of any disturbed existing vegetation. My cli-
ents intend to maintain the site in a natural state.
I trust the above addresses the issues raised by Mr.
Thomas J. McMahon, Sr. District Technician, and will en-
able the Board to render a decision in a timely manner.

Dear Mr. Goehringer:
In reference to your request for our assessment of Appl. No. 3860 -
Dr. Paul and Ellen Mitchell (Variance), please be advised that a site
inspection was conducted on October 2, 1989.
The inspection found the site to be a depressional area and within a natural
drainageway. Soils on the site are mapped as Carver and Plymouth sands with
15 - 35 percent slopes. In the northeastern section of the lot, at the bottom
of the depression, there is an area supporting the growth of saltmarsh grass -
Spartina patens.
Construction of a single family residence, garage and catwalk on this lot could
cause severe soil erosion problems. Adequate plans for erosion and sediment
control during and after construciton should be prepared and approved. A de-
tailed plan showing existing and proposed grades should be included in the plan.
In addition, surface drainage access details, and final landscaping plans should
also be reviewed and approved.

10 That if future operations by the State of New York require an al-
teration in the position of the structure or work herein authorized, or
if, in the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State. and if, upon the expiration or
revocation of this permit, the structure, filJ, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such
extent and in such time and manner a~ the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.
11 That the State of New York shall in no case be liable for any damage
or iniury to the structure or work herein authorized which may'he caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
12 Granting of this permit does not relieve the applicant of the responsi-
bility of obtaining any other permission, consent or approval from
the US. Army Corps of Engineers, U.S. Coast Guard. Ndw York State
Office of General Services or local government which may be required.
13 All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any

other environmentally deleterious materials associated with the
proiect.
14 Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
15 There shall be no unreasonable interference with ~avigation by the work
herein authorized.
16. If upon the expiration or revocation of this permit, the proiect hereby
authorized has not been completed, the applicant shaU, w;thout expense
to the State, and to such extent and in such time and m~nner as the
Department of Environmental Conservation may require, remove alt or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration

mental Conservation hereby certifies that the subject proiect will not
contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein are met.
19 All activities authorized by this permit must be in strict conformance
with the.approved plans submitted by the applicant Or his agent as part
of the permit application.

SPECIAL CONDITIONS
1. A row of hay bales must be staked in place along the FEMA A-8 zone line (11'
elevation)in the 50' buffer zone area and remain ~n place until construction is
completed.
2. Any portion of the 50' buffer zone seaward of the t2' contour elevation disturbed
during construction must be restored to existing grade and replanted with native
species; bayberry on 3' centers, rosa rugosa on 12" centers, e~ other groundeover
plants in accordance with a planting scheme which mdst be approved by NYSDEC,
3. The remaining 50' buffer zone outside area of constructien shall have no
disturbance to vegetation or topography.
4. No fill is to be brought to the site without additional prior approval by DEC.

A copy of this permit with supplementary conditions and approved
plans shall be avai]able at the project site whenever authorized
work is in progress.
The permit sign enc]osed with the pea'mit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours p~-lor to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is ful]y aware of and understands all provisions and
conditicns of this permit· Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee sh~l] notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
if project design modifications t=k= place after permit issuance, the
permittee shall submit the appropriate plan chauges for approval by
the Regioual Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new applic=tion for permit.
