THE ORDINANCE would produce

... it would make impossible any addition to the residence,
which is an existing non-conforming building, which lies
entirely within the mandated one-hundred foot (100ft.) setback
from the edge of the bluff. The residence pre-dates the Zoning
Ordinance, and the bluff setback §100-119.2.A )1).
An existing deck on the residence comes within five feet (5ft.)
of the top of the bluff (as shown on the survey map). Ail of
the residence lies within sixty-three feet (63ft.) of the top
of the bluff. The setback line lies forty feet (40ft.) landward
of the residence. It is therefore impossible to add onto the
existing residence without violating §100-119,2.A(1). This fact
constitutes a hardship for the owners, who are in need of extra
space in their house.
2. The hardship created is UNIQUE and is not shared by oll properties alike in the immediate
vicinity of this property and in this use district because
the beach.

... all properties in the district do not contain houses which
pre-date the Zoning Ordinance, nor which lie within one hundred
feet of the top of the bluff. Also, the bluff at this specific
site has a unique configuration. The house sits on a plateau
between two distinct banks, which descend from Hyatt Road to

3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
... the basic intent of the Variance is to expand and upgrade an
existing period residence in a manner and style consistent with
the original. The residence shall be transformed from seasonal
to year-round use and the exterior materials restored to the
original cedar shingles. Other homes in the area have gradually
been expanded and upgraded; the neighborhood has gone from a
purely summer colony to a solid, year-round community with
spacious homes. The additions planned are not to excessive
(18% increase in total square footage), nor would they make the
home larger than many of its neighbors.

Both banks are heavily vegetated; there is no bulkhead on
the beach and no erosion of the bluff.
There is an additional hardship created by the location of
the existing sanitary system, which was updated to SCHD
standards about eight years ago. This system is located on
the landward side of the residence, in the center of the
property. The possible locations for new addi~i'dh~ ~:0 the
house are therefore severely limited by the existing
sanitary system.

The intent of the Ordinance, is to maintain a setback from
the bluff edge, in order to preserve the structural
integrity of the homes in the event of erosion of the bank.
Unlike many cases, the bluff in this location is not eroding
due to its exposure, topography and vegetation. The beach
at its foot is stable.
Nonetheless the Variance seeks conservative additions to the
residence, which do not encroach closer to the bluff than
the existing residence. The major portion of the addition,
a master bedroom suite, is planned on the landward side of
the existing house, as remote as possible from the bluff.
In this location, the principal bedroom does not get a view
of the Sound.
The other proposed addition is a dining room built on the
west side of the existing residence. It would replace a
smaller existing enclosed porch, which currently serves as a
dining room, though it is only seven feet wide. This porch
would be removed in order to build the new dining room and
entry vestibule. These rooms could not be located
completely landward of the existing residence because of the
location of the existing sanitary system. To move and
replace this system would constitute a major economic burden
to the owners. The existing house itself is set back a
minimum of twenty-five feet (25ft.) from the bluff edge; the
proposed addition is set back a minimum of thirty-five feet
(35ft.) from the edge.

The final portion of the construction for which ~elief is
sought is a narrow treated wood deck to connect an existing
deck to the new dining room and grade on the west side.
This new deck would come within a minimum of twenty-three
feet (23ft.) of the bluff edge, as opposed to five feet
(5ft.) for the existing deck.
The spirit of the Ordinance in §100-119.2.A(1) has thus
been preserved to the greatest extent possible given the
existing conditions. The character of the neighborhood
would not be changed by granting this Variance request.

Variance from the Zoning Ordinance (see enclosed). Upon
passage of the Master Plan, the need for a variance was
eliminated due to changes in the ordinance, as specified in
a letter to us dated February 9, 1989. The Building
Department has subsequently given us a building permit.
