Variance to the Zoning Ordinance, Article IX, Section 100-102, as Disapproved, (nonconforming Bulk area and parking requirements of the Hamlet Business District) Proposed construction will have insufficient total side yard setbacks. Property Location: 53705 Main Road, Southold; County Tax Map No. 1000, Section 61, Block 1, Lot 14. WHEREAS, a public hearing was held and concluded on September 21, 1989 in the matter of the Application of SOUTHOLD FREE LIBRARY under appeal 3861; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the north side of Main Road, Route 25, Town of Southold, and is identified on the Suffolk County Tax Maps as District 1000, Section 61, Block 1, Lot 14. 2. This is an application for Variances from the Zoning Code Article IX, Section 100-102, for permission to construct addition on to existing building, (nonconforming bulk and parking requirement of the Hamlet Business District, Proposed construction will have insufficient total side yard setbacks. Article IX, Section 100-102, requires no building or premises shall be used and no building or part thereof shall be erected or alter in the B District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference. 4. The subject premises is known and referred to as having Lot the total area of .832 acres, the existing building is approximately 2333 sq. ft. first level, proposed construction on the first level will be 2324.5 sq. ft., for the total addition of all three floors will be approximately 6,500 sq. ft. inclusive. 5. In considering this application, the Board finds and determines: (a) factors, variance, in carefully considering the record and all the above the interests of justice will be served by granting the as applied and conditionally noted below. (b) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (c) it is the position of this Board that granting the 11 feet on one side and that of 11 1/2 ft. on the other side, this would not be out of character with the general existence in the immediate area. Accordingly, on motion by Mr. Goehringer, Seconded by Mr. Grigonis, it was RESOLVED, to GRANT a Variance in the matter of the Application of SOUTHOLD FREE LIBRARY as applied under appeal NO. 3861 for the construction to existing dwelling with insufficient total side yard setback, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The one side yard will be that of 11 feet and the other be that of 11 1/2 feet on the other side of this building. Vote of the Board: Doyen, Sawicki and Dinizio. Ayes: Messrs. I would like to go through the application so you understand the reason for the appeal, and the reason why the library considers the application to be a hardship and is looking for a variance. The library is here; the existing building. The Main Road is to your right. The building sits on a relatively narrow lot that runs between the Main Road and Travelers Street. Basically the library has been for years and years, looking to raise funds to build an addition onto the building. As you know, the library is a a masonry building from the 1800's. It was the Southold Savings Bank. It was subsequently converted to a library in the '20s. Up until this Now they're putting However, seeing as a lot of the traffic in the library has been determined to be for the traffic from people who are doing other things in town, we have tried to create a plan which links the Main Road with the parking lot via a pedestrian route which runs along the property line and also abuts Feather Hill Shopping Center. By doing that, we have essentially located our entrance about midway along that path into what would be the center of the building. Again, it's been determined from design study and a lot of exhaustive consultations with the library staff that a central entrance and central circulation would work the best for them because.they have the children on one end and adult section on the other end. So with this site plan, we've tried to create a situation RAM COURT REPORTING SERVICE (516) 727-3168 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 5 where we are lining up the parking area with the Main Road and also have the building function as efficiently as possible via the central entrance. Instead of coming in, for example, at the very end and having all the kids traipse through the main space or some kind of hallway or something which would take up space and not yield any utility. It's been also determined from meetings with the staff that the central relationships include a need for control for the building, who is coming in and out and going in and out and who is going up and down the stairs and who is going up and down the elevator. All the control functions, meaning the control desk and the administration area, are located central to the the building and the main and elevator, in a sense, that control point. Even this working door and the stairs have to be close by to drawing, what you will see is the exterior wall of the existing building, which runs as such, and then the exterior wall of the new building, which runs as such. Close by, as said, are located the stairs and the elevator the staff would have control over their use. As I said originally, the library is a masonry building, alter the existing structure very much. However, we do need to maintain an open path from the new functions emphasis which means it's difficult to clear to old building so it as one. We tried to do that. The in design had been to use the existing openings as much as possible because of the expense and the structural problem with making new large openings in the existing masonry walls. So basically the existing windows are located here, here and here. We are trying to reuse all of those things and at the same time keep the functions of circulation and control close to that center point in the building. So what we found, again, after truly exhaustive design ~tudy, the best place for those things was against the existing exterior wall of the building here. 6 I RAM COURT REPORTING SERVICE (516) 727-3168 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 What we did, therefore, was locate the stair in the center between the two windows. just fit and the elevator behind the stairs, again, on the other side of the existing opening. That left us sticking out from the existing building face three feet eight inches, and that is the encroachment which even though itself does not violate the side yard setback, when added to the setback on the other side of the building, something around twelve feet It violates the needed total setback. We tried locating that elevator in many other locations, for example out here or over here. Or where the stair is, and then put the stair other places. Basically we are sliding it all around this control administration area, but found that it just wasn't working for an efficient -- in an efficient means, and it was 7 causing us to add on great deal excess square footage just to make the main reading room function. But, again, finding, and -- with the idea we were trying to link the Main Road and pedestrian circulation that the library has always gotten, the patrons of the library are familiar from walking from the Main Road and the parking in the rear. So we were in a sense bound by that site planning decision and found that the entrance was -- could not be pushed back into the building to make up the distance. Again, the side yards are maintained on this side, the west side, but together with the side yard on the other side of the building it basically did not meet the total side yard requirement. So the hardship basically that we are claiming in -- in the first aspect of the hardship that we are claiming in this was the hardship of this building that we are working with, the old building, being rather intractable and on a narrow lot and having to add onto it in RAM COURT REPORTING SERVICE (516) 727-3168 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 a way that the library can afford without any additional square footage. It's as bare bones, if you will, as it can be. The library is strapped for funds. They haven't raised the total amount they need yet. They are trying desperately to get the amount and go to bid and hopefully start construction at some point, pending approval here or something else. But the building is a difficult building to add onto, is what I'm getting at. With existing openings and the library's need to control the buildings or staff's need to control the building in the most efficient possible way, it kind of led us to this path. We believe the hardship is unique because the building is unique in this district and in this town, being heavy masonry, as opposed to a frame building which you can cut all kinds of changes. A masonry can't. You have to respect it. that level the building itself open and make building you Therefore, at is unique. Then the side this zoning ordinance changed and now we have yards that need to be respected. However, building does not -- is not like the other buildings in the center of the hamlet but it has these setbacks and now has to respect them whereas the others don't. Also, it has an existing second floor, which these days in a public building means it has an existing second use. They can only use needs an elevator. It floor which they can't it now for their occasional trustee meeting of which even so, if you looked at it, they shouldn't be having a second floor of the building without an elevator, as a public meeting. We were also proposing a second floor meeting room which seals the fate of that. We are looking to save construction costs by limiting the size of the foundation. Furthermore, we believe that the variance would observe the spirit of the ordinance because it does not change the character of the district. The third drawing we have shows the eastern elevation, which is the site of this encroachment. And basically what you see here is the existing building coming back this far. This is the side that faces the old post office. The addition is in the rear. As a link between them in a sense on the elevation, at least, is this elevator which sticks out three and a half feet, three foot eight, off the building. It's a non-residential district for the most part, all the neighbors are non-residential. The building, the existing library has established a character of its own in its own setting. We are trying to remain faithful to the style of the building in all ways, and the encroachment on the side yard, seeing as it comes at this time, does not affect the character of the district because all the other buildings in the downtown of the hamlet 11 RAM COURT REPORTING SERVICE (516) 727-3168 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 have zero So with side yard, we the character side yards. our ending up with an eleven foot don't feel that that will disturb of the district in any way. And also this is virtually invisible from the street because it's behind the building on a narrow lot. That's basically it. MR. GOEHRINGER: Mr. Samuels, I notice you have the proposed addition on the first floor as 2,324.5 square feet. Is that approximately the same on the second floor also? MR. SAMUELS: The second floor is less. Because we do not want to build over the entrance lobby, because we were trying to maintain light to the existing historical books collection on the second floor. We did not want to wrap the second floor addition around the existing building, because we would cut off all the light. MR. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnecessary HARDSHIP because it would dictate an exterior envelop which constricts the efficient and practical functioning of the Library. Adding to an existing heavy masonry building with historic significance is a difficult matter; existing masonry openings must be used to link the old and new portions. As these openings cannot be moved, they establish very rigid relationships between the building's principal functional elements. For example, the most important relationships involve the placement of the elevator, new stairs, and doors between the Circulation Desk, Director's Office and Main Reading Room. To function efficiently, and provide the staff with the proper amount of control over the building, these elements must all exist on the north wall of the existing building, using the existing masonry openings. Because of this the elevator is necessarily pushed through the existing envelop to within eleven feet (tl ft.) of the eastern property line. After exhaustive study, the architect has determined that any other location would either create functional problems or control problems, or would seriously infringe on the space of the Main Reading Room, which has been designed to be as efficient as possible. On the western side of the building, a similar set of conditions exists which push the face of the new building to within eleven and one half feet (11½ ft.)of the property line. The new Entry is proposed on this side, accessed by a new walkway that connects Main Street to the Library's parking lot. The intention of locating the Entry in this location is to maintain the traditional pedestrian link to Main Street yet also offer essential convenient access to the parking lot. The existing front door will be for emergency exit only, in order to facilitate internal control. The new entrance faces and connects with the Feather Hill project, extending that pedestrian zone. A similar "squeeze" exists on this side. Without relief it is impossible to locate the Entrance porch, handicapped ramp and Foyer on this face of the building, while maintaining critical connections between the Lobby and new Reading Room, around and through the existing masonry structure. The Southold Free Library is already burdened with the "hardship" (economic and physical) of adding onto an ornate, historic masonry building located on a narrow site. The Library is willing and able to deal with this general hardship, in order to provide better service and space to the public, while doing justice to and enhancing a significant local structure. Strict compliance with the Ordinance, however, produces significant PRACTICAL DIFFICULTIES, because it imposes a floor plan which does not suit the functioning of the Library, nor the accessibility of the Public. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of the property and in this use district because most properties in this immediate vicinity contain buildings which pre-exist the Ordinance,and which therefore are built in many cases, right up to the property line. In fact, the Library's property includes a frame house which sits three feet (3 ft.) off the property line. Like many other buildings in the zone it has pre-existing, non-conforming status. These surrounding properties therefore have greater use of their sites than does the Library. The Southold Free Library also has an existing second floor, and proposes an additional second floor Reading Room, both of which require an elevator for handicapped accessibility. It is this elevator which contributes to the proposed building's encroachment into the required combined side yards. As described earlier, all efforts to locate the elevator in another (conforming) location failed due to the interior functional relationships and existing conditions. Therefore, the Library is UNIQUE in this district as an existing two story public building which requires an elevator to provide accessibility to all people, as required by State Law. Finally, the Library is the only building in the vicinity constructed of heavy masonry in an ornate style. This fact imposes special hardships on this project, because of the complexity and cost of adding to a building of this type. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because most of the non-residential buildings in the district are built right up to the property lines, forming a continuous front on Main Street. The Library's proposed addition is in the rear of the existing building, and is almost invisible from the street.
