Appeal No. 3862:
Application of HAROLD AND HATTIE STETLER for a Variance to
the Zoning Ordinance, Article III-A, Section 100-30A.4
(previously 100-32) for permission to locate accessory building
in an area other than the required rear yard. Location of
Property: 670 Wiggins Lane, Greenport, NY; County Tax Map
District 1000, Section 35, Block 4, Lot 28.7.
WHEREAS, a public hearing was held and concluded on
June 29. 1989 in the Matter of the Application of H^ROLD AND
ST[TLER under Appeal No. 3862; and
HATTIE
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of Wiggins Lane in the Hamlet of Greenport, Town of
Southold, and is identified on the Suffolk County Tax Maps as
District 1000, Section 35, Block 4, Lot 28.7.

2. The subject premises is a described parcel of land
containing a total area of approximately 39,000 sq. ft. and is
improved with a 1-1/2-story frame dwelling structure, as more
particularly shown on the copy of the survey submitted with this
application, having setbacks of: (a) 75 feet from the existing
bulkhead, (b) 35 feet from the westerly property line, (c)
44+- feet from the easterly property line.
3. By this application, appellants request a variance from
Article III-A, Section 100-30A.4 of the Zoning Code for
permission to locate 24' x 30' accessory building with a setback
of approximately three feet from the easterly property line, as
sketched on the copy of survey submitted for consideration. The
subject building is proposed for those accessory uses
specifically permitted in the zoning code for this R-40 Zone
District and at a height not to exceed 18 feet (per code).
4. Article III, Section 100-33 of the Zoning Code allows
accessory buildings to be located in the required rear yard
area, but does not provide for accessory buildings to be located
in any other yard area. The required rear yard area for this
parcel is that land area between the house and the bulkhead.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other alternative for appellants
to pursue; placing the structure in any other location on the
premises will also require variances;
(c) that the area chosen for the accessory structure
is close to the present blacktop parking and driveway areas and
is not unreasonable;
(d) that the variance will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience and/or order of the Town;
(e) that precedents have been established in area
waterfront communities for the same or similar placement of
accessory buildings in a yard area different than the seaward
areas of the dwellings;

(f) that in carefully considering the record and all
the above factors, the interests of justice will be served by
granting the variance, as applied and conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT a Variance in the Matter of the
Application of HAROLD AND HATTIE STETLER as applied under
Appeal No. 3862 for the placement of a 24' by 30' accessory
building in an area other than the required rear yard, SUBJECT
TO THE FOLLOWING CONDITIONS:
1. That the accessory building be located not closer than
five feet to the easterly property line at its closest point;
2. That the accessory building not exceed the height
provisions (per Code at 18 feet);
3. That no business enterprise be established within the
building;
4. Ail other provisions of the Code as pertain to
accessory uses and accessory buildings for this Zone District.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen, Sawicki and Dinizio. This resolution was duly adopted.

property is substandard; and by placing the garage in the sideyard,
no other properties would be affected.
2. The hardshipcreatedis UNIQUEand isnotshared by all prope~ies alike in the immediate
vicinity of this property and in this use district because the dwelling was constructed
in the 1970s with a setback at 75 feet from the bulkhead. We
understand that this area is the rear yard area under the ordinance.
The most feasible place to construct a three-car garage is at the
end of our asphalt driveway.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISZRICZbecause the premises wi11 continue to be used
for single-family residential.

Dear Sirs:
Today I was advised by the $outhold Town Building
Department that I needed a written letter of no jurisdiction for
my proposed accessory building at my residence, 670 Wiggins
Lane, Greenport.
This lot is bulkheaded its entire length, and the garage
building is proposed to be a minimum of 75 feet from the
existing bulkhead, along the easterly side of the dwelling.
Attached is the sketch of our proposed building location
and the County Tax Map.
If there is a fee required for this request, please let me
know.

during their regUlar meeting held on July 27, 1989 regarding the
above matter:
WHEREAS, Harold and Hattie Stettler applied to the Southold Town
Trustees for a permit under the provisions of the Wetland Ordinance
of the Town of Southold, application dated June 6, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on July 27, 1989 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,

RESOLVED that Harold and Hattie Stettler BE AND HEREBY IS GRANTED
PERMISSION UNDERTHEWETLANDORDINANCETO:
Construct addition to single family dwelling with the condition that
drywells be installed to contain roof runoff. Property located on
Gull Pond Lane, Greenport, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two ~
inspections are required and the Trustees are to be notified upon
completion of said project.
