Matter of ANTHONY BOLLETINO. Variance to the Zoning
Ordinance, Article III, Section 100-33, for permission to
construct an accessory shed and gazebo in front yard area.
Property Location: 16705 Main Road, Route 25, East Marion,
County Tax Map No. 1000, Section 23, Block 1, Lot 14.6.
WHEREAS, a public hearing was held and concluded on
December 19, 1989 in the matter of the Application of ANTHONY
BOLLENTINO, under Appeal No. 3892; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Main Road, Route 25, Town of East Marion, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 23, Block 1, Lot 14.6.
2. this is an application for Variances from the Zoning
Code Article III, Section 100-33, for permission to construct
accessory shed and gazebo in front yard area.

3. Article III, Section 100-33, In Agricultural-
Conservation and Low-Density Residential R-80, R-120, R-200, and
R-400 Districts, accessory building and structures or other
accessory uses may be located in required rear yard, subject to
the following requirements:
A. Such building shall not exceed eighteen (18) feet
in height.
B. Such buildings shall be set back no less than
three (3) feet from any lot line.
Ail such buildings in the aggregate shall occupy
not more than forty percent (40%) of the area of
the required rear yard.
4. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed shed and gazebo in any other
location on the premises will require other variance relief;
(c) that the area chosen for the shed and gazebo is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town:
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of ANTHONY BOLLETINO as applied under Appeal No.
3892, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 8' by 10' shed to be placed 36+- ft. from the
west property line and 220+- ft. from the Main Road.
2. That the shed only be used for storage purposes.
3. That the Gazebo be 50+- ft. from the east property
line and 130+- ft. from the Main Road.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
and Dinizio, (Absent Serge Doyen and Joseph Sawicki). This
Resolution was duly adopted.

L RIANCE OR SPECIAL EXCEPTION APPLICATIONS
Please submit the following at the time of filing your application:
1. Notice of Disapproval from the Building Inspector (after submitting your proposal
in writing for his review under the zoning regulations).
2.Application in triplicate (typed or neatly printed). Be sure to complete the
entire form, including the following:~
a. Permission or relief requested.
b. Street Address, Hamlet, Name of Subdivision (if any), County Tax Map Number
(from Notice of Disapproval).
c. Zone District (from Building Inspector's Office).
d. Current owners' names and addresses. If you are an agent or interested party,
please submit written authorization from owners. If the applicant or the
owner/interested party is a corporation, please furnish Disclosure Affidavit.
e. Variance forms must include difficulties or hardship imposed by strict compli-
ance of the zoning regulations (reverse side of Form ZB1).
f. Special Exception Form ZB2 must include uses and activities existing and those
proposed on this form as well as on the site maps under consideration.
g. Applications for signs must include general wording of sign, exact size, loca-
tion on the premises, written consent of property owners if applicant is not
the owner of the property, etc. ~:
h. The Article and Sections of the Code applicable must be furnished (see Notice
of Disapproval form).
3. Notice to Adjoining Property Owners Form:
a. Confirm current abutting owners' mailing addresses (as shown on Assessors tax
rolls). Please include owners of abutting private roads.
b. Send one copy (front side completed) together with copy of survey or map to
each abutting landowner by Certified Mail (postmarked by Post Office).
c. Return one completed form, signed and notarized on reverse, together with
postmarked Certified-Mail Receipts to the Board of Appeals. (Form to be
filled out exactly as those sent to the adjoining property owners.)
4. Environmental Assessment Form (Short and/or Long Forms) completed and signed.

a. Fronts along a waterway, freshwater or saltwater area, please be sure to submit
applications to the Town Trustees and N.Y.S. Department of Environmental Con-
servation as soon as possible [subdivisions included]. If applications are
pending, please confirm status and update.
b. Abuts other property that you own, please furnish copies of the current deed
and a single-and-separate title search from a title insurance company or
Suffolk County Clerk's Office. [This information may be submitted any
time prior to the public hearing as soon as available.]
c. Involves a subdivision, lot-line change, commercial use, or other project
also under review by the Planning Board, please be sure to obtain written
comments from the Planning Board for coordination with the Z.B.A. as early
as possible. [Planning Board 765-1938]
d. Involves an increase in density such as multi-dwellings, motels, subdivision
or set-off division, please submit copy of County Health Departmen~ Article 6
approval (and updates) when available.
7. Copies of:
a. current, or available, Certificate of Occupancy (from Building Inspector), and
b. current deed(s), c. building floor plan, height of structure, etc.
8.. Four original prints of survey or plan (certified to scale) showing all existing
and proposed structures, their setbacks from property lines, patios, raised decks,
fence enclosures, uses of all structures, size of lot, square footage and dimensions
of the entire new proposed construction, percentage of lot coverage including
pool, deck, patios (if any).
9. $150.00 filing fee [payable to "Southold Town Clerk"]. Please submit your packet
~Z.B.A. Office for initialing before payment is submitted to the Town Clerk's Off.
10. Please flaq all outside corners of proposed construction for on-site inspections as
early as possible. Photograph~ of areas of proposed construction (and areas seaward
if near wetlands) should be submitted at least lO days before the hearing date.
Written notification will be forwarded to you by way of a copy of the Legal Notice of
hearing (as published in the Suffolk Times and Long Island Traveler-Watchman). The
hearing will be held at the Southold Town Hall, Main Road, Southold, at the time allotted
in the Legal Notice. (The hearing will not start before the time given.) Please feel

elevated on North Sea Drive in Southold. The
nature of this application is a 12 by 32 foot
deck I believe. As the Pearlsteins are not here
tonight, it is my understanding that it is an
open deck and we would go with that interpretation
unless we hear something different. Is there

I have a copy of a sketch of a survey,
it's cut off on the name, the most recent date is
April 21st, it appears it's 1988. And the nature
of this application is a shed and a gazebo to
be placed on this particular piece of property
which I believe is presently in its location. And
I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in
the area. Kevin, would you like to be heard?
MR. KNOBLOCH: Yes. Just for the record
I'm Kevin Knobloch. When my client applied for
his variance for the pool and tennis court back
in January of 1988, they did not realize that they
were going to put a shed and a gazebo on the
property around the pool and the shed for the
tennis balls and the tennis machine and so forth.
So that's why we're back for a variance, so we
can be granted for a gazebo and a shed.
MR. GOEHRINGER: I haven't spoken to you
about this since prior to your filing the
application and I think that that is probably
sometime back in September; wasn't it, that we
had this discussion?

MR. GOEHRINGER: On a Saturday morning
over the telephone, telling me you were going
to bring this before us. Could you just give me
some indication, you don't have to do
on the actual distance that te gazebo
the property line on the east side and the
distance that the shed is from the west property
line? As I said, if you don't have
you can give it to us later.
MR. KNOBLOCH: The shed is
gazebo is 65

ACTION OF THE BOARD OF APPEALS
Appeal No. 3810:
Upon application of ANTHONY AND ROSEMARY BOLLETINO for a
Variance to the Zoning Ordinance, Article III, Section 100-32
for permission to locate accessory tennis court, swim~ingpool
and fence enclosure(s) in the frontyard area. Location of
Property: North Side (#16705) Main Road, East Marion , NY;
County Tax Map District 1000, Section 23, Block 1, Lot
14.6.
WHEREAS, a public hearing was held and concluded on
January 12, 1989 in the Matter of the Application of ANTHONY AND
ROSEMARY BOLLETINO under Appeal No. 3810; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:

Matter of ANTHONY AND ROSEMARY BOLLETINO
Decision Rendered January 23, 1989
1. By this application, appellants request a Variance
under Article III, Section 100-32 for permission to construct a
16 ft. by 32 ft. inground swimmingpool with four-ft, high fence
enclosure and 55 ft. by 115 ft. tennis court with 10-ft. high
fencing, in the frontyard area as shown on the sketched copy of
survey (lastly dated June 2, 1988 of Roderick VanTuyl, P.C.).
2. The premises in question is an 1.719+-acre parcel of
land situated along the north side of Main Road in the Hamlet of
East Marion, Town of Southold, and more particularly identified
on the Suffolk County Tax Maps as District 1000, Section 23,
Block 1, Lot 14.6.
3. The subject parcel is improved with a two-story
single-family house set back 255+- feet from the Main Road and
70 feet from the westerly property line.
4. Article III, Section 100-32 of the Zoning Code provides
accessory buildings to be located only in the required rear
yard.
5. For the record it is noted that a similar variance was
conditionally granted under Appeal No. 3059 in the Matter of the
Application of THEODORE AND MEL METALIOS for an accessory tennis
court in the frontyard area upon premises located two lots west
of the subject Bolletino premises.
6. Also noted for the record is the response dated
January 18, 1989 prepared by J. Kevin Mclaughlin, Esq.
concerning the inquiry of the Board of Appeals at its January
12, 1989 concerning the percentage of lot coverage as regulated
by Section 100-31, Bulk Schedule of the Zoning Code. The
percentage of lot coverage provided by the applicant was 11,825
square feet.
7. It is the position of this Board in considering this
application that:
(a) the circumstances are unique;
(b) the relief requested is not unreasonable and is
the minimal necessary;
(c) the relief requested will not alter the essential
character of the neighborhood;
(d) there is no other method feasible for appellant
to pursue other than a variance;

(e) the variance, if granted, will not in turn be adverse
to the safety, health, welfare, comfort, convenience, or order
of the town, or be adverse to neighboring properties;
(f) the interests of justice will be served by granting
the variance.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, to GRANT the relief requested under Appeal
No. 3810 in the Matter of ANTHONY AND ROSEMARY BOLLETINO for
permission to locate inground swimmingpool with fence enclosure
and tennis court with 10-ft. high fencing, as accessory uses in
the frontyard area, to be used incidental to the residential use
of the premises, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Waiver or other action by the Southold Town Trustees
concerning existence of wetland grasses in the southerly portion
of the property prior to commencing activities for construction;
2. Minimum 15 ft. setback from the easterly property line
