Special Exception to the Zoning Ordinance, Article III, Section 100-30B (14), for a Winery for the Production, Storage and the Retail Sale of Wine. Property Location: 34876 Main Road, Cutchogue, County Tax Map No. 1000, Section 097, Block 01, Lot 12.1. WHEREAS, a public hearing was held and concluded on June 27, 1990 in the matter of the Application of RALPH & PATRICIA PUGLIESE under Appeal No. 3831; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the north side of Main Road (Route 25), Hamlet of Cutchogue, and is identified on the Suffolk County Tax Maps as District 1000, Section 097, Block 01, Lot 12.1. 2. This is an application for a Special Exception from the Zoning Code Article III Section 100-30 B (14), for a Winery for the Production, Storage and the Retail Sale of Wine. Article III, Section 100-30, The purpose of the Agricultural-Conservation (A-C) District and the Low-Density Residential R-80, R-120, R-200 and R-400 Districts is to reasonably control, to the extent possible, prevent the unnecessary loss of those currently open lands within the town containing large and contiguous areas of prime agricultural soils which are the basis for a significant portion of the town's economy and those areas with sensitive environmental features, including aquifer recharge areas and bluffs. In addition, these areas provide the open rural environment so highly valued by year-round residents and those persons who support the Town of $outhold's recreation, resort and second- home economy. The economic, social and aesthetic benefits which can be obtained for all citizens by limiting loss of such areas are well documented and have inspired a host of governmental programs designed, with varying degrees of success, to achieve this result, For its part, the town is expending large sums of money to protect existing farm acreage. At the same time, the town has obligation to exercise its authority to reasonably regulate the subdivision and development of this land to further the same purposes while honoring the legitimate interests of farmers and other farmland owners. 4. The property in question is improved with an existing one family dwelling with a barn located towards the north of the dwelling and a shed being relocated on the premises. This parcel contains an area of 22+- acres in this A-C District. 5. In considering this application, the Board finds an determines: (a) that the use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; (b) that the Special Exception will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (c) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the Special Exception, as applied conditionally noted below. Accordingly, on motion by Mr. Doyen, seconded by Mr. Goehrigner, it was Page 3 - Appl. That the Winery/Barn only be used for the production, storage and the retail sales of wine and not be used for habitual dwelling. 2. That the Winery/Barn not exceed 4,221+- sq. ft. in size, that the portion of the barn being used for the Retail Sale of the wine product not exceed 726+- sq. ft. and that the storage area not exceed 3,500+- sq. ft. 3. That the Parking area be designed by the Southold Town Planning Board in the Site Plan evaluation. 4. That the buildings be located on this parcel as shown on the survey dated June 22, 1990 by R. Van Tuyl, showing a ten [10) foot Right-of-Way leading to the rear of the property. Vote of the Board: Ayes: Messrs. Goehrigner, Grigonis, Doyen and Dinizio, (Absent Joseph Sawicki due to illness). However, the fee that was submitted with the application was not correct. The new fee can be computed as follows: "The application fee for a new site plan shall be one hundred and fifty dollars ($150.00) per acre or any fraction thereof, plus two and one-half cents (2.5) per square foot of building area." Please submit a check for 'the difference between the one-hundred (100) dollars that was submitted under the old fee schedule and the amount due under the new schedule. Upon receipt of the remainder of the fee, the Board will proceed with your application. However, before proceeding, you should be aware that under the zoning code, a winery is permitted "for the production and sale of wine produced from grapes grown in the vineyards on which such winery is located." (Section 100-31 B. (13).). At this point in time, the property that you wish to use for the winery is currently contiguous with the vineyard. This property is also the subject of a minor subdivision application before the Board. If you and your partner proceed with that application, the proposed winery will become physically separated from your vineyard, since your partner will own the parcel that lies between the house (proposed winery site) and the vineyard. The end result is that your proposed winery will not be on or contiguous to the vineyard, hence not in compliance with the zoning code. It is suggested that you consider the following options before proceeding with your application. One is to subdivide the property differently so that the portion with the house and the proposed winery will be contiguous with the vineyard. Upon recommendation of the Planning Board and approval of the Town Attorney, the Building Inspector may revoke an existing Certificate of Occupancy upon a showing that the subject premises is being occupied or used in violation of an approved site plan and may direct that such occupancy or use be discontinued. The Town Attorney is authorized to commence proceedings in a court of appropriate jurisdiction to restrain said use or occupancy. Section 100-254. Review Procedure. A. Presubmisslon conference. Prior to the submission of a site development plan, the applicant or his agent shall meet with the Planning Board or its representive. The purpose of such conference shall be to discuss proposed uses or development plan elements that shall be submitted to the Planning Board in order for said Board to determine conformity with the provisions and intent of this Article. Said meeting shall take place within thirty {30) calendar days from the date of written request therefor. Bo Site Development Plan. Nine (9) copies of the site development plan application and any related information as defined during the presubmission conference shall be submitted to the Planning Board within four ~) months of the presubmission conference. If a site development plan application is not submitted within four [u~) months following a presubmisslon conference, another conference may be required by the Planning Board. 1. Within ten ~10) business days of receipt of the application the Planning Board shall determine whether to accept, reject or request revision of the application. 2. If the Planning Board determines said application to be acceptable, but in need of revision, it shall notify the appllcant in writing wherein said application is deficient within thirty business days. 3. In the case of a variance or special exception application requiring site plan approval, the site development plan application shall be subjected to preliminary review and written comments by the Planning Board within sixty 160) days of such request by the Board of Appeals. a. I have a copy of the Suffolk County Tax Map indicating surrounding propertie in the area. I will ask Mr. Moore: Would you like to be heard? MR. MOORE: Let me give you a revised survey subdivision map at the request of the Planning Board. W~ have redone this now to a 22-acre piece of property, by way of running a 10-foot strip of land. The issue that comes up is the question about the winery being located on the property, and working on grapes primarily grown on the premises. The Planning Board suggested, and we go along with it, to run a 10-foot strip clear up. (Discussion held off the record) MR. MOORE: Originally we had composed a three-foot lot subdivision, with the lot winery being located on a two-acre piece of property. At the Planning Board's request, we are going to make that a two-lot subdivision with the winery now being located on the same parcel of land on which the grapes were grown to avoid any problem with respect to the require 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 57 ments in our Zoning Code. THE CHAIRMAN: This 10 feet is deeded. MR. MOORE: Right. It will be the entire parcel. It would begin down on the Main Road and clear alon§ the 10 . feet. It is not a right-of-way. It is deeded. So that parcel, in fact, would be 22 acres in size. You can have this one. THE CHAIrmAN: Wonderful. Let the record show that I also have a map from R. VanTuyl. It appears to be June 22, 1990, the most recent date. The size of the barn is how large? MR. PUGLIESE: I believe it is 63 feet by 60 feet. I believe I submitted the plan. MR. MOORE: I have got a site plan prepared by Mr. VanTuyl,.amended May 31, 1990, showing the proposed winery and it doesn't show the dimensions of the building, but with the scale map I will get that figure to you. I think we are going to have more than enough parking there. This was done, the site plan which was done just by way 'of example, not intended to limit the number of parking spaces. I think you have a copy of that, I believe. It just shows, it is a very simple procedure, more than adequate parking. It is located on State Route 25, as are many of the other wineries in town. Mr. Pugliese points out to me the speed zone i~ that area is 35 miles an hour. So we are not going to have people speeding by. The proposed winery is located behind the residence, well off the property. Again, as many of the wineries, it is an agricultural building that will be converted, as were the others, assuming the use is granted by the Board for the winery. It has been used in the past as trucking, in the more recent past, with Mr. Pugliese's grapes being grown to the north. We think we have satisfied the criteria of the Code that would properly locate it, with the Board's approval, to operate a nice relatively small winery. Mr. Pugliese is not going to operate on the size or scale, for example, of Pindar. He has fewer grapes and would be operating a smaller facility in size.
