Matter of MGH ENTERPISES, INC. - ORIENT BY THE SEA.
Special Exception to the Zoning Ordinance, Article III, Section
100-31 C.9 (e), as disapproved, for permission to construct an
off-premises sign. Property Location: 66040 North Road,
Greenport, County Tax Map No. 1000, Section 40, Block 04, Lot 01.
WHEREAS, a public hearing was held and concluded on June
27, 1990 in the matter of the Application of MGH ENTERPRISES,
INC - ORIENT BY THE SEA, under Appeal No. 3948; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of North Road, County Road 948, Hamlet of Greenport, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 40, Block 04, Lot 01.
2. This is an application for Variances from the Zoning
Code Article III, Section 100-31 C.9 (e), for permission to
construct an off-premises sign.

3. Article III, Section 100-31 C.9 (e), Accessory uses,
limited to the following uses and subject to conditions listed
in 100-33 herin: The following signs, subject to the
supplementary sign regulations hereinafter set forth in Article
XX: (e) Such other signs as may be authorized as a special
exception by the Board of Appeals as herinafter provided.
4. In considering this application, the Board finds and
determines:
(a) that there is no other method for appellants to
pursue; and placing the off-premises sign in any other location
on the premises will require other special exception relief;
located;
that the area chosen for the sign is not unreasonably
(c) that the special exception will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience and/or order of the Town;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the special exception as applied conditionally noted
below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Grigonis it was
RESOLVED, to GRANT a Special Exception in the matter of the
application of MGH ENTERPISES, INC. - ORIENT BY THE SEA as
applied under Appeal No. 3948, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. That the off-premises sign not be illuminated and only
be single sided facing in the easterly direction.
2. That the sign be no closer than 25 ft. from the
southern property line and 30 ft. from the eastern property line.
3. That the sign be placed approximately 4 ft. above
ground and not contain an area more than 24 sq. ft.

A number of sign owners in the Town of Southold have been informed that their
sign sites are in violation of Section 88 of the Highway Law. The owners,
referred to above, have appealed, submitting to us a copy of an approval of
their respective sites issued by your office.
It appears that all parties involved have acted with good intentions, and
were not aware of the fact that, in addition to Town requirements, State
requirements apply to certain County roads. Nevertheless, the State's
requirement of commercial zoning for sign sites cannot be waived. We are
therefore obliged to advise each owner to remove their sign and either apply
for an alternate site, or for directional-type signing of limited size. The
owners will soon be advised that we will allow 30 days for the removal of the
signs.
For your reference, we are enclosing a copy of an excerpt from Part 150 of
Title 17 of the Official Compilation of Codes, Rules, and Regulations. (See
the highlighted text of Section 150.5.) These requirements also apply to
Main Street in Greenport, and Route 25 fr°m Main Street to Orient Point.
Other requirements exist that pertain to signs installed on State property at
any location.

property. I do not have the approximate locatic
of the property except it is to the side, the
east side of the Geier property. There is a
parcel approximately 10.4 acres. The original
sign was a four by six. The application has
requested that the sign be approximately 72
square feet. I have a copy of the Suffolk
County Tax Map indicating this and surrounding
properties in the area.
MR. HASSE: Bob Haase. The sign was
supposed to be 32 square feet.

be too small.

at home regarding this, at the time, and he
did mention to me that his property was business
This property was business property. It was
business property at one time. It is now
a hamlet density property, which is not
business property. I will admit to you we did
grant a sign in a similar location, in the
immediate area which also lost its business
value or evaluation in reference to zoning, and
we did that because there was a sign there
prior to this. We are going to have to take a
long hard look at this one and see what we
can do, but would you have Mr. Ketcham call our
office and indicate to us what the exact
location of the sign will be on the Geier
property and I assume you have permission from
the Geiers to put the sign up?
MR. HAASE: Yes.

be lighted.
MR. HAASE: Yes.

I guess it really wouldn't be fair to let you

problem with the sign. I have a problem with
the contents of the sign and that it may be
miles away from the location that it is telling
the people to go to. I just wanted you to
know I had that particular problem. I don't
know if it is grounds enough not to grant it.
So we will have to look into it. I just an
wanted you to know that was my way of thinking.
