Matter of AGNES AND CHERYL PAGNOZZI. Variance to the
Zoning Ordinance, Article XXIV, Section 100-244 B, for
permission to construct an addition to existing dwelling,
proposed construction will have insufficient side yard.
Property Location: 1450 Jockey Creek Drive, Southold, County
Tax Map No. 1000, Section 70, Block 5, Lot 17.
WHEREAS, a public hearing was held and concluded on
February 1, 1990 in the matter of the Application of AGNES AND
CHERYL PAGNOZZI under Appeal No. 3899; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
W~EREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of Jockey Creek Drive, Town of Southold and is identified
on the Suffolk County Tax Maps as District 1000, Section 70,
Block 5, Lot 17.
2. This is an application for Variances from the Zoning
Code Article XXIV, Section 100-244 B, for permission to
construct an addition to existing dwelling, proposed
construction will have insufficient side yard setbacks.

3. Article XXIV, Section 100-244 B, A nonconforming lot
separately owned and not adjoining any lot or land in the same
ownership at the effective date of this Article and not
adjoining any lot or land in the same ownership at any time
subsequent to such date may be used, or a building or structure
may be erected on such lot for use in accordance with all the
other applicable provisions of this chapter, provided that proof
of such separate ownership is submitted in the form of an
abstract of title showing the changes of title to said lot,
which abstract shall be in the usual form, shall be certified by
an attorney or a company regularly doing such work in Suffolk
County or by a corporation duly licensed to examine and ensure
title to real property in Suffolk County and shall contain a
certification that no contiguous property was owned by an owner
of the property involved since the date of any previously
applicable Zoning Law. Such lot shall be granted relief for
front side and rear yard dimensions as follows.
4. The subject premises for the proposed addition is
known and referred to as being 35 ft. on the east side of the
property line, 11 ft. south side, 12 west side of existing one
family dwelling and 22 ft. on the north side of the property
line.
5. In considering this application, the board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed addition in any other location
on the premises will require other variance relief;
(c) that the area chosen for the proposed addition is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of CHERYL AND AGNES PAGNOZZI as applied under Appeal
No. 3899, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the addition to existing one story frame house be
21+- ft. northwest and 21+- northeast of the property line.
2. That the sideyard be 11 ft. from the east side of the
property line, thereby proposed addition be reduced by 1 ft. so
that it's 10 ft. for the addition on the second proposed garage.
Vote of the Board: Ayes: Messrs. Goehringer,
and Dinizio (Absent Joseph Sawicki and Serge Doyen.

ALSO DEFINITELY DETRACT FROM THE PRESENT VALUE OF MY
PROPERTY.
MOST GARAGES IN OUR IMMEDIATE VICIN fTY O0 NOT FACE THE
STREETt OUT ARE FACED AWAY SO AS TO GIVE A BETTER
APPEARANCE. THEIRS WOULD FACE THE STREET AND BE MOST
UNATTRACTIVE.
IF THIS GARAGE IS ADDED TO THEIR HOUSE, THE ADDITIONAL
PAVING WILL BE REQUIRED FOR THE DR~VEWAYe THIS WILL
CUT DOWN ON OPEN GROUND SPACE NEEDED FOR ABSORPTION OF
RAINWATER AND WILL FURTHER REDUCE THE BEAUTY OF OUR AREA.
THE VARIANCE, IF GRANTED, WILL CONTRIBUTE TO THE FURTHER

Drive, and I am opposed to the variance for
the reason I stated in my letter, which is
in your file.
I feel that present resolution
limiting the distance to 15 feet from the
property line is to protect people like
myself from having a building too close to
mine. As it is now, our two houses are
closer together than any others in our
immediate neighborhood. I do not want to
look out my window and see a blank wall so
close. If you grant this variance I feel
that it will lower the value of my property,
and I am very much opposed.

Therefore, no permit is required under the Tidal Wetlands Act (Article 25
of the Environmental Conservation Law). Please be advised, however, .that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour or topographic crest without a permit. It is
your responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation of other alteration or disturbance to the
ground surface or vegetation in this area as a result of your project.
Such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
construction area) or erection of a temporary fence, barrier, or hay
bale berm.
Please npte that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.
