Matter of NICHOLAS NICKOLAUS. Variance to the Zoning
Ordinance, Article X~III, Section 100-239d a, as disapproved for
permission to construct addition to existing one family dwelling
and accessory building, proposed construction is less than 100
ft. from bluff of Sound in this R-80 Zone District. Property
Location: 17555 Soundview Avenue, Southold, County Tax Map No.
1000, Section 51, Block 1, Lot 2.
WHEREAS, a public hearing was held and concluded on
December 19, 1989 in the matter of the Application of NICHOLAS
NICKOLAUS, under Appeal No. 3868; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
andthe surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Soundview Avenue, Hamlet of Southold, and is identified
on the Suffolk County Tax Maps as District 1000, Section 51,
Block 1, Lot 2.
2. This is an application for Variances from the Zoning
Code Article XXIII, Section 100-239d A, for permission to
construct addition to existing one family dwelling and accessory
building, proposed construction will be within 100 feet of the
Sound.
3. Article XXIII, Section 100-239d (A) (1), requires all
buildings located on lots adjacent to Long Island Sound and upon
which there exists a bluff or bank landward of the shore or
beach shall be set back not less than one hundred (100) ft. from
the top of such bluff or bank.

4. The subject premises for the proposed cabana is known
and referred to as being 12' by 12', and the proposed one story
additions are located west of the property line and will be 20'
by 22' and 12' by 14'.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed cabana and additions in any
other location on the premises will require other variance
relief;
(c) that the area chosen for the cabana and additions is
not unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Dinizio, it was
RESOLVED, to GRANT a Variance in the matter of the
application of NICHOLAS NICKOLAUS as applied under Appeal No.
3868 for the placement of cabana and additions to existing
dwelling, SUBJECT TO THE FOLLOWING CONDITIONS.
That the cabana only be used for storage purposes and
that it have no sleeping quarters.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen and Dinizio, (Absent Joseph Sawicki). This resolution was
duly adopted.

is less than 100 feet from the existing top of bluff along the Long Island
Sound.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF, THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the proposed improvements would not increase existing setbacks
on the property from. t~ current situation. The existing improvements of residence,
swimming pool, porch~,~dl~?a~d~pb6q retaining walls, are closer than the current
code requirement of 100-foot setback. The purpose of the addition on the east side
of the house is to construct a master bedroom on the main level for retirement
purposes.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this prope~y and in this use district because the existing house was built in
this location prior to the 100-foot setback requirement. Existing residence, porch,
pool and pool retaining walls have been established by prior building permits.
Relocation of these improvements to meet current code of 100-foot setback would
be an unreasonable hardship.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because it is an existing single family residence
with large significant front yard and side yard setbacks which will make the
proposed improvements insignificant to adjacent neighbors and the surrounding
community.

Appeal No. 3824:
Application of NICK AND KATIE NICKOLAUS for a Variance to
the Zoning Ordinance, Article III, Section 100-33 (previously
100-32) for permission to locate accessory building in an area
other than the required rear yard. Zone District: R-80.
Location of Property: 17555 Soundview Avenue, Southold, NY;
County Tax Map District 1000, Section 51, Block 1, Lot 2.
WHEREAS, a public hearing was held and concluded on
March 9, 1989 in the Matter of the Application of NICK AND KATIE
NICKOLAUS under Appeal No. 3824; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Sound View Avenue in the Hamlet and Town of Southold,
and is identified on the Suffolk County Tax Maps as District
1000, Section 51, Block 1, Lot 2.

2. The subject premises is a described parcel of land
containing a total area of 3.01 acres, lot frontage of 130.0
feet (lot width at the principal building line approximately 278
feet, and lot depth of 550+- feet.
3. The subject premises is improved with a single-family,
two-story frame house and inground swimmingpool with fence
enclosure along the westerly side of the dwelling, all as
sketched on survey dated February 10, 1981 (of Roderick VanTuyl,
P.C.).
3. By this application, appellants request a variance from
Article III, Section 100-33 of the Zoning Code for permission to
locate 10' x 18' one-story storage shed along the existing pool
fence enclosure with a setback of approximately 90 feet from the
bluff and 60+- feet from the westerly property line, all as
sketched on the copy of survey submitted for consideration.
4. Article III, Section 100-33 of the Zoning Code requires
accessory buildings to be located in the required rear yard
area. The required rear yard area for this parcel is that land
area between the house and the bluff.
5. It is noted that at the time of the filing of this
application on February 3, 1989, Article XI, Section 100-119.2
of the previous zoning code was not included in the newly
adopted zoning code amendments (when enacted on or about January
22, 1989). For practical purposes, it is noted that the
location of the subject pool shed along the outside of the fence
enclosure is not much different than locating same within the
fence enclosure, particularly due to the great distance in the
yard setbacks (which will not require additional relief by way
of a variance).
6. In considering this application, the Board also finds
and determines:
(a) there is no other alternative available for
appellants to pursue other than a variance;
(b) the variance requested is uniquely related to the
property and will not alter the essential character of the
neighborhood;
(c) the variance requested is the minimal necessary
to afford relief and is not substantial;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience or order of the
town, or be adverse to neighboring properties;
(e) in view of all of the above factors, the

interests of justice will be served by granting the relief, as
requested and conditionally noted below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, to GRANT the relief requested for location of a
10' by 18' pool-storage shed, at a height not to exceed 10 feet,
along the existing fence enclosure, as applied under Appeal No.
3824 in the Matter of NICK AND KATIE NICKOLAUS, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. Accessory shed shall be used for storage purposes
incidental and accessory to the residential use of the premises;
2. Accessory shed shall not be used as sleeping quarters;
3. No kitchen or food preparation shall be permitted;
4. Shower doors must be constructed along the outside wall
of building (must open to the outside, rather than a single
entry from the inside of building).

Based on the information you have submitted, the New York State Department
o~vironmental Conservation has determined that the parcel
project is:
Greater than 300' from inventoried tidal wetlands.
Landward of a substantial man-made structure
greater than 100' in length which was constructed prior to 9/20/77.
Landward of the 10' above mean sea level elevation contour on a
gradual, natural slope.
Landward of the topographic crest of a bluff, cliff or dune which is
greater than 10' in elevation above mean sea level.
Therefore, no permit is required under the Tidal Wetlands Act (Article 25
of the Environmental Conservation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour or topographic crest without a permit. It is
your responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation or other alteration or disturbance to the
ground surface or vegetation in this area as a result of your project.
Such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
construction area) or erection of a temporary fence, barrier, or hay
bale berm.
Please note that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.

responsibility of obtainina any necessary permits or approvals from other

An Environmental Assessment (Short) Form has been submitted
with the subject application indicating that no significant
adverse environmental effects are likely to occur should be
project be implemented as planned.
It is determined that this Board's area of jurisdiction
concerning setback, area or lot-line variances determines this
application to fall under the established list of Type II
Actions. Pursuant to Section 617.2jj, this Department is
excluded as an involved agency.
This determination shall not, however, affect any other
agency's interest as an involved agency under SEQRA 617.2jj.

is before us tonight. And I have a copy of the
Suffolk County Tax Map indicating the surrounding

· MR. FEELEY: My name is Lawrence Feeley,
I'm the architect for Mr. Nickolaus, I'm speaking
on his behalf. What we've brought with us is an

aerial of the property showing the existing
residences to the sides of the residence as it
exists. We've also brought, which I believe you
have in your possession, this drawing here which
show. the existing residence in the solid line and
the proposed additions. It's colored in for you
to be able to see. What those additions entail
is a master bedroom addition on this end of the
house which would afford them the ability to keep
all the living space at one level. Being that
they're going to use this for a future retirement
home, they decided that they would like to have
that at that level. This addition over here in
the front would be a breakfast area, two modest
additions, which would be a window extension to
restore some of the architectual character of the
house as it once existed and then a small kitchen
addition in the back. On this we've also shown
all the set backs to the current structures and
the proposed structures and one that we would like
to point out is the set back which exists by the
existing pool structure retaining wall which is
20 feet. We haven't infringed any closer to the
top bluff with any of the new construction,

any further towards the bluff in any of the
existing construction that exists.

The cabana is for the pool.
I have a plan of it here. It would mainly be for
the pool filtration. A small room for pool
mechanical and a small space for changing with
toilet facilities and a shower.
MR. GOEHRINGER: Okay.
MR. FEELEY: I could describe the additions
to you if you would a little more.
MR. GOEHRINGER: You can just show them to
US.

FEELEY: The floor plan here shows the
master bedroom addition off to the east end,
some interior renovations in the master suite
which would become the toilet room, the new
breakfast room addition and these two little bay
extensions on the front and also the kitchen,
a solar extension in the back. That's about it.

to this we felt destroyed some of the
architectural character of the house and we want
it back without redoing in the front
to restore
here.
MR. GOEHRINGER: Okay. We thank you very
much. Is there anybody else who would like to
speak in favor of this application? Is there
anybody who would like to speak against the

What is your time limit on this; are you going to
try and build this this winter?
MR. FEELEY: I would think that we will
be waiting until the springtime. One thing I
did fail to mention is that some of the grade in
the back we were going to leave as existing and
we're not going to build it up.
MR. GOEHRINGER: Okay.
MR. FEELEY: And also that the addition
is cumulative of the whole structure. It's
20 percent of the floor area.
MR. GOEHRINGER: Okay. We may address it
tonight, I'm not positive, but we'll see how it
goes. If not, it would be in about two weeks
