Matter of ELSIE (JEP~ED) PARKIN. Variance to the Zoning
Ordinance, Article III A, Section 100-30A.3, Bulk and Parking
Regulations in this Division of Land. Property Location: 7575
Skunk Lane, Cutchogue, County Tax Map No. 1000, Section 104,
Block 04, lot 27.
WHEREAS, a public hearing was held and concluded on April
19, 1990 in the matter of the Application of ELSIE PARKIN, under
Appeal No. 3925; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of Skunk Lane, Hamlet of Cutchogue, and is identified on
the Suffolk County Tax Maps as District 1000, Section 104, Block
04, Lot 27.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30A.3 Bulk and Parking
Regulations in this Division of Land.

3. Article III A, Section 100-30 A.3, No building or
premises shall be used and no building or part thereof shall be
erected or altered in the Low-Density Residential R-40 District
unless the same conforms to the requirements of the Bulk
Schedule and of the Parking Schedule, with the same force and
effect as if such regulations were set forth herein in full.
4. The subject premises in question for Lot one (1) will
be 37,500+- square feet, and contain a one and a half story
house, 12+- ft. from the north property line and lot two will be
27,400 square feet and contain a one story framed house
approximately 10 ft. from the north property line and 14+- ft.
from the east property line.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and any division of this land will require other
variance relief;
(c) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(d) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

Tuyl Dated 12/12/90, Lot number one (1) contain 37,500
sq. ft., Lot number two (2) 27,400 sq. ft.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance
is requested for the reason that the applicant would like to divide this 64,900 square
foot parcel with two dwellings into two separate parcels, one containing 37,500
square feet and the other containing 27,400 square feet.

REASON FOR APPEAL Continued
]. STRICT APPLICATION OF THE ORDINANCE would produce practical difficu~ies or unn~ces-
so~ HARDSHIP becau~ this parcel which is set up for two separate families, would
have to be kept in single ownership. Each lot already has a dwelling. To
keep this as one property when it is already essentially two lots is
impractical and burdensome.
2 The hardship created is UNIQUE and is not shared by all prope~ies alike in the immediate
vicinity of this property and in this use district becau~ this parcel is twice as large as
most of the other properties to both sides of it along the northerly side of
Bay Avenue.
3. The Variance would obsewe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because dividing this parcel into two lots would
only result in the formation of two lots approximately the same size as
their neighbors. Since there are already two dwellings nothing would change
as a result of the division.

Be it RESOLVED that the Southold Town Planning Board start the lead agency
coordination process on this unlisted action.
WHEREAS, the Zoning Board of Appeals granted a variance subject to certain
conditions on May I, 1990 (Appl. No 3925); and
WHEREAS, condition Number I of the ZBA approval (that both houses
contain a valid Certificate of Occupancy) is in effect, but it is not necessary
that this condition be met prior to any subdivision approval;
Be it therefore RESOLVED that the Southold Town Planning Board grant
sketch approval on the map dated December 5, 1996.
Sketch plan approval is conditional upon submission of final maps within slx
months of the date of sketch approval, unless an extension of time is
requested by the applicant, and granted by the Planning Board. The final
maps, six (6) paper prints and two (2) mylars must contain a current stamp
of Health Department approval and must be submitted before a final public
hearing will be set.
The sketch plan has been referred to the Town Trustees for review. You will

The following is in response to your request of April 18,
1990 for co~m~ents on application No. 3925.
The Planning Board is not in favor of this potential minor
subdivision unless Health Department approvals can be obtained
for separate water and sewage systems. The Planning Board is
not sure if the smaller house has its own well and septic system.
The wetland area around the pond should be flagged in order
to determine the total buildable area of the second lot.
Further, the Trustees and the Conservation Advisory Council
should be asked for their input on the accuracy of the wetlands
line. A permit from the Trustees may be required because this
pond is listed on the Town's freshwater wetland inventory.

What I'd like to say about the application, we
have been in a similar situation in the past
where two houses on one lot, the practical difficult'
being that it is difficult and burdensome two
houses on one lot, in terms of selling, renting
and keeping up the property. And I'd like to
stress that the size of the lot in comparison to
the surrounding lot on the same zoning is large
to subdivide property and would enable the neighbor-
hood to have a lot of similar si~e to surrounding
lots and would also be easier for property owners
to keep up their P.C.O.'s.
I submit for the applicant, there has been
an access for more than thirty-three years, both
dwellings occupied since prior to the zoning code.
This is the former Petruchi (phonetic) houses and
I assume there was an active C.O. on both-these
houses.

has Mrs. Parkin owned the property?
MS. HAGEN: Since 1971. She owned both
parcel since 1971. She and her husband obtained
