ACTION OF THE BOARD OF APPEALS
Application for VALERIE KRAMER. Variance to the Zoning
Ordinance, Article XXVIII, Section 100-281 and Article XXIII,
Section 100-239.4B for permission to construct new dwelling
structure with an insufficient setback from the existing
bulkhead and from the easterly (front) property line along
Manhanset Avenue. Lot area of parcel is nonconforming in this
R-40 Zone District. Location of Property: 730 Robinson Road
and 980 Manhanset Avenue, Greenport, NY; County Tax Map Parcel
No. 1000-34-5-20.
WHEREAS, a public hearing was held on November 1, 1990,
which time all who desired to be heard were heard and their
testimony recorded;
at
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located at Greenport, Town
of Southold, with frontages along two streets: Manhanset Avenue
and Robinson Road, and with frontage along a dredged canal of
"Sterling Creek." The premises is more particularly identified
on the Suffolk County Tax Maps as District 1000, Section 34,
Block 5, Lot 20.
2. The premises is presently vacant and is quite unique in
its size, shape and location. Its size is 13,350 sq. ft.; its
dimensions are 30 ft. (along Robinson Road to the west) x 209.96
ft. in depth x 93.86+- ft. along Manhanset Avenue. The parcel
has limited building area due to its frontage along the dredged
canal (which is bulkheaded) and two front yard areas.
3. By this application, appellant requests variances for
permission to locate a new dwelling structure with a setback of

21+- feet to the bulkhead as initially submitted with this
appeal application.
4. On November 15, 1990, an alternative sketch was
submitted for board consideration, at the Board's request,
shifting the proposed house approximately 10-12 feet toward the
westerly property line in order to try to gain a greater
distance from the bulkhead. One foot was gained on the bulkhead
setback, but the side yard setback was reduced from the
originally proposal of 16-1/2 feet to 10 feet from the southerly
side property line. The front yard setbacks would be in
conformance with Section 100-244B as pertains to nonconforming
lots. Although the amount of relief requested by this
application is substantial in relation to the requirement, the
setbacks requested are not out of character with those generally
existing in the immediate neighborhood.
5. For the record it is noted that permits have been
issued by: (a) the Southold Town Trustees on Septem-
ber 27, 1990; (b) Suffolk County Health Department under Permit
No. 88-SO-147; (c) N.Y.S. Department of Environmental
Conservation by Permit No. 10-88-1400 dated January 25, 1990.
6. In considering this application, the Board also finds
and determines:
(a) the nonconformities of the land and building in
question lend to the practical difficulties;
(b) the difficulties cannot be obviated by some
method feasible for appellant to pursue other than a variance;
(c) the alternative location of the dwelling as
approved will not change the essential character of this
residential community;

RESOLVED, to GRANT the relief requested under Appeal
No. 3971 and shown on the "alternative sketch" for the location

of a new dwelling structure, SUBJECT TO THE FOLLOWING:
1. That the setback from the existing bulkhead be not
closer than 22 feet;
2. That hay bales be placed prior to commencement of
foundation or other construction activities approximately 15
feet from the house towards the water and extending a distance
of not less than 60 feet wide to the southerly and easterly
portions of the dwelling and remain until such time that an
adequate ground cover can be grown to prevent disturbance of the
land between the proposed dwelling structure and the existing
bulkhead and to prevent run-off into the canal. (There must be
also no disturbance to bulkhead tie backs).
3. That the side yard setbacks be not less than ten (10)
feet on each side (and minimum total side yard setbacks at 20
feet).
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, and
Dinizio. (Absent were: Members Grigonis and Sawicki.) This
resolution was unanimously adopted.

Dear Mrs. Kramer:
This letter will acknowledge receipt of your recent
application filed with our office. The Board Members will be
conducting individual field inspections and other reviews as
requir.ed by state and local laws.
A copy of the Legal Notice as published by our office in
the Suffolk Times and L.I. Traveler-Watchman, Inc. will be
forwarded to you within a couple of days to confirm the time of
the hearing, which has been calendared for Thursday evening,
November 1, 1990.
Also, in the interim, it is requested that you furnish us
with the total square footage of the proposed construction in
order that a review (if not done by the building inspector} may
be made as to compliance with the maximum-permitted lot coverage
of 20 percent. Should there be a need for a variance concerning
the lot coverage, you would be permitted to amend your paperwork
to include a variance for this (before we advertise notice of
the hearing).
Please feel free to call our office at any time if you have

V&lerte's husband. I Just wanted to add, we
bought the lot with the expectation it is
buildable. In the last 25 years all the
other lots of similar size have been getting
building permits. I think this is one
only three vacant lots left in the
subdivision shown.
?HE CHAIRMAN: When did you buy the
lot, Hr. Kramer?
MR. KRAMER: I think it was 1980.

Mit. KRAMER: As you can tell from the
map, it is a triangular lot and -- there is
not very much ·face there. I don't think we
are doing anything that is -- you know, more
recently there was a house built right on
the -- not a house, but something right on
Manhanset, right on the water.
THE CHAII~AN: That was the nature of
a lawsuit before this Board.
MR. KRAMER: If ! go any further
back, then I am going onto Hanhanset, which
is a'ver~ busy'street. I sm saying the
triangle gets bigger towards Manhanset, and
! want to get it towards Robinson. Bo ! am
losing the apex in getting tighter towards
Robinson.
THE CHAIRMAN: I wouldn't have any
objection to that. I would rather see you
shim the side yards more if you've got to
Robinson. My concern is the 21 feet from

the existing bulkheads right now. In other
words, if you are holding -- you have a 10-
foot side yard at this particular time to
the north --
HR. KRMfER: Yes, it is approximately
to the north.
THK CHAIRMAN: Heaning closer to the
north side.
HR. KRAHER: Closer to the west.
Hoping it down further may give us greater
distance for the diagonal, for the bulkhead.
Nell, it is a tiny parcel and Hanhanset is a
very busy road. I would like to stay as
much off that as possible.
THE CHAIRI~N: I couldn't agree with
yOU more.
HR. KRAHER: I don't think we are
going to do anything to the bulkhead. It ia
new and it would be ecologically sound and
certainly aesthetic.
THE CHAIRMAN: #ould you dome a
favor? Could you reduce the side yard and
give us a sketch, reducing the side yard on
the south side, which is the side closest to

the water and {o the Troyan (phonetic
spelling) property, to 12 feet, moving the
house closer to Robinson's Road and see if
we can get an idea what that would look like
in reference to distance from the bulkhead?
MR. KRAMKR: How much closer would
you want that?
THE CHAIRMAN: Well, you are 16 1/2
now. Reduce it to 12 and bring the house
closer to Robinson Road. Maybe we could get
· better distance from the bulkhead, moving
it towards the west, sliding it all this
Way.
We will leave the hearing open until
the special he·ring we are having on the
15th'and'if you give it to us before then we
can take a look at it and we can run back
down. I will be there Saturday. I will
take more measurements when I go down there.

I am presently applying for a variance in order to get a
building permit on my property(sec 34 block 5 lot 20), which has
been denied by the builing department as I need to build 75'from
the bulkhead in order to construct a home on this property. When
I bought the land in 1982 I bought it as a buildable lot.
I improved the lot in 1983 by bulkheading it wiht permission
from DEC and the trustees.
I presently have a DEC permit and Health Dept. permit and a
waiver from the trustees to construct a single family home on
this property, which I have enclosed copies of.
I am also enclosing a copy of a survey done in 1961 which
shows single and separate ownership of this property.
I am requesting your granting me a variance on this
property.
