disapproved, for permission to construct a deck addition to
dwelling and accessory pool. Proposed accessory structure not
permitted in the front yard area and proposed construction will

WHEREAS, a public hearing was held and concluded on June
27, 1990 in the matter of the Application of JACQUE KASABA under
Appeal No. 3950; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Cedar Point Drive, Town of Southold, and is identified
on the Suffolk County Tax Maps as District 1000, Section 90,
Block 3, Lot 14.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30 A.4 (100-33%, Article III A
Section 100-30 A.3, Article XXIV, Section 100-244, for
permission to construct deck addition to dwelling and accessory
pool. Proposed accessory structure not permitted in the front
yard area and proposed construction exceeds permitted lot
coverage.

3. Article XXIV, Section 100-244, Nonconforming lots,
Article III A, Section 100-30 A.4, Accessory buildings shall be
subject to the same requirements as 100-33 of the
Agricultural-Conservation District.
Article III A, Section 100-30 A.3, No building or
premises shall be used and no building or part therof shall be
urected or altered in the Low-Density Residential R-40 Zone
District unless the same conforms to the requirements of the
Bulk effect as if such regulations were set forth herein in full.
4. The subject premises is improved with one and a half
{1 1/2) story framed dwelling with an attached deck located to
the west of the existing dwelling on this corner lot and
contains an area of 13,416 sq. ft. in this R-40 Zone District.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed pool and deck in any other
location on the premises will require other variance relief;
(c) that the area chosen for the pool and deck is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

RESOLVED, to GRANT a Variance in the matter of the
application of JACQUE KASABA as applied under Appeal No.
SUBJECT TO THE FOLLOWING CONDITIONS:
3950,
1. That the pool not be placed any closer than 11 ft.
including deck from Lakeside Drive and 22 ft. from Cedar Point
Drive.
2. That the fence and any screening not exceed 4 ft. 6
in. in height in front yard areas above grade, the area
beginning at a point of 30 ft. from the corner of Cedar point to
30 ft. from the corner of Lake Side Drive remain open and
unvegitated.
3. That the 10 ft. by 3 ft. deck be located as shown on
the site plan dated May 1, 1990 by Briarcliff Landscape Inc.
Vote of the Board: Ayes: Messrs. Goehrigner, Grigonis,
Doyen and Dinizio. This resolution was duly adopted.

yard. That is up to the evaluation of the
Building Inspector. It certainly is a unique
piece of property. Okay.
Proposed construction: Accessory
structure use shall be located in the rear
yard area. He is not indicating. He is not
indicating if that is a side yard or a rear
yard. He is not telling. As you can see, we
have no other place to put it. The back yard
there behind us has a wood deck. It would be
too close to the road. What we consider the
side yard is about the best location for it.
THE CHAIRMAN: We are talking on Lake-
side Drive. What is the closest point that the
southwest corner of the pool would be to Lake-
side Drive?
MR. SCHWART: The closest point in feet,
it would probably be 11 feet. Now I am going
by this survey. It appears to be a lot longer,
a farther distance actually, but I am going by
the survey. We staked it out. It was somethin¢

dealing with one side or two sides of the fron~
yard, then definitely the other side is rear
yard. So the portion that extends out to the
northeast is probably the rear yard. That is
to the best of my knowledge, but I am not goin
to guesstimate if the front of the house is
on Lakeside Drive, where you walk into -- in
by the garage.
THE CHAIRMAN: I do concur with you th~
this gentleman does have a hardship in the
respect of this particular property and, as
long as Briarcliff is aware of the fact that
that's what is permitted in the front yard
area. This would be a four-foot fence. They
don't want anything else, and the ground COver.

RESERVED DECISION: Appeal No. 3255:
Upon application of THOMAS HIGGINS, 48 Kenwood Road, Garden City,
NY 11530, for a Variance to the Zoning Ordinance, Article III, Section
100-31 for permission to construct deck addition to dwelling with reduc-
tion of frontyard setback from Cedar Point Drive East. Identification
of Property: 80 Lakeside Drive (a/k/a 675 Cedar Point Drive East),
Southold; Cedar Beach Park Subdi~vision Lot No. 81; County Tax Map
Parcel No. 1000-90-03-014.
The public hearing on this matter was held on July 26, 1984,
at which time the hearing was declared closed pending deliberations.
The board made the following findings and determination:

way will lead to the proposed side deck addition which is shown to
be set back ll feet from the side'prop~rty line (which is permitted
under the current sideyard requirements of the Code). For the
record it is noted that this new one-family dwelling has been
authorized by Building Permit #12555Z issued August 27, 1983.
The premises in question contains an area of approximately
13,400 sq. ft. with 183.34' frontage along Cedar Point Drive East
and 184.18±' frontage along Lakeside Drive. The parcel is of a
"triangular" nature with most of th'e o~en yard area technically
"frontyards." The existing dwelling structure is set back 35'
from Lakeside Drive, 31' from Cedar Point Drive East, and 11'3"
from the easterly side property line. The parcel in question is
known as referred to as Lot 81 of the Subdivision of Cedar Beach
Park, Map No. 90, of December 20, 1927.
The board members have visited the site in question and are
familiar with the neighborhood. Although this parcel is of a shape
that frequently requires variances, the hardship does appear
self-imposed and the "significant injury" burden has not been
shown. The applicant has requested a five-foot walkway, and it is
the board's opinion that a three-foot reduction for that purpose,
leaving a 28' frontyard setback, would suffice.
Now, therefore, on motion by Mr. Goehringer, seconded by Mr.
Sawicki, it was
