B, as disapproved, for permission to construct an addition to a
one family dwelling. Proposed construction will have
insufficient rear yard setback. Property Location: 155 (Pvt.
Road #6) Birch Drive S, Laurel, County Tax Map No. 1000, Section
128, Block 4, Lot 4.
WHEREAS, a public hearing was held and concluded on June
27, 1990 in the matter of the Application of MATTHEW KAl{, under
Appeal No. 3946; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
W~EREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the south
side of Peconic Bay Boulevard, Hamlet of Laurel, and is
identified on the Suffolk County Tax Map No. 1000, Section 128,
Block 4, Lot 4.
2. This is an application for Variances from the Zoning
Code Article III A, Section 100-30 A.3, Article XXIV, Section
100-244 B, for permission to construct an addition to a one
family dwelling. Proposed construction will have insufficient
rear yard setback.

3. Article III A, Section 100-30 A.3, No building or
premises shall be used and no building or part thereof shall be
erected or altered in the Low-Density Residential R-40 District
unless the same conforms to the requirements of the Bulk
Schedule and of the Parking Schedule, with the same force and
effect as if such regulations were set forth herein in full.
Article XXIV, Section 100-244 B, A nonconforming lot
separately owned and not adjoining any lot or land in the same
ownership at the effective date of this Article and not
adjoining any lot or land in the same ownership at any time
subsequent to such date may be used, or a building or structure
may be erected on such lot for use, in accordance with all the
other applicable provisions of this chapter, provided that proof
of such separate ownership is submitted in the form of an
abstract of title showing the changes of title to said lot,
which abstract shall be in the usual form, shall be certified by
an attorney or a company regularly doing such work in Suffolk
county or by a corporation duly licensed to examine and ensure
title to real property in Suffolk County and shall contain a
certification that no contiguous property was owned by an owner
of the property involved since the date of any previously
applicable Zoning Law. Such lot shall be granted relief for
front side and rear yard dimensions as follows:
4. The subject premises is improved with a one (1) story
framed dwelling with a screened porch towards the southern side
of the existing dwelling. The proposed 16' X 37' addition will
be towards the westerly side of the existing dwelling in this
R-40 Zone District.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances
uniquely related to the premises
nonconformities;
to this application are
and its established
(b) that there is no other method for appellants to pursue;
and placing the proposed addition on this property will require
other variance relief;
(c) that the area chosen for the addition is not
unreasonable located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;

(e) that in carefully considering the record and all the
above factors, the interest of justice will be served by
granting the variance, as applied conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr.Dinizio, it was
RESOLVED, to GRANT a Variance in the matter of the
application of MA'r£HEW KAR as applied under Appeal No. 3946,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the 16' X 37~ addition be located as indicated in
on the survey submitted.
2. That the proposed addition not extend any closer than
eleven (11+-) ft. to the rear property line and fifteen (15+-)
ft. to closest side yard on north side of property.
Vote of the Board: Ayes: Messrs. Goehrigner, Grigonis,
Doyen, Sawicki and Dinizio. This resolution was duly adopted.

Dear Sirs:
It has been brought to my attention that the adjacent property
owners to my Southold premises are seeking a variance to permit them
to construct a rear addition on their premises which would violate set
back requirments.
My wife and I are in full support of the variance request.
Mr. and Mrs. Kar have transformed this residence from a down-trodden
summer home which was kept up poorly in the last few years into the
jewel of the neighborhood. Furthermore, they are the only year-round
residents in our Homeowners Association. It is beneficial to us to
have Matt and Gail living year round in this area. They keep an eye
on everyone else's property and contact us if there are any problems
or unusual occurrences.
The economics of real estate on the North Fork, especially for
property close to the Bay, make it extremely difficult for a young
couple to purchase a home in this day and age. Matt and Gall have
been able to do so but unfortunately their family has outgrown this

home. Therefore, they are presented with a financial hardship of
either improving or finding another suitable residence. Obviously,
improving their curent home is the more economic solution. This then
creates a practical hardship in that the home is placed on the lot in
such a manner that they cannot add an addition to the rear of the
premises without violating setback requirements.
It is my wish and I am sure the wish of everyone in our
Homeowner's Association that the Kar's be granted the relief they
seek. The improvements to their home can only serve to beautify our
area and the Town in general.

I have a copy of a survey, dated June
28, 1988, indicating a one-story frame dwelling
with screened porch located approximately in
the center of the property, skewed a little.
I have a copy of a Suffolk County Tax
Map indicating this and surrounding properties
in the area. This is a unique situation becaus(
the parcels in the area are extremely small.

We bought the property a couple of years ago,
and it was basically a summer bungalow. We
spent six months renovating it, winterizing
it. It has got a little more than 900 square
feet for the addition.

The next inspection was a tarring
inspection around the cinder blocks. At that
point the inspector stopped the work, saying
we did not have a sufficient rear setback.
THE CHAIRMAN: Rear yard setback?
MRS. KAR: I guess there was a discrepan¢
as to where the front of the house was, because
it is a unique neighborhood. We do have a
water view, and most of the houses -- we
consider that the front of our house. If that
was the case, then apparently we would have
made all the setback requirements. So the work
has been stopped and I have some pictures here.
There are 10 homes in the community going from
Peconic Bay Boulevard to the water. We are

kind of in the middle.
Even with the addition,

we have got more
space in between our house to the other pro-
perty lines than any of the other houses. It
is just the way it works out. The houses
have been there a long time. Some people are
within one foot of the property line rear yard.
I guess another point is that our rear
yard is next to an open lot. The person that
is behind us also owns the property behind us.
So she owns all the property going from the
boulevard to the bay. So our rear yard really
is in the place where there are no homes there.
I have a letter from both of our
neighbors, saying that they really want us to
continue. They want us there. We are the
only year-round residents in the

ticular point.

THE CHAIP~V~N: We granted the smallest
lot that has ever been granted by this Board
across the street, which I think was 3~300
square feet. That is the one next to the house
that actually bisects the garage.
We will have a decision for you very
shortly. We thank you for coming in and we wil
see if anybody objects to it.

some other jobs, and if we don't get moving
we may be put back to way in the fall.

MR. KAR: It is 11 feet, which is still
five feet further than any of them on our block.
Our neighbor is a foot. Gale has a picture
here that shows we have several houses that
are right on the property line.
