RESOLVED to deny the application of Leander B. Glover, Jr.
for a quitclaim deed to land adjoining land of the applicant
which was filled with dredge spoil by the County of Suffolk,
pending the result of the court litigation.
3. If your application is approved above, A Permit Fee is now due, and should be made payable
to the order of the Board of Southold Town Trustees. This fee is computed below according to
the Schedule of Rates as set forth in the instruction Sheet (Form 1/1).
If the Permit Fee is paid in person to the Secretary of the Board, The Permit will be obtainable

Dear Mra ®Goldsmith:
This is with reference to the application of Leander B. Glover, Jr.
to the Board of Trustees for a quit claim deed to land ads
joining land which the applicant claims to own on Fleet' s Neck$
Cutchogue, N.Y.
The land referred to is still under litigation, as the decision
made by Judge William Gieler is being appealed by the Fleets Neck
Property Owners Association, lnc.
Therefore, we feel that this application should not be taken into
consideration.
Furthermore, are object to any public lands, under the jurisdiction
of the Board of Trustees, being given or sold to anyone for pri-
vate benefit. The recent precedent that your Board set in denying
the acquisition of public land for private benefit on Fishermans
Beach supports our position in this matter.

Re: Application of Leander Glover, Jr. for a
Quitclaim Deed
Dear Trustees:
This firm represents the Fleet's Neck Property Owners Asso-
ciation, Inc. which has been involved in litigation with
Leander Glover, Jr, over the ownership of certain land
located at Fleet's Neck, Cutchogue, New York.
It is my understanding that Mr. Glover has applied to the
Board of Trustees for a quitclaim deed to property abutting
the property involved in the litigation. I request that
this letter be read at the meeting of the Trustees scheduled
for Tuesday, December 6 , 1977 at 7: 30 p.m, which is the date,
according to the public notice, that Mr. Glover's application
is to be considered.
This is to inform you that the litigation has not been termi-
nated and is still active. A trial was held in Supreme Court,
Suffolk County and a decision was issued by the Honorable
William R. Geiler in Mr. Glover's favor, As far as I know,
no judgment has been entered on this decision though a judg-
ment will most likely be entered shortly. We have been retained
by Fleet's Neck Property Owners Association, Inc, to file a
Board of Town Trustees

Notice of Appeal from any such judgment and to perfect the
appeal to the Appellate Division, Second Judicial Department,
Brooklyn, New York. It will be at least several months be-
fore the Appellate Division will act on this appeal.
It is our opinion that the Board of Trustees should not take
any action until the controversy between the Fleet's Neck
Property Owners Association, Inc. and Leander Glover, Jr.
has been permanently resolved.

below the high water mark of Eugene's Creek, situate, lying and being
near Fleet' s Neck, Cutchogue, Town of Southold, Suffolk County, New
York, which land was formerly under water and surrounded a certain
island of meadow owned by Leander B. Glover, Jr. , and which meadow
island and other lands were filled with dredge spoil by the County of
Suffolk during the dredging of Eugene's Creek in and about 1966; more

i BEGINNING at a point on the southerly side of East Road, which
point is North 850 58 ' 20" East 65.92 feet distant from a monument
!_. located on the northeasterly corner of land now or formerly of the
Estate of Henry L. Fleet; from said point of beginning the following
SIX courses and distances along land now of Fleet's Neck Property
owner' s Association, formerly of Henry & Clarence Fleet, which courses
and distances are the average center line of land formerly ,under water
;j which separated the former meadow island of Leander B. Glover, Jr. and
j land of Fleet' s Neck Property Owner ' s Association: (1) South 230 301
East 99. 54 feet; (2) South 780 47 ' 50" East 81. 30 feet; (3) North 790
