authorities. The Town accepts no responsibility in applying for or obtaining such approval. In th{
event mat such approval is necessary, the holder of this permit shall not commence operations here
un~er until such approval has been oUtained in writing, The failure to obtain such other approval whe~
required shall sub ect this permit to immediate revocation by me Trustees upon receipt by th~
Trustees- of written notice from such omer governmental or municipal authorities of its refusal o
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take ail precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicantalso ag, ecs- ~,.o moemn,-' '
fy and save harmless the Town, and its officers, agents and employees from any and a![ c~aims arisin9
from operations under this permit and any end al~ acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
~is permit are being conducted, do, by the acceptance of this permit, give consent to the Town,
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessa~ to insure that such operations are being con-
ducted in conformity with this permit. .
This operation will not substantially:
A. Adversely affect the wetlands Of the town.
· B. Cause damage from erosion, turbidity or silta-don. '
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wiidlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
· F. Adverseh/ affect navigation on tidal waters or the tidal flow of the tidai waters of the town.
G. Change the course of any channel or the natural movement o, flow or any waters.
H. Weaken or undermine the lateral support o,~ other lands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the peopie of the town,

The following action was taken by the Board of Trustees during their
regular meeting held on March 26, 1987 regarding the above matter.
RESOLVED that the Southold Town Trustees Ai~END their previous determination
declared on January 29, 1987 as follows: Ail cesspools are to be located
75' landward from the H.W.M. and be it further recommended that you take
this opportunity to upgrade the sanitary system prior to,,the start of
construction on property located at 450 Oak Street, Cutchogue.

I was advised that you had some questions regarding the approval
that was granted for the work no be performed at the above referenced
address.
The Town Trust~es approved your application subject to receipt of
the following information prior to the actual issuance of your permit as
follows:
I. You are to submit an approved plan by the Suffolk County
Dept. of Health Services for a single family dwelling.
2. You are to submit a plan for containment of run off from
impervious strucCures on the site, no be reviewed and
approved by the Town Engineer.
Please do not remit your inspection fees until this information is
furnished to this office and reviewed. Should you have any further

The following action was taken by the Board of Trustees at their
regular meeting held on January 29, 1987 regarding your application
~or a Wetland Permit.
WHEREAS, Rita F. Gledich applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated November 6, 1986, and
~EREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a ~ublic hearing was held by the Town Trustees with
respect to said application on December 23, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board.members have personally viewed and are
familiar with the premises in question and the surroBnding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the ~own,
NOW, THEREFORE, BE IT
RESOLVED that Rita F. Gledich BEAND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: construct
dwelling and deck additions to existing structure, subject to the following
conditions: Approval from the Suffolk County Dept. of Health Services and a
plan submitted and approved by the Town Engineer for containment of all
run off from impervious structures on the site. Property is located at 450
Oak Street, Cutchogue. This permit will expire on January 29, 1988 if the
work .has not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the Work. Prior to

TOWN TRUSTEES OF THE TOWN OF SOUTHOLD, AT THE SOUTHOLD TOWN HALL, MAIN
ROAD, SOUTHOLD, NEW YORK, ON TUESDAY, DECEMBER 23, 1986 ON THE FOLLOWING
APPLICATIONS FOR PEP. MITS UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF
THE TOWN OF SOUTHOLD.
IN THE MATTER OF THE APPLICATION OF: RITA F. GLEDICH to construct an
open deck and dwelling additions tO an existing residence. Property is located

Trustee Smith: The Conservation Advisory Council tabled their decision
we will will hold the public hearing. Until we get written comments
from the C.A.C. we will with hold our decision.
Trustee Larsen: I have one comment. Personally I feel that it is
over extended use of the existing property within the 75 ft. limit for
the record.
Trustee Smith: Okay, any additional comraents?
Trustee Krupski: Are we going to have any say as to what happens to that
property? The boat halves that are used for retaining walls on that steep
bank there?
Trustee Smith: We.have an application.
Trustee Larsen: A1 means on the creek side. It is a mess down there.
Trustee Smith: They will have to come back with another application.
Trhstee Larsen: I'm wondering what they are going to do with the building
materials there?
Trustee Smith: Any other comments? No comments? Then I will close this
public hearing.

RESOLVED to recommend to the Sou~hold Town Trustees denial
of the wetland application No. 467 submitted by En-Consultants,
on behalf of Olaf Nelson to construct a timber dock consisting
of a 4' x 5' ramp extending from lawn onto 10' x 10' deck land-
ward of marsh fringe; a 4' x 60' fixed, elevated (4' above
grade of marsh) walkway; a 4' x 16' hinged ramp; (2) 8' x 16'
floats secured by (5) 12" pilings. The Council recommends
denial pending a Declaration of Significant Imapct and Public
Hearing. The Coucil fears obstruction of the channel and there
has been strpng objections by the neighbors.

it is assumed that there are no objections nor comments from
those agencies.

following recommendations at their regular meeting held Thursday,
January 15, 1987:

a tie line).
3. The subject prem'~ses is located in the "A" Residential
and Agricultural Zoning District and is improved with a
pre-existing, nonhabitable building as evidenced by Certificate
of Occupancy #Z9455 issued March 6, 1979.
4. Submitted for the record is a survey prepared by
Roderick VanT~yl, P~C~ of October 23, 1979 certifying the
metes and bounds description of this parcel and the contours
as taken from the Suffolk County Department of Public Works
aerial survey (shown September 30, 1986). The area of the
proposed construction is landward of the~ existing'lO ft.

5. Article Xi~ Section 100-119.2(B) requires all buildings
proposed on lots adjacent to tidaZ.water bodies other than ~h~
Long Island Sound at not less than 75 feet from the ordinary
hi ghwater mark°
6. Article iii, Section 100=3I of the Bulk Schedule
of the Zoning Code requires a maximum lot coverage of all
structures at 20 percent of the total lot area. .Twenty
percent~of the total lot area of this parcel is 1220 sq.
ft., anu the total proposed lot coverage would be i6§~.
sq~ ft. A variance is required in the amount of 415 sq~
ft. over the allowance. It is the position of the board
that the lot coverage is excessive and is not the minimal
necessary'_~ and therefore a reduction to 24% (total) would be
feasible and. within the spirit of the zoning ordiuance.
7] The board agrees that the configuration of this
parcel lends to the difficulties requi~ing this variance'
and finds that the relief as granted will be the minimum'
necessary under the circumstances.
_Tn considering this appeal, ~he board a~so finds and
determines tha~t the granting of the relief as noted below:
(a) will not be inconsistent with the .general neighbo~'hood;
(b) will be the minimal necessary under the circumstances;
,Fc) is .not substantial in relation to the requirements;
(d) will not create a~substantial change in the character
of the area; (e) will not in turn be adverse to the
safety, health, welfa-e, comfort, convenience or order of
the
~own; (f) will serve the interests of justice.
