Variance to the Zoning Ordinance, Article XXIII, Section 239.4, for permission to construct an accessory deck, proposed construction will be less than 100 ft. from the top of the bluff of Long Island Sound. Property Location: 62825 North Road, Greenport, County Tax Map No. 1000, Section 40, Block 01, Lot 11.1. WHEREAS, a public hearing was held and concluded on May 15, 1990 in the matter of the Application of JCM SALES AND LEASING, under Appeal No. 3935; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and 1. The premises in question is located along the northwest side of North Road, County Road 48, Hamlet of Greenport, and is identified on the Suffolk County Tax Maps as District 1000, Section 40, Block 01, Lot 11.1. 2. This is an application for Variances from the Zoning Code Article XXIII, Section 239.4, for permission to construct an accessory deck, proposed construction will be less than 100 ft. from the top of the bluff of Long Island Sound. Article XXIII, Section 100-239.4 A (1), Ail buildings located on lots adjacent to Long Island Sound and upon which there exists a bluff or bank landward of the shore or beach shall be set back not less than one hundred (100) feet from the top of such bluff or bank. 4. The subject premises is improved with a one and a half story split level framed house in this R-80 Zone District. 5. In considering this application, the Board finds and determines: (a) that the circumstances of this application are uniquely related to the premises and its established nonconformities; (b) that there is no other method for appellants to pursue; and placing the proposed deck in any other location on the premises will require other variance relief; (c) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (d) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the variance, as applied conditionally noted below. Accordingly, on motion by Mr. Dinizio, seconded by Mr. Sawicki, it was RESOLVED, to GRANT a Variance in the matter of the application of JCM SALES AND LEASING as applied under Appeal No. 3935, SUBJECT TO THE FOLLOWING CONDITIONS: 1. that the 14 X 14 ft. deck not encroach over the lip area of the bluff and to remain even or landward of the top of the bank and the deck is to remain unroofed. Vote of the Board: Ayes: Messrs. Goehringer, Dinizio, Sawicki and Doyen, (Absent Charlie Grigonis). Muller, Meetinghouse Lane, Southampton, NY for a Variance to the Zoning Ordinance, Article III, Section lO0-31 for permission to construct addition to dwelling with insufficient sideyards; premises known as 62825 C.R. 48, Greenport, NY; County Tax Map Parcel No. 1000-40-01-10 and ll. The board made the following findings and determination: This is an appeal from Article III, Section lO0-31, Bulk Schedule of the Zoning Code which requires minimum sideyards of 15 feet and 20 feet, for a total sideyard of not less than 35 feet. The premises in question is located at the north side of County Road 48, Greenport, and contains an area of 1.320 acres, with 80' road frontage. The premises as shown on the August 9, 1984 amended survey prepared by R. Van Tuyl, P.C. is a one-story, one-family frame dwelling, and an accessory garage building in the frontyard area. The property is shown to comprise two deeded parcels identified as District lO00, Section 40, Block O1, Parcels 10 and ll, and it is the understanding of this board that these two parcels will by this proposal become one single buildable lot. Applicants propose'a la-story addition to the existing dwelling which would leave an easterly sideyard setback of 15 feet, for a variance of five feet. Since the existing setback from the westerly side property line is 13 feet, the total side yards requested would be 28 feet, for a variance of seven feet. In considering this appeal, it is the opinion of the board that: (1) by allowing the variance, no substantial detriment would be created affecting adjoining properties; (2) that no adverse effects will be produced on available governmental facilities of any increased population; ' (3) the variance will be in harmony with and promote the general purposes of zoning; (4) the relief requested is not substantial, being 20% and 25% of a variance from the requirements; (5) no adverse effects will be produced on available governmental facilities of any increase population; (6) the interests of justice will be served by allowing the variance, as indicated below. I have a copy of the survey produced by Roderick Van Tuyl, P.C., dated February 16, 1984, indicating a one and a half story frame house. It appears to be 96 feet from the top of the bluff or lift of the bluff. The nature of this application is a platform to be constructed almost even with the width of the bluff, approximately 14 feet by 14 feet, as basically an observation deck or sun deck, somewhat similar to what the neighbors in the area have. I would just like to mention that the plans, when we presented them, we did get a letter from the Department of Environmental Conservation approving it. We had gotten a permit from the Trustees Department, but a year and a half ago other things came about that we didn't have the chance to construct the deck. By the time we got around to constructing, we were told that the permit had run out of time. We applied for an extension and received the extension, but then were told by the Building Department that the Trustees did not have jurisdiction any longer. They said in that interim period, I guess, is where the transition took place and that we would have to reapply to the Building Department which we did. We had to pay another fee of $150.00, and we are at this point now. THE CHAIRMAN: Right. So here it is going to be, you know, four or five or six inches above the ground, but here it would be better than 12 to 18 inches above the ground. The site has an excellent sod cover with ground sloping towards the northwest corner. Gutters and downspouts exist with two downspouts on the east side exiting into drywells, while two on the west side exit onto the ground surface as runoff. The bluff face appears to be in stable condition with abundant vegetative cover. A platform built at the bluff edge would shade out ground cover and become bare underneath and potentially erodible, while adding more weight. We suggest grading the existing ground away from the bluff top edge, to prevent surface runoff from eroding the bluff. The two downspouts that exit onto the ground surface should also be directed into drywells, as they currently add surface runoff toward the proposed platform deck.
