WHEREAS, a public hearing was held and concluded on May 15, 1990 in the matter of the Application of GREG's SEAFOOD DOCK & MARKETING, INC. under Appeal No. 3943; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board Members Have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 10 The premises in question is located along the west side of Sound Avenue and the north side of Route 48, Greenport, County Tax Map No. 1000, Section 35, Block 1, Lot 8. 2. This is an application for a Special Exception from the Zoning Code Article III A, Section 100-30A.2 C(1), for permission to construct a off-premises sign. Article III A, Section 100-30 A.2, C(1) (100-31C), Accessory uses, limited to the following uses and subject conditions listed herein: 4. The subject premises is vacant land owned by Theodore and Maria Petikas, on the corner of sound Road and County Route #48 in this Agricultural (A) Zone District. 5. In considering this application, the Board finds an determines: (a) that there is no other method for appellants to pursue; and placing the sign in this District will require other Special Exception relief; (b) that the area chosen for the sign is not unreasonably located; (c) that the variance will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience and/or order of the Town; (d) that in carefully considering the record and all the above factors, the interests of justice will be served by granting the variance, as applied conditionally noted below. Accordingly, on motion by Mr. Sawieki, seconded by Mr. Doyen, it was RESOLVED, to GRANT a Special Exception in the matter of the application of GREG'S SEAFOOD DOCK & MAI~KETING, INC. as applied under Appeal No. 3943, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the 4 X 6 doubled faced sign be not be triangular, that there be two posts atleast four (4) ft. off the ground not to obstruct the view. 2. PUBLIC HEARING: Appeal No. 2599. Upon application of the $outhold Town Republican Committee, Sunset Lane, Greenport, New York for a Special Exception to the Zoning Ordinance, Greenport, New York, for a Special Exception to the Zoning Ordinance for permission to erect an off-premises directional sign. Location of property: N/s North Road, Greenport, New York; bounded north by Brandi & Raynor, east by Sound Road, south by North and Main-_ Roads, west by Raynor. The Acting Chairman opened the hearing at 10:57 P.M. by reading the application for a Special Exception., legal notice of hearing as advertised in the local and official newspapers, affi- davits attesting to its publication in the local and official newspapers, Notice of Disapproval from the Building Inspector, and letter from the Town Clerk that notification to adjoining property owners was made to Sfaelos Realty Corp., Sophie Raynor, Joseph Brandi; fee paid $15.00. MR. DOUGLASS: I have a copy of the section of the County Tax Map showing this and the surrounding properties and a letter from the property owner giving consent to erect said sign. It appears that all parties involved have acted with good intentions, and were not aware of the fact that, in addition to Town requirements, State requirements apply to certain County roads. Nevertheless, the State's requirement of con~nercial zoning for sign sites cannot be waived. We are therefore obliged to advise each owner to remove their sign and either apply for an alternate site, or for directional-type signing of limited size. The owners will soon be advised that we will allow 30 days for the removal of the signs.
