Location of Property: 124 Hickory Avenue, Southold, NY; County Tax Map District 1000, Section 78, Block 7, Lot 50. WHEREAS, a public hearing was held on September 26, 1990 in the Matter of the Application of HAROLD AND ANNETTE GORDON under Appeal No. 3962; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along a private right-of-way extending from the southerly side of Hickory Avenue in the Hamlet and Town of Southold, and more particularly identified on the Suffolk County Tax Maps as District 1000, Section 78, Block 7, Lot 50. The subject premises is a substandard parcel containing a total lot area of .80 of an acre (or 34,848+- sq. ft.) with 104+- ft. frontage along Goose Creek. 3. The subject premises: (a) is improved with a single-family dwelling set backat its closest point 11+- feet from the south (side) property line and 95+- feet from the inside of the access right-of-way; (b) is located in the R-40 Zone District which requires sideyards at 15 and 20 feet, or greater. 4. Appellants are requesting a two-foot extension of the existing deck reducing the present setback to not less than eight feet at its closest corner. 5. In considering this application, the Board also finds and determines: (a) that the grant of the relief of two feet will not be adverse to the essential character of the neighborhood; (b) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town, or be adverse to neighboring properties; (c) the grant of the variance will not increase dwelling unit density or available governmental facilities; (d) the percentage of the relief requested is not substantial; the relief is the minimum necessary to afford relief and will not in turn cause a substantial effect on the safety, health, welfare, comfort, convenience, and order of the town. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Dinizio, it was RESOLVED, to GRANT the relief requested under Appeal No. 3962 in the Matter of HAROLD AND ANN~'~'i'E GORDON for a two-foot extension of the existing deck at not less than eight feet from the side property line, as applied. Y. 11545 July 17, 1990 Building Department Town of Southold To whom it may concern: I, Joseph Petruzziello, am the owner of the property along the southwest border and adjoining that of Harold and Annette Gordon, the address of which is 124 Hickory Avenue on Goose Bay, Southold, New York, 11791. I am informed that Harold and Annette Gordon wish to extend an existing deck an additional two (2) feet, which will thus reach a line or point eight (8) feet from our contiguous property line. Mr. and Mrs. Gordon require a variance for approval of this construction. I do not have any objection to their plan. Thank you. 7:36 p.m.) The next appeal is in behalf of Harold Gordon, Appeal Number 3962. It is a variance for a deck addition to existing residence with insufficient side yard setback. I have a copy of a 6, 1972, by Alden Young, indicating a parcel just under an acre with a frame bungalow probably a little closer to the west side than it is to the center of the property. Attached to this existing frame bungalow is a deck which surrounds it on two sides partially. The nature of this application is to reduce the side yard from 10 feet to 8 feet, on the deck side which is the closest portion to that side of the property. I have a copy of the Suffolk County Tax Map indicating this and surrounding properties. Doctor, would you like to say anything for the record? DR. GORDON: Yes. Dr. Harold Gordon, 124 Hickory Avenue. We wish to enlarge the size of this deck you just mentioned. Since it is used right now it is an existing deck. We wish to enlarge it, since it is uncomfortable and its use is restricted for that reason. THE CHAIRMAN: In closing it will still be a pole structure holding it up, or will it be cement block foundation? DR. GORDON: Well, the house is presently on cement blocks.
