Matter of FRANCES FRISBIE. Variance to the Zoning
Ordinance, Article III A, Section 100-30 A.4 (100-33), as
disapproved, for permission to construct an accessory building
in the front yard area. Accessory buildings may only be located
in the required rear yard. Property Location 8050 Nassau Point
Road, Cutchogue, County Tax Map No. 1000, Section 118, Block 5,
Lot 2.1.
WHEREAS, a public hearing was held and concluded on June
27, 1990 in the matter of the Application of FRANCES FRISBIE,
under Appeal No. 3949; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the west
side of Nassau Point Road, Hamlet of Cutchogue, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 118, Block 5, Lot 2.1.

Code Article III A Section 100-30 A.3 (100-33), for permission
to construct an accessory building in the front yard area.
Accessory buildings may only be located in the required rear
yard.

3. Article III A, Section 100-30 A.4 (100-33), Accessory
buildings shall be subject to the same requirements as 100-33 of
the Agricultural-Conservation District.
Article III, Section 100-33, In the Agricultural-
Conservation District and Low-Density Residential R-80, R-120,
R-200 and R-400 Districts, accessory buildings and structures or
other accessory uses shall be located in the required rear yard,

4. The subject premises is improved with a one story
framed house with an attached garage located west of the
existing dwelling and a tennis court located in the front yard
area. The premises contains an area of 54,450 sq. ft. in this

5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed accessory building in any other
location in the front yard area will require other variance
relief;
(c) that the area chosen for the accessory building is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance as applied conditionally noted below.

Accordingly on motion by Mr. Goerhinger, seconded by Mr.
Doyen, it was
RESOLVED, to GRANT a Variance in the matter of the
application of FRANCES FRISBIE as applied under Appeal No.
SUBJECT TO THE FOLLOWING CONDITIONS:
3949,
1. That the proposed storage shed be located in the front
yard area, not exceed 10 X 12 ft. (one story in height) and be
placed behind the existing tennis court.
Vote of the Board: Ayes: Goehrigner, Grigonis, Doyen,
Dinizio and Sawicki. This resolution was duly adopted.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical diffi~J./t~s~o~es-
sary HARDSHIP because the subjectpremtses ts water front and
wish to construct the storage shed between her house and the water which wouid
brock her view. The subject premsies has a tennis court
ctearwater lane and the storage shed would be most convententla]P'i'6d~ted at the
southwesterly end of the tennis court. It would be set back approximately 280 feet
from Ctearwater Lane behind the tennis court and accordingly would not be visible
from the road.
2 The hardship created is UNIQUE and is not shared by oll properties alike in the immediate
vicinity of this property and in this use district because this is waterfront property and
accordingly for all intents and purposes the waterfront side of the property
is considered by the owner to be the "front yard". The existing house is located
down by the water front to take advantage of the view and the proposed shed would
be most conveniently located by the existing tennis court between the road and the
house. The tennis court is fenced and the shed would be located behind the fence.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because Many other properties located in the area have
accessory buildings, such as garages, in the front yard. The storage shed would not
be readily visible and accordingly would not change the character of the neighborhood.
The subject premises is also wooded and accordinIy the shed would not be visible from
the road.

RESERVED DECISION: Appeal No. 2913. Application of Frances N.
Frisbie, 175 Clearwater Lane, Cutchogue, NY for a Variance to the
Zoning Ordinance, Art. III, Sections 100-30 and 100-35 for permis-
sion to construct tennis court and fence exceeding the maximum
four-foot height requirement in the frontyard area at 175 Clearwater
Lane, Cutchogue, NY; Nassau Point Filed Subdivision Map No. 156,
Subdivision Lot 106; County Tax Map Parcel 1000-118-5-2.
A public hearing was held concerning this appeal on November 5,
1981, at which time the hearing was closed and decision reserved
until a later date.
The Board made the following findings and determination:
By this appeal, applicant seeks permission to construct a 60'
by 120' tennis court approximately 95' from a tie line on Clearwater
Lane to the northwesterly corner of the proposed tennis court with
a 10' high fence around the perimeter of same. Existing on the
premises are a one-family dwelling containing a living floor area
of approximately 1839 square feet and porch area of approximately
406 square feet, and accessory garage with an area of approximately
504 square feet. The lot in question has road frontage along the
tie line of Clearwater Lane of 174.34 feet, an average depth of
approximately 510 feet. The practical difficulties in this situation
are unique and lends itself to th~ location of the dwelling approxi-
mately 370 feet from the tie line at Clearwater Lane, leaving substan-
tial frontyard area and minimal rearyard area. The Board agrees with
reasoning of applicant.
In considering this appeal, the Board determines that the
variance request is not substantial; that the circumstances here-
in are unique; that by allowing the variance no substanial detri-
ment to adjoining properties would be created; that the difficulty
cannot be obviated by a method, feasible to appellant, other than
a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the
relief requested will be in harmony with and promote the general
purposes of zoning; and that the interests of justice will be
served by allowing the variance.
On motion by Mr. Grigonis, seconded by Mr. Sawicki, it was
RESOLVED, that Frances N. Frisbie be granted a variance to
the zoning ordinance, Article III, Sectionsl00-30 and 100-35 for
permission to construct tennis court in the frontyard area and
fence exceeding the maximum height requirement as applied for,
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That a minimum setback of three feet be maintained from
the westerly side property line;
2. That this matter be referred to the Suffolk County Planning

PUBLIC HEARING: Appeal No. 2588. Upon application of
Frances N. Frisbie, Clearwater Lane, Cutchogue, New York 11935,
for a variance to the Zoning Ordinance, Article III, Section
100-31 and Bulk Parking Schedule for permission to change lot
lines on a filed subdivision map. Location of property:
Nassau Point Road and Clearwater Lane, Cutchogue, New York,
known and designated as Lots 105 and 106 on Map No. 156
"Amended Map A of Nassau Point."
The Acting Chairman opened the hearing at 8:52 P.M. by
reading the application for a variance, legal notice of hear-
ing as advertised in the official local newspapers, affidavit
attesting to its publication in the official newspapers,
Notice of Disapproval from the Building Inspector, and letter
from the Town Clerk that notification to adjoining property
owners was made to Robert H. Sturday and Roberta Sinott.
MR. DOUGLASS: We have a copy of a sketch drawn for Mrs.
Frisbie of the way she desires to subdivide this land and
where she desires the access t0 the piece where her house and
garage are and so on. We also have a section of the County
Map showing the part of Nassau Point where we would be taking
action upon. This again is a case where at the time of pur-
chase they purchased two sections of a subdivision, however,
when they were purchased and put together, it became one. So
it is now a case of subdividing the property not just changing
the lot line. Is there anybody in the audience who wishes to
speak for this application?
MR. FRISBIE: I'm the husband of the lady who owns the
property, and we appeared before the Town Planning Boar~ and
they told me that it was to go before you fellows, that this
was the question of redrawing the lot line. This is in a
filed subdivision map. There were two lots, 105 and 106. We
could build on 105 but it would mess things up because there
is a cesspool, the house on 105 for 106, and the garage for
106 is on 105; and I think you folks understand, I mean,
I don't know whether you care for me to show you.
MR. DOUGLASS: We have been up there and did take pictures
of it.

MR. FRISBIE: Well, what we had planned to do was at some future
time build on this other lot for one of our children when they were
ready for it; and that would be fine, we could do that now; but if
at some future time and when we pass on or when things change, there
would be an awful mix-up. In other words, it could be a mother-
daughter situation now or a father-son, but at a later date you
would have two garages on one lot and no garage on the other lot,
so we therefore respectfully request the permission regarding the
lot line.
MR. DOUGLASS: Can you tell me, were both of these lots when
purchased put in Mrs. Frisbie's name.
MR. FRISBIE: Yes, they were.
MR. DOUGLASS: Then it is now one common lot of 2.4 acres. They
are not independent lots any more.
MR. FRISBIE: Even in a filed subdivision?
MR. DOUGLASS: It becomes one lot. It doesn't matter whether
you buy two or three. If they were bought and purchased and put
under the single and separate ownership it is one lot. This, we
went over this with the Town Attorney yesterday and so it becomes
a point of subdividing this land, the one that you wish to create
out on Nassau Point Road conforms, there are no problems. It
conforms and has over the area and has road frontage. However,
the one that where you live will only have 25-foot of frontage
· on a road and that's the access. So thereby it does not conform
in frontage. The only thing that we can do is we can give you
approval of access and then you have to go back to the Planning
Board and they will have to approve the subdivision of it and
then the County Planning Board has to approve it because you are
within 500 feet of the water° That is a matter that our sacre-
tary just takes care of. She will, if it is approved, she would
write the Suffolk County Planning Board and they will send back
an answer to us. However, you will, if we approve the access and
so on for your homestead part, why then you will have to go back
to the Planning Board for approval of the subdivision of the two.
We can grant you the access and the lack of footage on the road.

MR. DOUGLASS: Is there anybody wishing to say anything'on
the application? Do you have any questions. I'll make a motion
then that the application for the access and the property divi-
sion of under the allowable number of footage be granted and
that you take it back to the Planning Board and get their
approval on the subdivision.
After investigation and inspection, the Board finds that the
applicant wishes to divide a 2.4 acre parcel into two parcels
which had become one parcel when p~rchase of both contiguous
parcels was made into the same ownership. Th~ lots in the ~.
proposed subdividing would'each have more than 40,000 square

feet in area. The Board feels that the applicant has met
requirements except for access off Clearwater Lane. The
Board agrees with the reasoning of the applicant.

The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of the property
and in the same use district; and the variance will not change
the character of the n~ighb0rhood and will observe the spirit
of the Ordinance.
On motion made by Mr. Douglass, seconded by Mr. Tuthill, it
was
RESOLVED, that Frances N. Frisbie, Clearwater Lane, Cutchogue,
New York, be GRANTED a variance for access to the lot whose
frontage will be off Clearwater Lane, subject to the following
CONDITIONS:
(1) That the access road be in conformance with the

THE CHAIRMAN: Welcome everybody here.
This is the regular monthly meeting of the
Southold Town Zoning Board of Appeals. The
first hearing on the agenda for the evening is
in behalf of Frances Frisbie, Appeal Number
3949. The legal notice reads as follows:
"Upon application of the Applicant 3949,
Frances Frisbie, variance to the Zoning Ordinan¢
Article III A, Section 100-30 A.4 (100-33),
as disapproved, for permission to construct
an accessory building in the front yard area.
Accessory buildings may only be located in
the required rear yard. Property Location:
8050 Nassau Point Road, Cutchogue, County Tax
Map No. 1000, Section 118, Block 5, Lot 2.1."
I have a copy of a survey indicating
a parcel approximately 2.25 acres, with a
large home that is on the water. The nature
of this application is a proposed shed which
is presently under construction, which lies
landward and almost directly in the center of
the lot -- contiguous to the tennis court. I
have a copy of the Suffolk County Tax Map
indicating this and surrounding properties in

the area.
Would somebody like to be heard?
MR. OLSEN: Gary Olsen. I am an attorne
having my office on Main Road, Cutchogue. I
represent the Applicant herein. I don't really
have too much to add, other than what I said
in the application. I think you did -- if
you drive down Nassau Point Road you will see
that a majority of the waterfront parcels have
a similar situation, in that the front yard is
basically the area between the house -- this
is considered between the house and the water --
and the rear yard for all practical purposes
becomes the area between the house and the
roadway. As you drive down Nassau Point Road
you see many houses have accessory buildings
between the house and the road than those that
don't.
This particular parcel, you can drive by
it and not even know it is there. It is very
wooded. There is a tennis court now located
between the house, with the Town's approval,
between the house and the roadway and the shed,
the proposed shed, would be located on the

westerly end of the tennis court. It would not
be visible really from any adjoining parcel nor
from the roadway, and I respectfully submit it
would not adversely affect the character of the
neighborhood. In fact, it probably would be
more in keeping with the character of the
neighborhood if the variance was granted than
if it was not.
There is a practical difficulty to put
this shed, which would be used for storing
tennis court facilities and lawn equipment and
so on, to put it in the rear yard which would
be the water side property. It creates a real
practical difficulty for this particular appli-
cation.
This property has been developed some
time ago, after the house was already there
and it would ruin the view to have the shed
between the house and the water. As I say, to
put it in this proposed location, no one's
going to even know it is there, and it is not
going to change the character of the neighbor-
hood.
In addition to what I submitted to the

Board, I do have a letter from Mr. Sanford
Hanauer indicating he has no objection to the
application. I submit that as an exhibit.
I also.have received a letter, dated
June 22nd, 1990, from the Southold Town Trustee!
indicating that this application is not within
their jurisdiction. So I submit that to you,
also.
I also have a survey, which is a little
different than the one I submitted in the
application, from VanTyle, which has elevations
put on it indicating that the proposed location
of this shed is towards the road side of a 15-
foot elevation and accordingly there would be
no Department of Environmental Conservation
jurisdiction. So I also submit that to you,
and I submit it.
I will submit a letter from -- well, it
is really a flier, from the Department of
Environmental Conservation indicating that thei~
jurisdiction does not extend for any structures
built beyond a 10-foot contour.
THE CHAIRMAN: The size of the shed is
10 by 12, and it is approximately four feet
