HomeMy WebLinkAboutLP-04/12/2016 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, April 12, 2016 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: John Sepenoski, Chairman Sam McCullough Eric Keil Anne Murray Lillian Ball Members Absent: None Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Tim Caufield, Peconic Land Trust Vice President Holly Sanford, Peconic Land Trust Program Manager Commencement:  The meeting began at 7:06 p.m. with five LPC members present. Committee Minutes and Administration: None Land Preservation Applications and Inquiries:  SCTM #1000-69.-1-8 (ZEBROSKI) PDR Application: Purchase offer review and determination \[executive session\] EXECUTIVE SESSION. The LPC members entered into On April 6, 2016, Landowner Bill Zebroski delivered a written formal bargain sale offer to the Town for the sale of a development rights easement on his entire parcel (SCTM #1000-69.-1-8) which LPC reviewed. Land Preservation Coordinator will inform the Town Board of the proposed bargain sale before entering into contract. END OFEXECUTIVE SESSION Landowner is agreeable to Town submitting this project for possible grant funding from NYS State Agriculture and Markets. Awarded grant recipients will not be notified until mid-September 2016. Sale will not be conditional upon receipt of State grant funding.  SCTM #1000-59.-3-28.5 (PINDAR VINEYARDS, LLC, Southold) PDR Application: Appraisal review and purchase offer determination \[executive session\] EXECUTIVE SESSION. The LPC members entered into A revised appraisal of Pindar Vineyards, LLC property was reviewed by LPC, in which appraiser re- evaluated property as “crop neutral”. END OFEXECUTIVE SESSION MOTION made by Eric Keil, seconded by Lillian Ball, to direct Land Preservation Coordinator Melissa Spiro to share Town’s appraisal with landowner and to grant Pindar Vineyards, LLC an additional thirty (30) day extension from date of revised offer letter based on appraiser’s re-evaluation. Purchase offer extended remains the same as in the March 23, 2016 offer letter. Motion carried: 5/0  SCTM #1000-14.-2-29.2, 29.3 & 29.4 and 19.-2-2, 3 & 12.2 (ORIENT POINT LLC a/k/a Papas/Vasilas) PDR Application: Appraisal review and purchase offer determination \[executive session\] EXECUTIVE SESSION. The LPC members entered into A revised appraisal was reviewed by LPC. END OFEXECUTIVE SESSION MOTION made by Eric Keil, seconded by Anne Murray, to direct Land Preservation Coordinator Melissa Spiro after receiving Town Board approval for the project, to present and negotiate a purchase offer to Orient East LLC, Orient West LLC, and Orient Point LLC for a development rights easement as proposed to LPC. Motion carried: 5/0  SCTM #1000-54.-5-49.1 (JAMES MURPHY) Open Space Application: Review new application LPC reviewed new application received from landowner James Murphy for the proposed Town’s purchase of 1.992 acres of vacant land/wetlands located across from McCabe’s Beach parking lot, said land being bordered by Horton Lane and Lily Pond. LPC favorable to preservation of this parcel for public access to Lily Pond provided landowner is offering sale of the property at a reasonable price. Land Preservation Coordinator Melissa Spiro directed to present proposed project to the Town Board for approval. MOTION made by Lillian Ball, seconded by Anne Murray, to direct Land Preservation Coordinator Melissa Spiro to commission an appraisal of property owned by James Murphy (SCTM #1000-54.-5- 49.1) subject to Town Board approval of this proposed project. Motion carried: 5/0 Applications & Inquiries for Uses or Structures on Preserved Property None Stewardship and Management: None General Land Preservation Items:  FARMLAND PROTECTION IMPLEMENTATION GRANT PROGRAM, ROUND 14 Request for Proposals Update re: review of potential projects Zebroski project discussed and will be submitted to NYS Agriculture and Markets as a proposal seeking State grant funding for the purchase of a Town development rights easement upon SCTM #1000-69.-1-8. Other current projects discussed and it was determined that no other project is a good candidate for grant submission.  DUTIES OF THE LAND PRESERVATION COMMITTEE Review duties pertaining to serving as a review board Land Preservation Coordinator Melissa Spiro gave presentation regarding her review of Duties of the Land Preservation Committee pertaining to review authority. Committee members discussed review authority including whether Committee is advisory or discretionary. Discussion will continue. Next Regular Meeting:  Tuesday, April 26, 2016.
