Matter of J. PARKER WICKHAM. Variance to the Zoning
Ordinance, Article XIII, Section 100-132, for permission to
construct a building for antique vehicles, proposed construction
will have bulk, area and parking regulations and insufficient
side yard setback. Property Location: 410 Airway Drive,
Mattituck, County Tax Map No. 1000, Section 123, Block 01, Lot
02.
WHEREAS, a public hearing was held and concluded on
February 1, 1990 in the matter of the Application of J. PARKER
WICKHAM, under Appeal No. 3897; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is located along the north
side of Park Avenue, Town of Mattituck, and is identified on the
Suffolk County Tax Maps as District 1000, Section 123, Block 01,
Lot 02.
2. This is an application for Variances from the zoning
Code Article XIII, Section 100-132, for permission to construct
a building for antique vehicles, proposed construction will have
bulk, area and parking regulations and insufficient side yard
setback in this LI District.

3. XXIII, Section 100-132, No building or premises shall
be used and no building or part therof shall be erected or
altered in the LIO Light Industrial Park/Planned office Park
District unless the same conforms to the Bulk Schedule and
Parking and Loading Schedules incorporated into this chapter by
reference, with the same force and effect as if such regulations
were set forth herein in full.
4. In considering this application, the board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities.
(b) that there are buildings in the immediate Zoning
District as close or closer with proposed additions and that the
area chosen to store antique cars is not unreasonably located.
(c) that the use will not prevent the orderly and
reasonable use of adjacent properties.
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally noted below.

be located on northwest side of existing large storage building
2. That the 20 by 40 ft. addition to the existing large
storage building be located on the west side of the premises.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis and

Mr. Orlowski: Oregon Road Recycling Corp. - Discussion of
fire well letter. SCTM ~1000-83-3-4.5. We have conditional
approval. I went to sign it and noticed one of the conditions
that should have been on there was the firewell. What would
the Board like to do?
Mr. Ward: Mr. Chairman, I would like to offer the following
resolution.
WHEREAS the Southold Town Planning Board has received a
letter from the Chief of the Cutchogue Fire Department, dated
February 19, 1992, in which a recommendation is made in
accordance with that Department's policy, that a fire well be
installed on subject property due to the fact that there is no
fire well within 1500 feet; and whereas said distance of 1500
feet is considered the.maximum effective distance from a
suitable water supply for fire protection; and whereas the
closest wells to the property are 2121 and 2626 feet away;
AND WHEREAS the Southold Town Planning Board also has
received a letter from the Chairman of the Cutchogue Board of
Fire Commissioners, dated February 21, 1992, which states that a
recent safety inspection of the subject premises revealed that

The following is in response to your request of January 29,
1990 for comments on Appeal No. 3897, Parker J. Wickham.
The Planning Board is not in favor of reducing the
transition buffer area between the above Light Industrial (LI)
District and the R-80 Low-Density District to the north of the
property from thirty feet to four and one half feet.
There is no hardship on the applicant's part as there are
other locations on the site which can be used for the siting of
the new building. The purpose of the buffer area is to protect
residentially zoned property from the impact of industrially
zoned property. Granting the applicant's request would be an
unwarranted intrusion into the buffer area.

The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, March 26, 1990.
RESOLVED that the Southold Town Planning Board, acting
under the State Environmental Quality Review Act, do an
uncoordinated review of this unlisted action. The Planning
Board establishes itself as Lead Agency, and as Lead Agency
makes a determination of non-significance and grants a Negative
Declaration.
Please remit a check in the amount of twenty (20) dollars
to cover the site plan fee for the additional building of eight
hundred (800) square feet.
Enclosed please find a copy of the Negative Declaration for
your records.

The public hearing on this matter was held on .July 29, 1982.
Upon application of MATTITUCK AIRBASE INC., Airway Drive, Mattituck,
NY for a Specia~ Exception to the Zoning Ordinance, Article VIII, Section
100-80B(1) for permission to alter and construct addition in a "C-Light"
District located at 410 Airway Drive, Mattituck, NY; bounded north by New
Suffolk Avenue and Wickham; west by Bagshaw, Peconic Corp. and Wickh~t~
south ~by Park Avenue; east by Wickham, Parkin, Tandy, Wickham and Holman;
County Tax Map Parcel No. 1000-123-1-2.
The boa'rd ~ade the following findings and determination:
By this appeal, appellant seeks permission to construct a 30' x 125'
addition attached to the existing shop building, leaving a rearyard set-
back of approximately 59' from the rear property line (presently abutting
Bagshaw). The premises in question is trapezoidal in shape and has a
· frontage along Airway Drive of 260 feet. Existing on the premises are
the principal building and an accessory building located in the northerly
sideyard area. The principal building is extensive, with an office,
stock rooms, waiting room
For the record it is noted that appellant has previously applied
to this board under Appeal No. 2893 for permission to construct an
addition with an insufficient fron~yard setback for office space. That
variance was given a conditional approval at a Special Meeting held
November 7, 1981.
In considering this appeal, the board determines that the variance
request is not substantial; that the circumstances herein are unique and
practical difficulties have been shown; that by allowing the variance no
substantial detriment to adjoining properties would be created; that the
difficulty cannot be obviated by a method, feasible to appellant, other
than a variance; that no adverse effects will be produced on available
governmental facilities of any increased population; that the relief
requested will be in harmony with and promote the general purposes of
zoning; and that the interests of justice will be served by allowing the
variance as indicated below.
On motion by Mr. Douglass, seconded by Mr. Goehringer, it was

A public hearing was held and closed concerning this
appeal on October 15, 1981.
The Board made the following findings and determination:
Appellant has appealed to this Board seeking a variance
for permission to construct an addition to the existing office
building at 410 Airway Drive, Mattituck, New York with a setback
from Airway Drive of approximately 15 feet. Existing on the
premises is an extensive building with office, stock rooms,
waiting room, etc. The proposed addition contains an area of
approximately 447 square feet. The addition for office space
as indicated in the appeal application seems most practical,
inasmuch as it is being extended from the existing office area,
however, the Board is concerned about the nearness of the
building to Airway Drive particularly if Airway Drive were
accepted as a Town Road. Information supplied to the Board
indicates that Airway Drive is maintained by the Town.
In considering this appeal, the Board determines that the
variance request is not substantial; that the circumstances herein
are unique and the practical difficulties have been shown; that by
allowing the variance no substantial detriment to adjoining proper-
ties would be created; that no adverse effects will be produced on
available governmental facilities of any increased population; that
the interests of justice will be served by allowing the variance.
On motion by Mr. Goehringer, seconded by Mr. Grigonis, it
was
RESOLVED, that a variance to the zoning ordinance as
applied for in Appeal No. 2893, application of Mattituck Air
Base, Inc. be allowed SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the setback from the easterly property line be
not closer than 18 feet;
2. That this matter be referred to the Suffolk County
Planning Commission pursuant to Sections 1323, et seq. of the
Suffolk County Charter.
