Matter of PAMELA VALENTINE. Variance to the Zoning
Ordinance, Article XXIII, Section 100-231 A, for permission to
construct a fence exceeding 4 ft. in the front yard area. Fence
in the front yard area not to exceed 4 ft. in height. Property
Location: 34655 Main Road, Orient, County Tax Map No. 1000,
Section 019, Block 01, Lot 5 & 6.
WHEREAS, a public hearing was held and concluded on May
15,1990 and May 30, 1990 in the matter of the Application of
PAMELA VALENTINE under Appeal No. 3933; and
WHEREAS, at said hearing all those who desired to be hard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board Made the following findings of fact:
1. The premises in question is located along the north
side of Main Road, Route 25, Hamlet of Orient, and is identified
on the Suffolk County Tax Maps as District 1000, Section 019,
Block 01, Lot 5 & 6.
2. This is an application for Variances form the Zoning
Code Article XXIII, Section 100-231 A, for permission to
construct a fence exceeding 4 ft. in height in the front yard
area.

3. Article XXIII, Section 100-231 A, Fences walls, hedges
or other live plantings within five (5) feet of the property
lines may be erected and maintained, subject to the following
height limitations:
A. When located in the front yard along the front lot
line, the same shall not exceed four (4) feet in height.
B. When located along side and rear yards, the same shall
not exceed six and one-half (6 1/2) feet in height.
C. When located other than in the front yard area or along
side or rear lot lines, the same shall not exceed eight (8) feet
in height.
4. The subject premises in question contains an area of
29,855+- sq. ft. and an area to the east property line to be set
off containing 18,984+- sq. ft. a total area of 48,839 as shown
on the survey dated February 4, 1986, by Roderick VanTuyl
depicts a one and a half story framed house with an accessory
garage in this R-40 Zone District.
5. In considering this application, the Board finds and
determines: (a) the relief requested is not within the
character of the immediate area and will be a substantial
change, creating other precedents to follow; (c) the practical
difficulties claimed are not sufficient to warrant the granting
of the relief requested; (d) the circumstances of the property
are not unique; (e) that in carefully considering the record
and all the above factors, the interest of justice will be
served by denying the relief granted and granting alternative
relief, as further noted below.
Accordingly, on motion by Mr. Grigonis, seconded by Mr.
Dinizio, it was
RESOLVED, to

DENY the Variance with ALTERNATIVE RELIEF in
application of PAMELA VALENTINE under Appeal
TO THE FOLLOWING CONDITIONS:
1. That the fence not be any higher than 5 ft. 6 in. at
its highest point above grade and that the fence be 2 to 6
inches within the property line for the entire distance of the
fence area requested and that the fence be located as drawn in
on the survey by Roderick Van Tuyl dated February 4, 1986.

2. That standing at a point approximately forty (40) feet
north of the intersection of Old Main Road and Main State
Highway and running along Main State Highway approximately 249+-
feet.

there was a problem with adVertising and

MS. VALENTINE: Pamela Valentine. It
was not advertised~and we were not properly
notified.
THE CHAIRMAN: Would you give us any
statements that you'would like for the file,
please?
MS. VALENTINE: Yes. I would like to
make one statement about the description of
our application for permission to build an
eight-foot fence. The application was actually
for a six-foot fence, except for the limited
area on that front of Main Road and that was
the only frontage where we applied for an
eight-foot fence. In fact, it may be a seven-
foot fence in that limited area, but the fence
is going to be a six-foot fence if it is
approved.

not normally grant these. You are going to
have to tell us why you want it. This
definitely is in the front yard area. It is
on the main road, and you have got to explain
to us why you want it.
MS. VALENTINE: Well, we want it:
1) Because of the increasing traffic from the
ferry which I think is pretty noticeable. Ther,
was an article in the Suffolk Times just last
week. It is not only us, but a lot of people
are realizing that the traffic is just becoming
a problem. There is a lot. This lot in par-
ticular suffers because it is closer to the
ferry than -- it is not in Orient Town itself.
It is way outside of the town. We don't have
any neighbors who would be able to see the
fence from their yard or their home. The
ferry traffic at that point isn't broken up,
at all. We just have strings of traffic.
Quite frequently it is strings of commercial
traffic.
THE CHAI~V~N: You presently have there
split rail fence and there are bushes around
this split rail fence.

THE CHAIR~LAN: What are you doing?
Are
you taking out the split rail fence and putting
in a stockade fence in place of that?
MS. VALENTINE: The fence we propose
to put in would be in the exact location of
the split rail fence, which I believe is about
10 feet from the road, and the fence would be -
I really don't know if stockade is the right --
it would be a tongue and groove cedar fence.
THE CHAIrmAN: You mean like a woven
fence.
MS. VALENTINE: Can I approach?
THE CHAIRMAN: Sure. That's why we
asked you to come.
MS. VALENTINE: It would be kind of
like this.

be planting? First of all, I was over there
and we are familiar with the property. We
had litigation on this before.

THE CHAIrmAN: I was unable to pick.up
any monuments to locate, to see where the
actual property line started. So that is the
reason for my question, in reference to place-
ment of where the split rail fence is,
because with the copy you can see it from there
It really just takes the property line and
draws a red line through it, and I do not
know the exact placement of where the fence
is going to be. Would you be planting anything
in front of this fence so as to shield it,
in any way?
MS. VALENTINE: I don't believe we
would be planting anything in front of it.
There are flowers and low, very low plantings
in front of the fence where it is. To the
extent that those could be saved, we would
save those and to the extent that we can save
any plantings that are presently there, it
would remain.
THE CHAIRMAN: What is the purpose of
the eight-foot fence in front of the easterly
lot?

MS. VALENTINE: The seven or eight-foot
fence in front of the easterly lot is because
when we initially purchased the property we
were hoping to put a tennis court in that lot.
As it stands now, I don't think either of us
could go out and play tennis because of the
traffic out there. If, in fact, we do decide
to put a tennis court, we would like a slightly
higher fence in that area: 1) For the
protection and because it wouldn't be seen
from the house as much as you would see the
seven-foot area fence. If you are going to
deny our application because you object to
the eight-foot fence, what we would be willing
to do is listen to your proposal on limiting
it to a six or seven-foot fence in that area.
THE CHAIRMAN: The fence is for the
sole purpose of keeping balls off the road,
evidently, or is it for the purpose of
shading the property from the viewer?
MS. VALENTINE: I think it serves both
purposes, actually.
THE CHAIRMAN: I thank you very much.

there is anybody else here in the audience

I have read over the minutes of the
last hearing. I have one correction. I
stated the erosion that has taken place is
about a foot a year on top of the bluff. That
is incorrect. It is about a foot every two
years. I have remeasured that. I have been
up there since 1968, and we just replaced the
deck on the association property. It was
about 10 years ago we had replaced it. I
measured what the difference was, the recessio]
and it's following the way it has been. I

WHEREAS, public hearings were held on April 3, 1986, May 22,
1986, August 14, 1986, and September II, 1986, at which time the
hearing was officially concluded; and
WHEREAS, at saiJ hearings all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the board has ~arefully considered all testimony
and documentation submitted conceKning this applicati, on; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning,
and the surrounding areas; and.
WHEREAS, the'board made the following findings of fact:
1. By this application, appellants request Variances from
Article III, Section 100-31, Bulk Schedule of the Zoning Code
which requires: (a) a minimum lot area of 80,000 sq. ft.,
(b) a minimum lot width [frontage] of 175 feet, and (c) a
minimum lot depth of 250 feet.
2. The property in question contains a total area of
48,839 sq. ft., total lot width (frontage) of 242.10 feet,
and average lot depth of 220.07 feet. The subject premises

is improved with the following structures: (1) 1½-story
framed, single-family dwqlling, (2) nonconfoKming frame
cottage, (3) accessory ~hed, (4) accessory garage, all
as shown by survey map prepared July 2, 1986 by Roderick Van
Tuyl, P.C. The premises was conveyed to Katherine Heins
by deeds: (a) at Liber 5129 cp 89 dated January 31, 1962
by W.C. Duvall, and (b) at.Liber 5487 cp 487 dated 3, 1964
by W.C. Duvall.
3. Appellants request area variances of two proposed
parcels in this pending~division of land as follows: (a)
the westerly portion of 27,742 sq. ft. in area,.133.99 feet
along the Main Road and 146.§3 feet along the Old Main Road,
and 193.62 feet in depth, retaining the two existing residential
dwelling structures and accessory storage buildings; (b)
the easterly portion of 21,097 sq. ft. in area, lot width of
lO8.11 feet and average lot depth of 242.11 feet. It appears
that the nonconforming status of the existing dwellings will
not be upgraded by this application, and a third dwelling
structure is anticipated.
4. On October ll, 1983, under Appeal No. 3144, appel-
lants were denied area variances in a proposed division of
this property for the reasons stated therein; and on November 2,
1983, the Suffolk County DEpartment of Planning disapproved
same after review in accordance with the requirements of
the Suffolk County Charter. To date, there has been no
change concerning these actions.
5. On October 16, 1984, the Suffolk County Department
of Health issued approval.of construction after application
by the appellant(s) for the proposed new dwelling under #14-S0-208.
6. On March 22, 1985, a building permit was issued by
the Town Building Department after application by the appellant(s)
for a new single,family residence under #13778Z, on a parcel of
an area of 18,984 sq. ft. as shown by the building-permit application
and survey prepared October 12, 1984 by Roderick VanTuyl, P.C.
7. On NJvember 29, 1985, Long Creek Homes was engaged
by the applicants, who advanced to him a check of $11,983.00.
8. By early December 1985, the lot had been cleared and
a portion of the footings installed. There has been no other
construction to this date. ~.
9. On or before December 24, 1985, Building Permit
#13778Z was properly revoked by the Building Department.
10. On February 28, 1986, this application for a
variance was filed in complete form with the Southold Town
Clerk for processing by the Board of Appeals.
ll. It is further noted for the record that to date
no subdivision or set-off approvals have been rendered by
the Southold Town Planning Board, concerning this pending
division of land.
12. I'n viewing the character of the area, the board finds

a majority of the parcels in the area contain an area of 40,500
sq. ft. or more: (a} to the north, a 3.3-acre parcel, (b)
to the east, a 1.6-acre parcel, (c) directly south along the
south side of the Main Road, an 18.2-acre parcel, {d) .west of
the westerly side of the Old Main Road, a 1.9-acre parcel;
{e} two lots east, a 40,500± sq. ft. parcel, and a 44,000±
sq. ft. parcel.
13. The percentage of the lot area required in the
zoning code by this application is: (a) 73% for the proposed
easterly parcel, (b) .65% for the proposed westerly parcel.
In considering this application, the board also finds
and determines that: (a) the relief requested is substantial
in relation to the requirements, (b) that the difficulties
claimed are not sufficient to warrant a granting of the relief
requested, {c} the character of the immediate area would
be adversely affected by the granting of the variance, (d)
the variance will in turn cause a substantial effect
on the safety, health, welfare, comfort, convenience, order
of the town, {e) in view of the manner in which the difficulties
arose, the interests of justice will best be served by denyi.ng
the variances applied.

The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavits attesting
to its publication in the official newspapers, and notice to
the applicant.
THE CHAIRMAN: Is there anyone present who wishes to

(Mr. William Heins was present to speak for the applica-
tion).
THE CHAIRMAN: There is a note in the file dated
January 23, 1975: "To Whom It May Concern: There is no
objection on my part regarding a building of Mr. Hein's
being too near the property line." s/s William D. Tuthill.

MR. WILLIAM HEINS: Yes.
THE CHAIRMAN: How close is the building to the line?
MR. HEINS: I thought it was about 10 feet.
THE CHAIRMAN: This first survey shows 12 feet but I
think you added something to that.
MR. ROBERT BERGEN: How much did you add on to the garage?
MR. HEINS:-. About 8 feet
THE CHAIRMAN: ~The cause-of all this trouble was that you
connected_the_accessory building to the house which put
house three feet from the line.- Originally the'building was.
there and you enlarged the original garage, and then
attached the garage to the house. The house is eleven feet
from Old Main Road and it is on an irregularly shaped lot.
I think that the reason why the date of the original applica-
tion for a Building Permit is 1969 and this violation that
the Building Inspector found is dated 1975 is that in the
meantime you were trying to buy some property.

Bulk Schedule, for permission to reseparate two parcels having insufficient
area and/or width, located at the north side of Main Road, Orient, NY;
more particularly identified as County Tax Map Parcel Nos. 1000-19-2-5 & 6.
The public hearing on this application was held on September 29,
1983, at which time the hearing was declared closed pending deliberations.
The board made the following findings and determination:
This is a variance from Article III, Sections 100-30 and 100-31,
Bulk Area Schedule, which requires a minimum of 80,000 square feet for
each parcel of land and a minimum lot width of 175 feet. The applicant
presently owns a parcel of land containing approximately 52,000 square
feet in area. Applicant proposes a division of this parcel into two
lots, the most westerly parcel would contain an area of approximately
33,000 square feet and the easterly parcel would contain an area of
approximately 19,200 square feet with 88-foot frontage along the Main
(State) Road. Existing at the northwesterly section of the subject
premises is a 1½-story, one-family, frame dwelling with accessory
garage.
For the record it is noted that at a meeting held August 17, 1983,
the Southold Town Planning Board disapproved the project as proposed.
The public hearing on this application before the Zoning Board was
held on September 29, 1983, and the board is familiar with the state-
ments and circumstances herein. The members of this board have per-
sonally visited the site and are also familiar with the property as
well as the surrounding neighborhood. A majority of the parcels in
the immediate neighborhood contain an area of 40,500 square feet, or
more.
In considering this appeal, the board determines: (1) that the
practical difficulties are not sufficient to warrant the granting
of this application; (2) that the variance request is substantial
in relation to the requirements of the zoning 6ode; (3)
that the circumstances are not unique, and that a precedent may be set
if granted, for other parcels in the neighborhood; (4) that the
relief requested will not be in harmony with or promote the general
purposes of zoning; (5) that the interests of justice will not be
served by allowing the variance applied for.
