Please be advised that I have been requested by Phyllis Rayne Byer
to represent her in re the above captioned matter. In reviewing the
Notice of Disapproval from the Southold Town Building Department
dated September 21, 1990 it is noted that the building inspector
referred to Article III Section ]O0-30A (1). I cannot find such a
section in the Zoning Code. Under Article III there is a Section
]O0-3]A (1). There is also an Article IIIA Section ]00-30 A.].
which relates to a Low Density Residential R-40 District which use
district is tota]ly unrelated to the subject premises which is zoned
Limited Business (LB) District.
Due to the fact that there appears to be a technical error on the
face of the Notice of Disapproval I would respectively request that
the hearing scheduled for March 22, 199] be recessed so that I can
communicate with the building department in order to review the
issues raised in this letter.
