Gercke Land Company, Inc. , a Virginia Corporation with its
principal place of business at 3056 Berkmar Drive (P.O. Box
7213) , Charlottesville, Virginia 22906, party of the first part,
and
Benson Shalette, residing at 110 East End Avenue, New York, N.Y.

a WITNESSETH, that the party of the first part, in consideration of
Ten Dollars and other valuable consideration paid by the party of
the second part, does hereby grant and release unto the party of
the second part, the heirs and successors and assigns of the
party of the second part forever,
ALL that certain plot, piece, or parcel of land situate, lying,
and being in the Town of Southold, County of Suffolk, State of
New York, bounded and described as follows:
BEGINNING at the point where the westerly line of a certain 50'
right-of-way (recorded in the Suffolk County Clerk's Office on
DIST. 1000 November 29, 1978 at L. 8541 p. 192) comes to its northern terminus
SEC. 052.00 at land of Ofrias known as Arshamomaque Island, said point also
being the southeasterly corner of the premises about to be
BLK. 07.00 described: Running thence along the southerly line of Ofrias and
PARTOFlOT the northerly line of Lang, two courses: (1) S 88° 00130"W 466. 37
00 0 feet; thence (2)N 46°2214011W 25 feet, more or less, to the
ordinary high water mark of Long Creek; thence northerly along
said high water mark 625 feet, more or less; thence along other
land of Ofrias the following six courses:
(1) S. 88 ° 001 E. 270 feet; (2) S. 2 ° 00' W. 300 feet; (3)
along an arc curving to the left, with a radius of 40 feet, a
distance of 62 . 83 feet, (4) S 880001E 135 feet, (5) S 24 '31'30"E157 . 26 feet, (6) S 1°59130"E 90 feet to the point or place of
beginning.
TOGETHER with the 50' right-of-way described at L. 8541 p. 192 .
TOGETHER with another right-of-way over other land of Ofrias
immediately to the north of the northerly terminus of the 50'
right-of-way, which right-of-way is bounded and described as
follows:
J Beginning at the point where the easterly line of the 50'
right-of-way comes to its northern terminus at the land of
v~ Ofrias known as Arshamomaque Island; thence along other land
of Ofrias the following six (6) courses: (1) S 88°00130"W 50
feet, along the northerly end of the 50' right of way and
the southerly line of Ofrias, (2) N 1059130"W 90 feet, (3) N
24 °31130"W 157. 26 feet, (4) S 889001E 27 . 94 feet, (5) S
0 24° 31130"E 215 feet, (6) S 1059130"E 30 feet, more or less,
U to the point or place of beginning.

Said right-of-way to be used for ingress, egress, utilities, and
all other legal purposes.
Together with and subject to another right of way immediately to
the west, then north of the westerly line of said last mentioned
right of way which is more particularly bounded and described as
follows:
Beginning at a point on the westerly line of said last
mentioned right of way, said point being distant the
following two courses and distances as measured along same
from a point on the westerly line of another right of way
(recorded in the Suffolk County Clerk's Office on 11/29/78
at Liber 8541 page 192) where said last mentioned right of
way is intersected by the northerly line of land now or
formerly of Lang: (1) N. 1° 59' 30" W. 90 feet, and (2) N.
24 " 31' 30" W. 104 . 58 feet to the true point or place of
beginning. Running thence from said point or place of
beginning along the arc of a curve bearing to the left
having a radius of 40 feet, a distance of 44 . 31 feet; thence
N. 88° 00' W. 122.74 feet; thence westerly, northwesterly,
and northerly along the arc of a curve bearing to the right
having a radius of 65 feet, a distance of 102 . 10 feet;
thence N. 20 00' E. 300 feet; thence S. 880 00' E. 25 feet
to land now or formerly of Ofrias, the following three
courses and distances: (1) S. 2 ° 00' W. 300 feet; (2)
southerly, southeasterly, and easterly along the arc of a
curve bearing to the left having a radius of 40 feet, a
distance of 62 .83 feet, and (3) S. 88 ' 00' E. 135 feet to
the westerly line of the first above mentioned right of way,
and thence along the westerly line of said right of way S.
240 31' 30" E. 52 . 68 feet to the point or place of
beginning.
To have and to hold the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party
of the second part forever. And the party of the first part
covenants that the party of the first part has not done or
suffered anything whereby said premises have been encumbered in
any way whatsoever except as aforesaid. AND the party of the
first part in compliance with Lien Law § 13 covenants that the
party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the
cost of the improvement before using any part of the total of the
same for any other purpose.
This transfer is made in the ordinary course of the transferor's
business.
