Box 1179 Southold, New York 11971 Fax (516) 765-1823 Telephone (516) 765-1800 ACTION OF THE BOARD OF APPEALS Appeal No. 4006: Application of ERIC AND MARY ANN ALEXANDER for a Variance to the Zoning Ordinance, Article XXIV, Section 100-244B, for permission to construct addition to dwelling with an insufficient side yard setback from the westerly property line. Premises is nonconforming as to lot area in this R-40 Zone District, and the existing dwelling structure is nonconforming as to the westerly side yard and southerly (rear) yard setbacks. Location of Property: South Side of Peconic Bay Boulevard, Laurel, NY; County Tax Map Designation: 1000-128-04-020. WHEREAS, a public hearing was held on February 22, 1991 and on March 22, 1991 in the Matter of the Application of ERIC AND MARY ANN ALEXANDER under Appeal No. 4006; and WHEREAS, at said hearings all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located along the southerly side of Peconic Bay Boulevard in the Hamlet of Laurel, Town of Southold, containing a total lot area of approximately 28,750 sq. ft., and is identified on the Suffolk County Tax Maps as District 1000, Section 128, Block 4, Lot 20. The subject premises: (a) is improved with a one story single-family dwelling structure set back at its closest points 11.8 and 14.8 feet from the westerly {rear} property line; 35+- feet from the southerly (side) property line; 90+- feet from the northerly (front) property line, and 13+- feet from the right-of-way easement line and 28.5 feet to the easterly {front} property easterly right-of-way easement boundary, all in the ownership of the applicants; (b) is located in the R-40 Zone District which requires a minimum side yard at 15 feet (Section 100-244B) for substandard parcel of this size. 3. Appellants are requesting permission to construct a 10' wide x 53' long one-story addition with a proposed setback of 4.8 feet from the westerly property line. 4. The amount of relief requested by this application is 68 percent of the requirement (10.2 feet), which is substantial. 5. It is the opinion of the Board that although the variance as requested is not the minimum necessary to afford to afford relief, that an alternative setback at not less than seven (7') feet from the westerly property line is more appropriate under the circumstances. 6. In considering this application, the Board also finds and determines: (a) that the grant of alternative relief will not be adverse to the essential character of the neighborhood; (b) the alternative relief will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town, or be adverse to neighboring properties; Pa~e 3 April ~0, 1~91 Special Meeting Southold Town Board of Appeals (ALEXANDER decision, continued:) (c) the grant of the alternative relief will not increase dwelling unit density or cause a substantial effect on available governmental facilities; (d) the relief, as alternatively granted, is the minimum necessary to afford relief; (e) the practical difficulties claimed are uniquely related to the land and are not personal in nature; (f) the difficulties cannot be obviated by some other method feasible to appellant to pursue, other than a variance; (g) in considering all of the above factors, the interests of justice will be served by denying the variance requested and granting alternative relief, as conditionally noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Villa, it was RESOLVED, to DENY the variance as applied for a proposed setback from the westerly property line at 4.8 feet, and to ALTERNATIVELY GRANT a reduced setback from the westerly property line at not less than seven (7') feet. Is there anything you would like to say for the record? MR ALEXANDER: Yes, sir. My name is Eric Alexander. The kitchen itself is at this point 30 years old and in desperate need of modernization. My family is growing, I have four children and my widowed mother-in-law lives with us half the time, so while we are intending to modernize the kitchen, it is an opportune time for us to also expand it so that it's easier to eat in the kitchen itself. That's the reason for the request for the variance. The hardship would be involved in perhaps relocating the kitchen which is financially not really feasible. The properties in this particular area, along the Boulevard are quite long and narrow and the house itself is built to situate on that particular piece of property, so it is in fact, the house is long and narrow. The area in question on the Boulevard is mostly a su~er area and there are quite a few residences in the area that have five feet or less side yard variances. In fact, of the seven properties that adjoin my piece of property, there are seven structures on those properties that are five foot or less to the existing property line. I have pictures of those particular structures. CHAIRMAN GOEHRINGER: Great. Could we see them? MR ALEXANDER: Sure. Just to finish. The westerly boundary which is where the intended addition would be, there is a new, a brand new structure being built there, on that piece of property at this point. That structure, in fact has a five foot side line variance. CHAIRMAN GOEHRINGER: application on that. one? This is the McGowan one. We had an This is McGowan also. MR ALEXANDER: No. This is to the east of the actual building, Dr. Gross happens to own two pieces of property. This is his garage and then this is to the east of his garage, there's a home and a garage. I would be probably more in conformance with the neighborhood if I had the variance. CHAIRMAN GOEHRINGER: I'm going to pass these over. You are going to give me this right? MR ALEXANDER: Yes. CHAIRMAN GOEHRINGER: Okay. Let me take those also. We have two members of the Board that were not on the Board at the time. I do want to ask you one or two more questions. MR ALEXANDER: Yes, sir. CHAIRMAN GOEHRINGER: My question, Mr. Alexander, is the 4.8 feet which you propose. Does that include the overhang? or would there be a further? MR ALEXANDER: Yes. CHAIRMAN GOEHRINGER: It does include the overhang? MR ALEXANDER: I believe it will include the overhang. The actual structure will not be that close. I do attest to the problems that exist on an undersized lot of this nature, however, and I'm very well familiar because I did live across the street from you for about 16 years, at one time. I don't presently. So, I'm going to ask the Board if they have any reason that they might want to go into Mr. Alexanders' house and look at the present situation that exists and what he intends to do or can we see this from the outside? Nonconforming buildings with nonconforming uses. A. A nonconforming building containing a nonconforming use shall not be enlarged, reconstructed or structurally altered or moved unless the use of such building is changed to a conforming use. B. A nonconforming building containing a nonconforming use which has been damaged by fire or other causes to the extent of more than fifty percent (50%) of its fair value shall not be repaired or rebuilt unless the use of such building is changed to a conforming use. § 100-244. Nonconforming lots. A. This subsection is intended to provide minimum standards for granting of a building permit for lots made nonconforming or continued in a state of nonconformance by the adoption of this Article and that were singly and separately owned as of the effective date of this Article. B. A nonconforming lot separately owned and not adjoining any lot or land in the same ownership at the effective date of this Article and not adjoining any lot or land in the same ownership at any time subsequent to such date maY be used, or a building or structure may be erected on such lot for use, in accordance with all the other applicable provisions of this chapter, provided that proof of such separate ownership is submitted in the form of an abstract of t/tie showing the changes of title to said lot, which abstract shall be i{~ the usual ' form, shall be certified by an attorney or a company regularly doing such work in Suffolk County or by a corporation duly licensed to examine and ensure title to rea] property in Suffolk County and shall contain a certification that no contiguous property was owned by an owner of the property involved since the date of any previously applicable Zoning Law. Such lot shall be granted relief for front side and rear yard dimensions as follows: 10144 2-25-89 ZONING § 100-250 C. In the case of single and separate ownership of a nonconform- ing lot located in a subdivision plat, approved after April 9, 1957, by the Planning Board of the Town of Southold and filed with the County Clerk of Suffolk County, relief for all front, side and rear yard and area dimensions shall be granted to the extent that such front, side and rear yard and area dimensions were required at the time the map was originally fil~ed with the County Clerk of Suffolk County. § 100-245. Repairs and maintenance. Notwithstanding any of the foregoing regulations, nothing in this Article shall be deemed to prevent normal maintenance and repair of any building or the carrying out upon the issuance of a building permit of major structural alterations or demolitions necessary in the interest of public safety. § 100-246. Involuntary moves. Sections 100-241A and B and § I00-243A herein are not ir~tended to apply to involuntary movements of uses or structures as a~result of condemnation actions or other litigation.
