You must have a letter of consent or permission in order to keep your stake there. We suggest that you get written permission fromMr. Gillispie allowing you to keep your stake there. Goldsmith, Chairman Board of Southold Town Trustees Town Clerk's Building Southold, New York 11971 Re: Mooring Stakes at Dam Pond, East Marion Dear Sir: Sometime ago you wrote to me requesting an opinion with respect to the authority of the Town Trustees to issue permits for mooring stakes along the shore of Dam ]Pond. You had received a letter from Mr. Gillispie whose family assert title to the lands in question. It is my understanding that the Trustees contemplate issuing permits to persons to place stakes along the shore (an possibly offshore) at Dam Pond. I believe that it is unquestioned that the Gillispie family has title to the lands along the shoreline and in the absence of any consent or permission I do not believe that the Trustees would have authority to issue permits for the placing of stakes or piles on private property. Please be advised that the up-l~d contiguous to Route 25 in the area of the permits is private property owned by Narion S Gilliepie and further that the creek bottom in that area is alee privately owned by virtue ef deeds of record.
