Dear Mr. Gilliland:
The following action was taken by the Board of Town Trustees during
their regular meeting held on June 25, 1987 regarding the above matter.
WHEREAS, Michael S. Gilliland applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated April 4, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on June 25, 1987 at which time all interested
persons were giveh an opportunity to be heard, and no objections were raised, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
WHEREAS,' the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED than Michael S. Gilliland BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: To construct a
single family residence. Property is located on Sound Drive, Greenport.
The permit is approved with the provision that the house is placed no closer tothe
sound than the neighboring homes.

This permit will expire on June 25, 198~ if work has
not commenced by said date. There are nwo inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
mnsurance policies insuring against any liability which may arise
mn the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
PLEASE RETURN TO THE BUILDING DEPT. FOR A DETERMINATION ON THE NEED OF ANY
OTHER ~OWN PERMITS THAT MAY BE REQUIRED FOR THIS PROJECT.
Please remit $10.00 for Wetland Inspection fees for this project.

REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.

The Southold Town Conservation Advisory Council held its regular meeting
June 18, 1987. The following recommendations were made at that meeting:
No. 527 - Mr. and Mrs. John Lang - Recommend approval with the stipula-
tion that applicant does not distub the natural vegetation (spartina
wetland).
No. 528 -_Mr. and Mrs. Alan Watson - Recommend approval.
No. 529 - Hide-A~Way Boat Basin- Recommend approval.
No. 530 - West Lake Association - Recommend approval.
No. 531 - Alexander Koke - Recommend approval of the berm and filling.
No. 532 - Gardiners Bay Property Owners Association - Recommend approval.
No. 533 -Yan H. Rieger - Recommend approval.
No. 534 - Peter Fakiris - Recommend approval of the dock but disapprove
of the bulkheading. The CAC suggests applicant extends the
ramp from the base of the dock up further and that would eliminate
the need for -the bulkheading. The CAC does not approve of the
bulkhead because there are no other bulkheads in the area and
the bulkhead would create erosion problems.
No. 536 - John C.W. Campbell - Recommend approval with the stipulation that
a 50' natural vegetation buffer be maintained between the house and
bulkheading.
No. 510 - James E. Fitzgerald .Ir., Pres., Broadwaters Cove Association, Inc.
Recommend approval.
No. 522 - Michael S. Gillilund - Recommend approval with the stipulation that
it be mandatory that applicant does not disturb the natural
vegetation buffer between the house and bluff.

Dear Mr. Smith:
Enclosed is my completed application plus ~150 filing
fee plus ~5.00 inspection fee for the Wetland Permit from the
Southold Town Trustees.
I am, of course, happy to comply with any requirement
of the Town Board, but I am uncertain as to why such an
application would be necessary. While I am unfamiliar with the
ordinance and regulations governing coastal and interior
wetlands, flood plains and drainage areas of the Town of
Southold, the information required by the permit seems to be
geared toward projects that will disturb wetlands, shoreline and
the like. As I indicated in my application for a variance, the
bluff on which I plan to construct my house is 45 feet above the
water and does not itself contain any wetlands. I intend to
disturb the bluff only to the extent absolutely necessary to
build a house and garage and will not disturb any of the areas
that seem to be of concern in the permit application.
To respond to additional questions posed by the
instruction for the Wetlands Permit application, my lot, Lot 109
of the Eastern Shores subdivision, is located immediately to the
Board of Town Trustees 2 April 9, 1987
west and contiguous to the lot owned by Martin ~nrenreich.

As you may know, I have an application for a variance
pending before the Zoning Board of Appeals and would be grateful
if you would consider my application as soon as possible.
