Variance to the Zoning Ordinance, Article XXIV, Section 100-244 and Article XXIII, Section 100-239.4, for permission to construct extension to screen enclosure for patio and existing wooden deck with insufficient setbacks from the bulkhead and side (or rear) property line on this corner lot fronting along Cedar Beach Road and the west side of Sunset Way, Southold, NY; County Tax Map Parcel ID No. 1000-91-1-5; also referred to as Lots 158 and 159 on the "Map of Cedar Beach Park subdivision." (The dwelling as exists is nonconforming as to the rear yard and side yard setbacks, and the lot area and depth are also nonconforming in this R-40 Zone District.) WHEREAS, a public hearing was held on January 11, 1991; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, the surrounding areas; and and WHEREAS, the Board made the following findings of fact: 1. By this application, appellants seek a Variance for permission to extend and enclose the existing patio with a screened-in enclosure to a size 18' by 17', leaving a set back from the southerly side property line at 29 feet. 2. The premises in question is referred to as Lot Nos. 158 and 159 on the "Map of Cedar Beach Park" and is identified on the Suffolk County Tax Maps as District 1000, Section 91, Block 01, Lot 005, containing approximately 35,000 sq. ft. in area. 3. The subject parcel is improved with a single-family dwelling, which is nonconforming as to the rearyard setback and S~uthold Town Board of Appeals -2- February 1, 1991 Special Meeting (Appl. The subject parcel is improved with ~ single-family dwelling, which is nonconforming as to the rearyard setback and setback to the bulkhead, which bulkhead setback varies between 16 feet to zero feet. Also existing is an accessory garage structure located in the front yard area. 4. It is the position of this board that in considering this application: (a) the setback reduction to 29 feet from the southerly property line is not substantial in relation to the existing nonconformity, and maintains the existing insufficient setback at 16+- feet from the bulkhead to the rear of the house; (b) the relief requested is minimal under the circumstances; (c) the difficulties are uniquely related to the property and are not personal in nature; (d) the variance will not adversely effect the essential character of the neighborhood; (e) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town and neighboring properties; (f) in view of all the above, the interests of justice will be served by granting conditional relief, as noted below. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Dinizio, it was RESOLVED, to GRANT the relief under Appl. No. 3991 as requested in the Matter of the Application of JOHN AND GRACE FIORE, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the remaining decks in the rear shall remain open and unenclosed (as is in its present state); 2. That setback of the subject porch not be reduced to less than the requested 29 feet from the southerly property line and not closer to the bulkhead than the existing patio (where the porch will be constructed over). STRICT APPLICATIONJ~'I'~ ~NANCE would produce practical difficulties or unneces- sary HARDSHIP because, l~tQ ,~wel bJ~f:~o~ my property consists of a corner lot which is subject to both side and rear yard setbacks. The land is approximately 219 feet on Sunset Way by 126.3 feet deep. The house as originally constructed, is only about 15 feet from the existing bulkhead. At the time the house was constructed, there were no regulations requiring the present setback provision. The deck was constructed from the rear of the house to the existing bulkhead without knowledge that a building permit was required. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because .my property is the only corner lot. Ail the other lots do have somewhat similar problems in that they all face "Canoe Inlet" and are constructed close to the water but none of them have rear and 'side yard setback limitations. Because of the proximity of the patio to the water, it is impossible to use the patio at nigh~~ because of the insects and we would like to enclose the patio with screens. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE~,THE CHARACTER OF THE DISTRICT because The original filed map known as "Cedar Beach Park" created small lots basically for summer homes. All the houses are close to the water and my house is in keeping with the other homes. The enclosed patio and existing deck does not change the character of the neighborhood. CHAIRMAN GOEHRINGER: I have a survey done by Roderick Van Tuyl P.C. dated June 4, 1990 indicating a one story frame home, built within 12 feet of the bulkhead. I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Is there somebody here to represent the Fiore application. MR CAMINITI: Since the application was filed I have a more current survey which shows the actual distances if llke. you CHAIRMAN GOEHRINGER: Surely that would be great, I appreciate it. MR CAMINITI: I also have some photographs you can have. This is somewhat similar to the previous applications Mr. Chairman. Although the parcel is a rather good size for the scenic beach area, the house itself was constructed only within .11 feet of the bulkhead. The bulkhead existed prior to 1976 and my clients purchased the property in 1976 from a Judge Vurgio who has been the owner for over 25 years. We have a letter of waiver of jurisdiction from the Town Trustees and there is one pending now from the DEC. What happened here was since the people owned the property since 1976 and we weren't under any regulations at that time as to setback. They constructed a deck that completely surrounds the house. We have a stop work order from the Town Building Department to okay a variance. In conjunction with the application we are asking for permission to screen in the patio which is on the south side of the house. Basically the people just were not aware of the fact that they needed a permit to construct it. He built it himself with his neighbor and as you see it's a pre-existing use, that shows itself on the c/o. Ail houses are built that way in the area and it's not unique and it certainly is a hardship if we could not maintain this. We are asking for a variance on the setback for this. CHAIRMAN GOEHRINGER: He does not want to do any screening on the portion of the deck that is facing the water, only on the cement portion. For the record after viewing it I don't have a particular problem with it. I did have a problem if there was going to be any screening of the existing wood deck. We will discuss it and certainly it is nothing he is going to screen tomorrow anyway, so we will have the decision for you in a sh~rt period of time. MR DINIZIO: Can I just ask a question? On my copy of the survey on the patio it has like a dotted line that comes out by 5 or 10 feet. Is that an addition to that patio? On this one here I noticed it's not. It says like 5 feet. MR CAMINITI: There is an application pending by it. His application was to extend the patio by an additional 5 feet. MR DINIZIO: But that's not the case right? MR CAMINITI: I would not like to press my luck at this point. CHAIRMAN GOEHRINGER: You can let us know. MR CAMINITI: If possible we would like to enlarge the patio by 5 feet. CHAIRMAN GOEHRINGER: Will you give us a setback on that slde and include the 5 feet, with the 5 feet what the distance is to the MR CAMINITI: Do you want a new survey?
