HomeMy WebLinkAboutLP-03/15/2016 APPROVED LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, March 15, 2016 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: John Sepenoski, Chairman Lillian Ball Anne Murray Peggy Dickerson Members Absent: Sam McCullough Eric Keil Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Commencement:  The meeting began at 7:00 p.m. with four LPC members present. Committee Minutes and Administration:  HOLD - Acceptance of LPC meeting minutes from February 16, 2016. No quorum of LPC members eligible to vote.  HOLD - Acceptance of LPC meeting minutes from March 1, 2016. No quorum of LPC members eligible to vote. It was suggested that an e-mail be sent to members in order to get minutes approved. Melanie will send out e-mail.  Land Preservation Committee Term Expirations and Vacancies Terms expiring 3/31/2015 – Anne Murray, Lillian Ball, Peggy Dickerson LPC members Anne Murray and Lillian Ball have expressed their desire to the Town Clerk’s office to be re-appointed to the Land Preservation Committee. Peggy Dickerson has decided not to seek re- appointed. Vacancy due to death of LPC member Maureen Cullinane LPC members were saddened to learn of the death of LPC member Maureen Cullinane on March 7, 2016. Anne Murray volunteered to write a short memorial in Maureen’s honor for her service to the Town and will forward it onto Town Councilman Bob Ghosio for consideration by the Town Board. Land Preservation Applications and Inquiries:  SCTM #1000-96.-5-12.1 (THE ROMAN CATHOLIC CHURCH OF THE SACRED HEART) Respond to request for extension of purchase offer MOTION made by John Sepenoski, seconded by Lillian Ball, to grant a 30-day extension to the LPC purchase offer proposed to The Roman Catholic Church of the Sacred Heart. The offer remains valid until May 2, 2016. Motion carried: 4/0  SCTM #1000-69.-1-8 (ZEBROSKI) Review purchase offer \[executive session\] Melissa presented verbal Bargain Sale proposed purchase offer brought to her by landowner and noted that landowner intends to make offer formal by presenting letter outlining his proposal. EXECUTIVE SESSION. The LPC members entered into MOTION made by Lillian Ball, seconded by Peggy Dickerson, to authorize Land Preservation Coordinator Melissa Spiro to present LPC’s recommendation to the Town Board to pursue the purchase of a development rights easement on farmland owned by William Zebroski (SCTM #1000- 69.-1-8) as a Bargain Sale offer that was presented by landowner, subject to receiving a formal letter from Mr. Zebroski, outlining said offer. Motion carried: 4/0  SCTM #1000-14.-2-29.2, 29.3 & 29.4 and 19.-2-2, 3 & 12.2 (ORIENT POINT LLC a/k/a Papas/Vasilas) PDR Application: Appraisal review and purchase offer determination \[executive session\] HOLD – There were questions concerning appraisal report. Melissa will discuss with appraiser before next LPC meeting. END OF EXECUTIVE SESSION  SCTM #1000-107.-10-8 & 9 (PATRICIA M. KRUPSKI and MILL LANE ONE, LLC) Review new application Confirm appraisal authorization MOTION made by Anne Murray, seconded by Peggy Dickerson, to formally direct Land Preservation Coordinator Melissa Spiro to commission appraisals on the two Krupski properties (SCTM #1000- 107.-10-8 & 9) that due to a timeframe factor, were initiated as directed in e-mail correspondences between Melissa and LPC members prior to this meeting, in which a quorum of LPC members responses authorized and approved ordering an appraisal for each of the two subject properties. Motion carried: 4/0 Land Preservation Coordinator Melissa Spiro discussed Town Engineers’ recommendation to have the Town purchase fee title to an area in the northeast corner of Patricia Krupski’s parcel (SCTM #1000-69.-1-8) for drainage project purposes, if the Town moves forward with any preservation project. Melissa suggested that LPC members do a site inspection for the purpose of determining whether or not scenic restrictions would apply to these parcels.  SCTM #1000-127.-3-8, 9.2, 10.2 & 10.3 & 127.-8-17.2, 17.3 (BRUSHES CREEK aka TriSTATE CAPITAL HOLDINGS / JEFFRY HALLOCK / HALLOCK HOLDING CORP. / CAPITAL ASSET RETIREMENT FUND) Pending Open space acquisition: review pending Town/County partnership status Melissa presented an update of the County’s request for Town to partner on the open space acquisition project. County using both “old” and “new” County Drinking Water Funding. The partnership percentage had been discussed via e-mails with LPC during the past week and with the Town Board during an executive session. LPC re-iterated for the record that LPC in favor of pursuing partnership with County at overall ownership share of the proposed acquisition 79% County / 21% Town, with the Town providing maintenance and stewardship. Melissa noted that there was some concern that County “old” Drinking Water funding would prohibit hunting and deer management on property. Jeff Standish, DPW Director, was planning to attend a County meeting to support deer management on these parcels to protect the eco-system. MOTION made by Lillian Ball, seconded by Anne Murray, supporting recommendation to the Town Board to pursue partnership with the County for the purchase of six (6) parcels in the Brushes Creek Area (SCTM #1000-127.-3-8, 9.2, 10.2 & 10.3 & 127.-8-17.2, 17.3) for open space purposes. Motion carried: 4/0  SCTM #1000-101.-1-4.1, 4.3 & 5.2 (L&R VINEYARD) Review PDR inquiry LPC members reviewed potential purchasers’ PDR inquiry re: proposed sale of development rights and design concept of land currently owned by L&R Vineyard (SCTM #1000-101.-1-4.1, 4.3 & 5.2). Although LPC, in general, supports preservation of this property, there is no support for the current design proposal which excludes all of the CR 48, Oregon Road frontage, and a significant part of the Elijah’s Lane road frontage in a “block” of over 17± acres as described in e-mail. LPC cannot issue a “letter of intent” as requested. Applications & Inquiries for Uses or Structures on Preserved Property None Stewardship and Management: None General Land Preservation Items:  FARMLAND PROTECTION IMPLEMENTATION GRANT PROGRAM, ROUND 14 Request for Proposals Land Preservation Coordinator Melissa Spiro is reviewing Round 14 RFP and looking for preservation projects that may fit criteria for grant submission.  NEW RULES FOLLOW-UP Town Councilman & LPC Liaison Bob Ghosio had met with Supervisor Russell, Land Preservation Coordinator Melissa Spiro and LPC Chairman John Sepenoski to address LPC duties to the Town and Chairman Sepenoski’s “New Rules as of 2/16/2016” document that was distributed at a prior LPC meeting. Hand-out of Town Code Chapter 17, Chapter 70, and Chapter 185 were provided to LPC members for review. Matter will be discussed again at April 12,2016 LPC meeting. Next Regular Meeting:  Tuesday, March 29, 2016. The next regular meeting will be on Adjournment:  The meeting was adjourned at 8:11 p.m. by the four attending LPC members.
