Variance to the Zoning Ordinance, Article XXIII , Section 100-239. 4A and Article XXIV, Section 100-244B for permission to construct addition which will decrease total side yards and reduce yard setback from bluff along the Long Island Sound. Location of Property: 1035 Aquaview Avenue, East Marion, NY; County Tax Map District 1000, Section 21, Block 02, Lot 013 . WHEREAS, a public hearing was held on March 22, 1991, and continued on April 5, 1991 ; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1 . By this application, appellants originally, upon filing the variance application on February 12, 1991, requested permission to square off the two northerly corners of the existing dwelling in addition to renovations/reconstruction shown on the plans prepared by Miller Associates, Project #9037 dated Janu- ary 4, 1991. All construction will be within 100 feet of the Sound bluff . 2 . The premises in question is a described parcel of land having a frontage along the north side of Aquaview Avenue of 60. 0 feet and frontage along the Long Island Sound of 43+- feet. The subject parcel is substandard, having a lot area of approximately 11,330 sq. ft. 3 . The subject parcel is unique, being quite narrow and with limited (upland) building area, which lends to the practical difficulties. 4. Article XXIV, Section 100-244B of the Zoning Code permits relief to lots containing less than 20,000 sq. ft. in the front Page 2 April 10 , 1991 Special Meeting Southold Town Board of Appeals (Appl . No. 4008 - KOSTOULAS decision , continued : ) yard to not less than 35 feet and in the side yards to not less than 10 feet. The minimum rearyard setback is permitted to be reduced under this provision to 35 feet. The code does not specifically permit relief to substandard parcels for bluff setbacks, except as may be permitted by the Board of Appeals. 5 . During the processing of this application, opposition was received from the landowners immediately abutting this parcel on the easterly side. Upon learning of the objections raised by the adjoining landowners, the applicants have alternatively requested permission to construct a 10 to 12 ft. addition along the southerly side of the house, meeting the required setbacks as limited by Section 100-244B of the code. Although the addition along the southerly portion is "landward" of the dwelling structure, this alternative would be within 100 of the bluff, also necessitating relief by this board. 6. It is the position of this board that in considering this application, as amended, for an addition along the southerly portion of the dwelling structure: (a) the proposed location of the southerly addition is landward, being 46+- from the bluff at its closest point, of the existing dwelling structure, setback reduction to 24 feet from the westerly {front) property line is substantial in relation to the requirements, however, there is no alternative available for appellants to pursue except by variance; (b) the alternative relief, as requested, is not substantial in relation to the existing structures; (c) the difficulties imposed are uniquely related to the property and are not personal in nature; (d) the variance will not adversely effect the essential character of the neighborhood, or be adverse to the safety, health, welfare, comfort, convenience or order of the town and neighboring properties; (e) there is no other alternative method feasible for appellants to pursue; ( f) in view of all the above, the interests of justice will be served by granting conditional alternative relief, as requested and further noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to GRANT alternative relief for the construction of a 10 to 12 ft. addition along the southerly (front) of the principal dwelling structure, which will be not less than 46 feet Page 3 April 10, 1991 Special Meeting Southold Town Board of Appeals (Appl. No. 4008 - KOSTOULAS decision, continued) : to the bluff setback at its closest point (although landward of the dwelling) , as requested in the Matter of the Application of TONY AND MARI A KOSTOULAS under Appl. No. 4008, SUBJECT TO THE FOLLOWING CONDITIONS: 1 . That the front yard addition comply with the front yard setback provisions of the Code for this substandard parcel (as per 100-244B) or the provision in effect at the time of the issuance of a building permit; 2. The proposed reconstruction/renovation at the northerly end for the existing house including the porch (or deck) within the existing footprint, shall be permitted provided the porch or deck construction not protrude more than four feet from the dwelling; this reconstruction/renovation shall not include the squaring off of both corners at the northerly portion of the house. 3 . The renovations of the existing dwelling shall not extend beyond the existing footprint and shall not involve excavation or other land alteration activities. Vote of the Board: Ayes: Messrs. At that time the top of the bluff was approximately .16-18 and 24 feet northward of the proposed additions on the Northeast and Northwest corners of the residence, respect- ively. The bluff face in this area is very steep; however, appears stabile and is vegetated predominately with woody vegetation. There was no significant toe erosion at the base of the bluff. Construction of the new concrete foundations and piers will involve excavation in close proximity to the top of the bluff. The new construction will also add signi- ficant weight at the top of the bluff. Wheather this activity will jeopardize the stability of the bluff can not be accurately determined by this office. However, such activity would increase the potential for bluff erosion especially along the upper portion of the bluff. Storm water runoff from the roof of the dwelling and the yard area should be diverted from flowing over the top of the bluff and onto the bluff face. CHAIRMAN GOEHRINGER: I have a copy of a survey dated November 15, 1990, updated December 19, 1991 indicating an existing, partially ground level deck, thereby enclosing most of the rear yard area, landward, lip of the bluff, a wood deck, which is a landing, and then steps leading down to Long Island Sound. The nature of this application is the existing partially ground level deck and, I believe the elevated wood deck. And I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Is there any representa- tives for the Kostoulas's. MRS. MARIA KOSTOULAS: We are here and I also have pictures for you. CHAIRMAN GOEHRINGER: I forgot where your house was, I went to the wrong house. MRS. KOSTOULAS: Quite honestly, we were not aware we needed a variance for this. It is at ground level, we simply connected the two existing decks. It is probably about a total of two hundred and fifty (250) square feet. It is exists right now, as you can see from the pictures. We have two (2) very young children. We have a three (3) year old and a one (1) year old, so the main purpose of this was to keep them in the back yard. It is 40 mph zone in front of our house and it is very dangerous with the kids running out. I also have another picture to show you. Last year, we were here for a variance, there is a cement slab in the back of the house that we were not allowed to remove because it is on the back of the Sound. So it posed a danger for the children as well, so that was another reason that we chose to cover it with the wood planks. CHAIRMAN GOEHRINGER: Yes, I think that at the time you came before us, you were expecting with that second child. MRS. KOSTOULAS: You are right, a .year-old now. CHAIRMAN GOEHRINGER: There has been some discussion before the Town Trustees concerning this deck and its position in the new Coastal Zone Management Law. What has been going on with the Trustees over this deck, anything to your knowledge? MRS. KOSTOULAS: Nothing. Page 11 \ Public Hearing Southold ZBA 5/7/92 CHAIRMAN GOEHRINGER: Nothing. MRS. KOSTOULAS: I did speak myself to Mr. Bredmeyer and he said it was, no decision has been made. CHAIRMAN GOEHRINGER: It is undecided. MRS. KOSTOULAS: At the time I spoke to him and that was, I would say a month ago, so nobody has told me anything otherwise. The only change was, that it was about ninety-five percent (95%) completed, with the exception of the cement slab and the Building Inspector told us to just finish it and make it safe because it was a libility at that point. The children could just fall on it. CHAIRMAN GOEHRINGER: You have gotten a C.O. for the house? MRS. KOSTOULAS: Correct. CHAIRMAN GOEHRINGER: You just don't have the C.O. for this deck and that is basically. . . . MRS. KOSTOULAS: Right, but when I got the original C.O. it included the deck that went down to the water and that was part of the original C.O. The only thing we don't have is that middle piece between the existing deck and the house. CHAIRMAN GOEHRINGER: Okay, let us see what develops. Thank you. MEMBER VILLA: Well, the only thing that you can say about this, is that you would, if you were looking at it before it was done, it could be a disturbance to the bluff or to the land area. It is accomplished, it is done, so if you are going to dismantle it, you create another situation where you might be disturbing the bluff. It is almost better leaving it be. MRS. KOSTOULAS: If I could say something with my husband, we have done everything in our power, to obviously make it as safe for us as possible. We intend on living there for a long time. We planted two hundred (200) rose bushes to preserve the bluff. We've done, literally, everything we possibly could. We didn't make it an elevated deck for that reason, we just put it right on the ground. We tried to do as little as possible, just to cover it. CHAIRMAN GOEHRINGER: I want to be honest with you. I was completely floored when I went there. I didn't realize that. There is no doubt in my mind, I'm sure that you probably didn't realize that you couldn't do what you did also. Two (2) houses to the east I was. I really don't know how to answer this thing, except that we really should address the issue again with Mr. Bredmeyer and see if there is any change and that is what we will do. Because of the fact that the house is very small and because the Kostoulas would like to have a four bedroom home, strictly a vacation home, and it would not, in fact, would be a real asset to the community, in a sense that it certainly will be a very beautiful home. CHAIRMAN GOEHRINGER: This is a copy of a letter that we received. We had a call from the next door neighbor and they indicate that in doing a measurement, that it' s much less than 18 feet, its closest point. We do have here a rather symmetrical bluff line. It is not one that' s totally irregular or anything, which is pretty good. Was that measurement taken from the corner, the proposed corner of the house, that 18 feet? I know it' s penned in here, it' s not done by a surveyor. MR RANDAZZO: The measurements were taken from the existing corner, which is already 9. 2. CHAIRMAN GOEHRINGER: It was taken from that corner. MR RANDAZZO: Again, I have no defining line as to where the bluff starts or ends. That' s a physical thing to do. CHAIRMAN GOEHRINGER: It' s a guesstimate? MR RANDAZZO: Yes. The only reason I say that it doesn't do any damage to anyone because the existing rear yard line is already exposed. I see no harm in squaring off the home at this point and again I reinstate that it just doesn' t make any sense not to square this off. It' s doing no harm to anyone, the way I see it. Except for the side yard of course. CHAIRMAN GOEHRINGER: Would you do me a favor would you state both, actually we are really not concerned with the west side. We are really concerned with the east side. Would you stake that addition all the way out? In other words just give me a point that I can measure from and I ' ll do a variance myself on reference to distance from. If you wouldn' t mind. MR RANDAZZO: No problem. Is there anything you would like to say for the record? MR ALEXANDER: Yes, sir. My name is Eric Alexander. The kitchen itself is at this point 30 years old and in desperate need of modernization. My family is growing, I have four children and my widowed mother-in-law lives with us half the time, so while we are intending to modernize the kitchen, it is an opportune time for us to also expand it so that it' s easier to eat in the kitchen itself . That' s the reason for the request for the variance. The hardship would be involved in perhaps relocating the kitchen which is financially not really feasible. The properties in this particular area, along the Boulevard are quite long and narrow and the house itself is built to situate on that particular piece of property, so it is in fact, the house is long and narrow. The area in question on the Boulevard is mostly a summer area and there are quite a few residences in the area that have five feet or less side yard variances. In fact, of the seven properties that adjoin my piece of property, there are seven structures on those properties that are five foot or less to the existing property line. I have pictures of those particular structures. CHAIRMAN GOEHRINGER: Great. Could we see them? MR ALEXANDER: Sure. Just to finish. The westerly boundary which is where the intended addition would be, there is a new, a brand new structure being built there, on that piece of property at this point. That structure, in fact has a five foot side line variance. CHAIRMAN GOEHRINGER: This is the McGowan one. We had an application on that. This is McGowan also. Where is this one? So that' s the other alternative that they are suggesting. And I believe that they can sit with that. CHAIRMAN GOEHRINGER: So therefore you are requesting 40 feet? MR RANDAZZO: Exactly. The benefit will be of course that the bluff distance now will be increased by about 9 feet. CHAIRMAN GOEHRINGER: I see. The only thing that concerns me is, okay I see the 50 feet, you have 46 penned in and that' s the reason why I didn' t understand. Because normally 46 . minus 10 is 36 . MR RANDAZZO: No. In fact with the 10 would extend it to the front with still a remaining 40 foot. CHAIRMAN GOEHRINGER: So if this Board was so inclined to grant you a 40 foot setback, front yard setback, you can construct this dwelling in its present planned entirety as I have it here in that area. (UNIDENTIFIED) : I can' t hear you. CHAIRMAN GOEHRINGER: What Mr. Randazzo is asking for instead of moving toward the bluff, is to slide the house 10 feet closer to the road. MR BAUER: 10 feet? CHAIRMAN GOEHRINGER: Closer to the road. There are two stakes presently in the front of the house now. MR BAUER: He has stakes there. They are more than 10 feet. Much more like 12 or 14 feet that he has out toward the road. CHAIRMAN GOEHRINGER: Did you measure those. Excuse me just one second, Did you, Mr. Randazzo, measure those stakes, are they exactly 10 feet? MR RANDAZZO: Yeah. They are exactly 12 feet right now. MR BAUER: I would like a detailed drawing showing how far he will go to the water, to the bluff and what type of supports he will give that balcony without disturbing that ground at all. CHAIRMAN GOEHRINGER: Well he just said that the balcony is not going to. MR BAUER: Well that' s what he said, excuse me, but when. CHAIRMAN GOEHRINGER: Well we' ll put the restriction in the decision, I don' t have a problem with that. You tell me what you have a problem with. Let' s work it out here and get it taken care of. MR BAUER: Okay. I mean of his stories he says four feet and on another he shows eight feet. What does he have on his front? CHAIRMAN GOEHRINGER: In reference to distance to the top of the rim of the bluff . Okay. When I measured it when it was squared off, I was over the other night, I got 12.9 feet on the east side, if you went to the posts that were placed to square off the house. And I had 20 feet on the west side. Now we have to know what the distance is of the existing rear porch. Do we have any idea what the depth of that is? Is it 8 feet, is it 9 feet? MR RANDAZZO: The rear porch at this point? CHAIRMAN GOEHRINGER: Yeah. Right. MR RANDAZZO: The existing porch? CHAIRMAN GOEHRINGER: The existing porch. Okay, you would be 12. 9, that was an average by the way, it' s really about 13 , so you would be 13 plus 7, you would be about 20 feet. MR BAUER: As it is where he had it staked out to the east property line, he had only between 8 and 9 feet to the bluff . CHAIRMAN GOEHRINGER: Right. MR BAUER: Now you consider the bluff where it starts to taper and that' s all we had at that particular time. CHAIRMAN GOEHRINGER: But you don' t have an objection if he cuts that back porch off, does not penetrate the rear of the property in any way for this small deck that he intends to put off the second story? MR BAUER: No. As long as he doesn' t disturb any ground for footings. So when they get in there with a digger, that whole ground is going to shake. CHAIRMAN GOEHRINGER: I understand. I thank you. MR BAUER: Could I ask one more thing? CHAIRMAN GOEHRINGER: Sure. MR BAUER: What do you consider the square footage for the amount of ground that can be covered? SAWICKI cc Appeal No. 3753 : At a Meeting of the Zoning Board of Appeals held on August 18 , 1988 , the above appeal was considered, and the Action indicated below was taken on your Request for a Variance to the Zoning Ordinance, Article XI, Section 100-119. 2A: Upon application of VINCENT GEROSA for a Variance to the Zoning Ordinance, Article XI, Section 100-119. 2A for permission to construct additions to existing dwelling with an insufficient setback from top of bank or bluff along the Long Island Sound. Location of Property: 315 Aquaview Avenue, East Marion, NY; County Tax Map Parcel No. 1000-21-2-3 . WHEREAS, a public hearing was held and concluded on August 18, 1988 in the Matter of the Application of VINCENT GEROSA under Appeal No. 3753 ; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The property in question is identified on the Suffolk County Tax Maps as District 1000 , Section 21, Block 2, Lot 3 , and is a described parcel of land containing a total area of approximately 30, 625 sq. ft. with frontage of 125 feet along the north side of Aquaview Avenue, depth of 245 . 0 feet, and frontage along the Long Island Sound mean highwater mark of 125.22 feet. 2. The subject premises is improved with a single-family, one-story framed house as more particularly shown on the survey map prepared by Roderick VanTuyl, P.C. , amended June 3 , 1988. Page 2 - Appl. No. 3753 Matter of VINCENT GEROSA Decision Rendered September 16 , 1988 3. By this application, appellants propose to construct deck addition and structures, all as shown by the rendition submitted and prepared by John Amisano, Architect, extending from the rear of the existing dwelling structure leaving an insufficient setback at its closest point to the top of the bank (or bluff) at not less than 45 feet. 4. Article XI, Section 100-119. 2, subparagraph A(1) requires all buildings and structures proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100) feet from the top of the bluff, or bank. 5. The existing dwelling is shown to be set back also at approximately 45 feet, and there is no increase of the nonconformity. 6. In considering this appeal, the Board finds and determines: (a) the activities required for the placement of this construction are to be built without disturbance to the vegetation of the bluff or be adverse to the character of the immediate area; (b) the percentage of relief in relation to the requirement is substantial; however, there is no other alternative for appellants to pursue other than a variance; (c) the practical difficulties are related to the land with the established nonconformities, and are not personal in nature; (d) the grant of this variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town; (e) in considering all the above factors, the interests of justice will be served by granting the application, as conditionally noted below. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Sawicki, it was RESOLVED, to GRANT a Variance from Article XI, Section 100-119.2A of the Zoning Code for additions as applied in the Matter of VINCENT GEROSA, more particularly shown on Plan No. 8759, Drawing No. 101, prepared by John Amisano, Architect, and SUBJECT TO THE FOLLOWING CONDITION: There be no disturbance within 40 feet of the bank (or bluff) area.
