Variance to the Zoning Ordinance, Article III, Section 100-33 (100-30A.4) for permission to locate accessory tennis court and croquet court in an area other than the required rear yard. Location of Property: Private Road, Fishers Island, NY; County Tax Map District 1000, Section ~3, Block 3, Lot 005; also referred to as Lot 6 and 5C, Block 18, Map of Chocomount 2. WHEREAS, a public hearing was held on February 22, 1991; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located in the R-120 Zone District at Fishers Island, with frontage along two sides by a private road and frontage along the northwesterly section by Fishers Island Sound. 2. The subject premises consists of an area of approxi- mately 6.58 areas and is improved with a residence and 31' x 21' garage, accessory swimming pool, two accessory sheds (one of which is to be removed). 3. Proposed by this application is the location of a 60' by 120' tennis court enclosed with a wire fence at a height of 10 feet which is requested at eight (to ten) feet from the northerly property line and at a distance of more than 75 feet Page 2 - Appl. Also proposed by this application is the location of a croquet court which will consist of an enclosed putting green surface surrounded by two curbings, neither of which will exceed 12 inches in height (and may contain planters for screening and landscaping). Both courts are more particularly shown on the topographical map prepared by Chandler, Palmer & King dated January 3, 1990 and amended lastly July 3, 1990 (#53285). 4. Article III-A, Section 100-30A.4, and Article III, Section 100-33, provide that accessory buildings be placed only in the required rear yard. The subject parcel is considered by the zoning definitions (100-13) a corner lot, having two or more front yard areas. 5. It is the position of this Board in considering this application that: (a) the circumstances are uniquely related to the land and are not personal in nature; (b) the relief is not substantial and is the minimal necessary under the circumstances; (c) the relief as granted will not alter the essential character of the neighborhood; (d) the relief requested in not unreasonable; (e) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town, or be adverse to neighboring properties. Accordingly, on motion by Mr. Doyen, seconded by Mr. Goehringer, it was RESOLVED, to GRANT permission in the Matter of the Application of DAVID J. STRUPP under Appeal No. 4003 for the placement of two accessory court structures in the front yard area as noted in paragraph 3, supra, and subject to the following restrictions: 1. That the accessory tennis court be set back not closer than ten (10) feet to the northerly property line (instead of eight); 2. ( ) (x) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance isrequested forthe reasonthatthe residence in question faces away from Fishers Island and the front yard is in effect the rear yard. The proposed location is not visable from any abutting owner's residence or from the private road on which our property is located. If the proposed improvements were located in the rear yard they would be unuseable due to the exposure to the weather and would be visable to the abutting owners' residences as well as to the boaters on Fishers Island Sound. The location proposed is the.only practical location. The front ~rm ZB1 (Continueon other si~) yard is the current location of two sheds, a large parking area and driveway (asphalt), vegetable and flower garden and swimming pool. Adjacent property owner has tennis court in front yard. Property owned by Dennis O'Brien. REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce procticaldifficultiesorunneces- sa~ HARDSHIP becau~ tennis court and croquet would be unuseable due to exposure to the weather. This is reason why variance was granted to D%nnis O'Brien for construction of 'tennis court in front yard of new residence. 3. The Variance would obse~e the ~irit of the O~inance and WOULD NOT CHANGE THE CHARACTER OF THE DIS-rRICI' because the improvements are in the area of our land which is used as the rear yard. The location is not visable from abutting owners' residences. Request for variance to the Zoning Ordinance, Article XXVIII, Section 100-281A(7) for permission to construct new principal dwelling structure upon premises which is nonconforming and has not been held in single and separate ownership as exists since April 9, 1957. Lot is nonconforming, having a total lot area of 22,668 sq. ft. and 25 ft. frontage (width) along Middle Road in the Hamlet of Greenport, Town of Southold, NY; County Tax Map Designation 1000-41-2-12.1. WHEREAS, a public hearing was held on June 7, 1991, and all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony' and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, the surrounding areas; and and WHEREAS, the Board made the following Findings of Fact: 1. By this application, applicant seeks a variance for approval or recognition of the subject lot, having a total nonconforming lot area of 22,668 sq. ft. and nonconforming road frontage of 25 feet along Middle Road, Greenport, Town of Southold in this R-40 Zone District. 2. The premises in question is identified on the Suffolk County Tax Maps as No. 1000-41-2-12.1, located near "Fleetfield," a 1942 (preexisting) subdivision filed by Clarence C. Fleet and Henry L. Fleet. 3. The record shows the following conveyances of land within this block (located along the easterly side of Middleton Extension and the southerly side of Washington Avenue) immediately surrounding and including this parcel as follows: Page 2 - Appl. STAPLES Decision Rendered July 12, 1991 (a) Parcel 1000-41-2-6: This corner lot consists of an area of 7765+- sq. ft. and was conveyed on April 22, 1966 to McGinners, having been previously conveyed on July 12, 1963 to McGinners' predecessor in title~ The owners of record since May 31, 1967 are John M. Krukowski and wife, and the premises has a dwelling which preexists zoning. It is noted that the lot has been in single and separate ownership since at least 1963. (b) Parcel 1000-41-2-7: This parcel consists of an area of approximately 13,000 sq. ft. and was conveyed to Waterhouse on November 9, 1965. It is noted that this lot conformed to the 1965 lot area requirements of the zoning code (minimum 12,500 sq. ft.) and has been single and separate since this time. A new dwelling was constructed in late 1968 (building permit 94021Z) for this particular lot. (c) Parcel 1000-41-2-8: This parcel consists of an area of approximately 13,000 sq. ft. and was conveyed on June 20, 1966 to Staples, who later conveyed the premises on March 22, 1984 to Burden. It is noted that this lot conformed to the 1965 lot area requirements of the zoning code (minimum 12,500 sq. ft.) and has been single and separate since 1966. A new dwelling was constructed in 1966 (building permit ~3194Z). (d) Parcel 1000-41-2-10: This parcel consists of an area of 12,550+- sq. ft. and was conveyed to Reeves from Joseph Diaz on January 27, 1964. This lot conformed to the 1964 lot area requirements of the zoning code (minimum 12,500 sq. ft.) and has been single and separate since 1964. A new dwelling was constructed in 1964 (building permit #2479Z). (e) Parcel 1000-41-2-11: This parcel consists of an area of approximately 12,900 sq. ft. and was conveyed to Staples on December 22, 1969, and who acquired the parcel on August 29, 1963 from Joseph Diaz. It is noted that this lot conformed to the 1969 lot area requirements of the zoning code (minimum 12,500 sq. ft.) and has been single and separate since 1969. A new dwelling was constructed in 1985 (building permit #13856Z). (f) Parcel 1000-41-2-13.2: This parcel consists of an area of 73,660+- sq. ft. and was conveyed to Field from Joseph Diaz on March 10, 1972. This lot conformed to the 1972 lot area requirements of the code (min. 40,000 sq. ft.). A new dwelling was constructed in 1972. (g) The parcel herein was created in 1969 when set-off by Joseph Diaz when the northerly parcel (1000-41-2-11) was conveyed. The applicant on February 19, 1981 acquired the parcel, which conformed to the 1969 lot size requirements of the zoing code (minimum 12,500 sq. ft.). The building envelope area shows the located of a proposed dwelling to be built in accordance with the minimum setback regulations for this zone district. Accordingly, on motion by Mr. Dinizio, seconded by Mr. Villa, it was RESOLVED, that the parcel which is currently identified on the Suffolk County Tax Maps as No. 1000-41-2-12.1, now of HALSEY A. STAPLES, be and hereby is RECOGNIZED for single-family dwelling use, subject to all setback, bulk schedule and other zoning requirements applicable under the zoning code, and subject County Health Department and any other agency approvals which may be required at the time of submission of an application for a building permit (with the exception of lot size), that the application be APPROVED, as applied. Goehringer, Chairman Dear Sirs: In response to your letter of January 28, 1991, I telephoned Linda Kowalski and determined that you are in possession of an adequate number of surveys and that what is needed is more information about the fencing around the tennis court and the curbing that will be installed around the croquet court. Let me start by explaining the tennis court. The tennis court will be exactly 60 feet by 120 feet. The tennis court will be enclosed with a wire fence which on the east and west end and the east side will be 10 feet high. On the west side, the fence will be 10 feet high near each of the ends but in the center will be 4 feet in height. I h~ve asked the people that will be constructing the tennis court to provide you with more details regarding the tennis court and its construction. I mentioned this morning to Linda that if desired by the Board, I certainly would be willing to move the tennis court in a southerly direction by approximately 10 feet. As I explained, the tennis court cannot be reoriented and must have its linear axis in a north-south direction. If the court is constructed in any other manner, it is basically unplayable except during mid-day because of the rising and setting sun. Board of Appeals -2- February 4, 1991 Now turning to the croquet court. The croquet court will be extremely simple and basically is no more than a rectangular grassy area (very much like a putting green surface) which will be surrounded by 2 curbings neither of which will exceed 12 inches in height. It is possible that the corners of the area could have stone planters but these would be no different than exist in many yards. I was not planning to attend the meeting at which time this matter would be taken before the Board, but if you feel that my absence could in any way jeopardize favorable action, please let me know as it would be possible, albeit inconvenient, for me to attend. Goehringer, Chairman Dear Sirs: In response to your letter of January 28, 1991, I telephoned Linda Kowalski and determined that you are in possession of an adequate number of surveys and that what is needed is more information about the fencing around the tennis court and the curbing that will be installed around the croquet court. Let me start by explaining the tennis court. The tennis court will be exactly 60 feet by 120 feet. The tennis court will be enclosed with a wire fence which on the east and west end and the east sid~ will be 10 feet high. On the west side, the fence will be 10 feet high near each of the ends but in the center will be 4 feet in height. I have asked the people that will be constructing the tennis court to provide you with more details regarding the tennis court and its construction. I mentioned this morning to Linda that if desired by the Board, I certainly would be willing to move the tennis court in a southerly direction by approximately 10 feet. As I explained, the tennis court cannot be reoriented and must have its linear axis in a north-south direction. If the court is constructed in any other manner, it is basically unplayable except during mid-day because of the rising and setting sun. The croquet court will be extremely simple and basically is no more than a rectangular grassy area (very much like a putting green surface) which will be surrounded by 2 curbings neither of which will exceed 12 inches in height. It is possible that the corners of the area could have stone planters but these would be no different than exist in many yards. I was not planning to attend the meeting at which time this matter would be taken before the Board, but if you feel that my absence could in any way jeopardize favorable action, please let me know as it would be possible, albeit inconvenient, for me to attend. The proposed covered wood deck (gazebo-type) structure is shown to be 45+ feet at its closest point to the property line at the southwest corner, and the tennis court with fencing is shown to be not closer than 28 feet at its closest point to the property line at the southwest and the southeast corners. 5. Article III, Section 100-32 of the Zoning Code provides accessory buildings to be located only in the required rear yard. Most of the area normally feasible to construct is technically front yard, and there is no other alternative for appellant to pursue other than a variance. 6. Article XI, Section 100-119.1 of the Zoning Code provides a limitation of four feet for fences in the frontyard area. It is not practical to construct a tennis court with · fencing at four feet high or less, and the request of the appellant is not unreasonable under the circumstances.
