Variance to the Zoning Ordinance, Article XXIV, Section 100-244B for approval of deck/patio construction with a reduced front yard setback. (The lot is nonconforming as to area and width in this R-40 Zone District.) Location of Property: 4945 Main Bayview Road and the easterly side of Smith Drive North, Southold, also referred to as Lots 83 & 84 on the Subdivision Map of "Goose Neck"; County Tax Map District 1000, Section 76, Block 2, Lot 20. WHEREAS, a public hearing was held on January 11, 1991 in the Matter of the Application of ROBERT AND NORMA SIEBER under Appeal No. 3989; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is a corner parcel lot fronting 150.0 feet along the westerly side of Smith Drive North and 100.0 feet along the north side of Main Bayview Road in the Hamlet and Town of Southold and is referred to as Lot Nos. 83 & 84 on the Map of Goose Neck. The subject premises is nonconforming as to lot area in this R-40 Zone District containing a total lot area of 15,000 square feet and is improved with a single-family dwelling set back 34.9 feet from Smiths Drive North and 35.4 feet from Main Bayview Road (exclusive of step areas). 3. By this application, appellant requests a variance for the construction of: (a) a raised patio/deck entry of a size 10 ft. by 12 ft., and (b) a raised side patio/deck of a size 14 ft. by 24 feet, both as shown on Page 2 of the sketched maps submitted with the application. The raised patio entry reduces the front-yard setback to 25 feet from Main Bayview Road (at its closest point), and the patio/deck along the north (side) of the dwelling maintains the same front-yard setback at 34.9 feet. 4. For the record, it is also noted: (a) that Article XXIV, Section 100-244B provides relief to nonconforming lots having a lot area of less than 20,000 square feet in the front yard to not less than 35 feet, (b) that a Certificate of Nonconforming Premises was issued (no date furnished) to William E. and Elsie Young for this dwelling and land. 5. In considering this application, the Board also finds that the relief requested: (a) will not be adverse to the essential character of the neighborhood; (b) will not in turn be adverse to the health, welfare, comfort, convenience or order of be adverse to neighboring properties; safety, the town, or (c) will not increase dwelling unit density or cause a substantial effect on available governmental facilities; (d) is the minimum necessary to afford relief; (e) cannot be obviated by another method feasible to appellant to pursue, other than a variance; (f) in considering all of the above factors, the interests of justice will be served by granting the variance, conditionally noted below. as Accordingly, on motion by Mr. Goehringer, seconded by Page 3 - Appl. On information and belief, the said terrace was constructed prior to 1957, therefore, pre-existing and non-conforming. Prior to 1957, the only set-back restrictions on this property and the neighboring properties shown on "Map of Goose Neck" (filed 11/22/48, as Map #1663 were as'set forth in recorded Covenants & Restrictions dated 1/28/55, ~- .filed ~/t4~§5, to wit: "No building or structure, whether the same be the main dwelling house or any garage, ~shed or any outbuilding shall be built closer than five (5) feet from any boundary line and not closer than fifteen (15) feet from the highway." 3. The Variance would observe the spirit of the O~inonce and WOULD NOT CHANGE THE CHARACTER OF THE D1STRICT b~ouse The'Town code (Art. XXIV, Section 100-242) provides for the remodeling, reconstruction or enlargement of a nonconforming building containing a conforming use. It specifies, "provided such action does not create any new nonconformance or increase the degree of nonconformance". By removing the existing terrace (approx. 367.5 s.f. in variance to code) and replacing it with a smaller patio (apprbx. 81 s.f. in variance to code), applicant decreased the previous degree of nonconformance by over 80%. Also, the previous terrace had non-conforming set-backs on two streets. The removal of this terrace has completely eliminated the non-conforming set-back off Smiths Drive North, which extended a length of 49 ft., and reduced, the length of the non-conforming set-back off Bay view Road from 20 ft. to 12 feet, while only increasing the set-back from Bay Vie~R~-~by an ~additional 2 ft. CHAIRMAN GOEHRINGER: I have a sketch and copy of the survey. The survey was produced by August P. Knapp dated 5/16/83 mentioning the house which is somewhat centered in the center of the property. The nature of this application is a patio which faces Bayview Avenue and which I assume protrudes into front yard area and I have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. BRUER: This is a piece of property and a deck that was actually the prior deck was created prior to zoning and there is a 1983 pre-existing certificate of occupancy for the house and I believe it did include the deck since the deck was there when they gave this pre c/o. It fronts on two streets as I think you observed and what the applicant did was he made a mistake and took down the old deck which was existing and was proper at the time. He created, actually what he did was he eliminated 80% of the non- conforming ~se and Just left a reconstruction. He reconstructed the deck a little bit in the front leaving less then what was there before. He moved the decking that was on the Smith Drive North and put out a patio in the rear which is acceptable under the ordinance. This is a small lot that was created well before the present zoning requirements of lots these days and the house was built back at that time. This is the old Smithfield Park area. Considering the fact that what was done by the applicant was to reduce the non- conforming use by over 80% we would ~espectfully request that the Board grant the application as asked for. I think the papers pretty well spell it out. The deck on the front that is there doesn't go out really any further then what was there originally. The area as I said has been reduced and we would ask that you would please grant it. It would be a hardship, it is unique and its really not changing the character of the neighborhood. CHAIRMAN GOEHRINGER: The gentlemen is selling this house? Is that the reason you need the c/o? MR BRUER: Yes, actually he sold it, with the condition that we get the c/o. The bulkhead existed prior to 1976 and my clients purchased the property in 1976 from a Judge Vurglo who has been the owner for over 25 years. We have a letter of waiver of jurisdiction from the Town Trustees and there is one pending now from the DEC. What happened here was since the people owned the property since 1976 and we weren't under any regulations at that time as to setback. They constructed a deck that completely surrounds the house.
