Variance to the Zoning Ordinance, Article XXIV, Sections 100-242A and 100-244B for permission to construct addition to existing nonconforming dwelling structure, increasing the lot coverage and reducing the rear yard setback. Location of Property: 215 Hummel Avenue, Southold; County Tax Map No. 1000-63-2-14. WHEREAS, a public hearing was held and concluded on April 30, 1991; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning and the surrounding areas; and WHEREAS, the Board made the following Findings of Fact: 1. By this application, appellants are proposing a 16' deep by 20' wide residential addition with a reduced rear yard setback at 33.5+- feet and requested lot coverage at 31.2%. The setbacks from the side property lines are proposed at 15 feet from the westerly side and at 13.6+- feet from the easterly side (at its closest points). The proposed addition is more particularly shown on the survey prepared by Anthony W. Lewandowski dated September 5, 1990. 2. The premises in question contains a total lot area of 5,381 sq. ft. with 50.09 ft. frontage along the north side of Hummel Avenue, Hamlet and Town of Southold, and is identified on the Suffolk County Tax Maps as District 1000, Section 63, Block 2, Lot 14. The subject parcel is improved with a single-f~unily, one-story frame house, which is presently set back at approximately 50 feet from the rear property line and 17.0 feet from the front property line. 4. Article XXIV, Section 100-242A of the Zoning Code restricts enlargement of a nonconforming structure where the degree of nonconformance is increased. The su~bject structure is presently nonconforming as to excessive lot coverage, which under Section 100-244B is limited to 20 percent. The degree of nonconfoITaance of the lot coverage is proposed to be increased from the existing 25.5 percent to 31.2 percent. 5. Article XXIV, Section 100-244B of the Zoning Code provides relief to nonconforming lots held in single and separate ownership to a limitation of 25 feet for both side yards (10 ft. and 15. minim%um each side yard) and 35 ft. minim~u~ rear yard. The lot is nonconforming as to lot area and width, and the side yards will conform to the limitations of this provision and the rear yard is proposed to be reduced by approximately 12 to 18 inches less than the requirement. 6. It is the position of this Board in considering this application that: (a) the circ~unstances are unique to the property and are not personal in nature; (b) although the relief requested is substantial, the relief, as alternatively granted, will not alter the essential character of the i~ediate neigb_borhood; (c) there is no other method feasible for appellant to pursue other than a variance; Southold Town Board of (d) the variance, if granted, will not in turn be adverse to the safety, health, welfare, comfort, convenience, order of the town, or be adverse to neighboring properties; or (e) the interests of justice will be served by granting alternative relief, as noted below. Accordingly, on motion by Mr. Villa, seconded by Mr. Grigonis, it was RESOLVED, to DEN~ the relief requested for a 16' x 20' addition, and to GP~T alternative relief for a 14'deep x 20' wide addition at the rear of the existing dwelling. ( ) (~) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that for about eighteen years, applicants have lived full time in a small house on tho smallest lot in the neighborhood. Applicants wish to build a one-room addition which can bo used as a sitting room/sun room/dining room. That addition will be constructed adjacent to their kitchen and in the approximate location of an existing cement patio. Although the honso theoretically could be expanded by adding a second story rather than the proposed addition, that alternative is not viable in light of applicants' ages. t~onn zB1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the subject 5.381± square foot lot is located in an R-40 zone in Southold. The b~,,,~ promises is improved by a one-story, two-bedroom frame residance of 999± square feet and a one-story frame detached garage of 373 ± square feet. Abutting the exterior of the north wall of the house is a 10x20 foot cement patio with a metal frame awning. Section 100-244B of the Zoning Code permits lot coverage of not more than 20% or 1,0'7'/± square feet and, because of the lot's small area, the lot coverage of tho present house alone is 18.6%. Other than to add a second story, applicants, who are in their late '/Os, are unable to expand their small living quarters without coming into conflict with the Code. Applicants reside full-time in the house and seek to construct a one-room addition on the rear of their home. That room will be used as a sun room/dining room/sitting room. The exterior dimensions of the planned addition are 16x20 feet and will provide the applicants with additional living space of 304± square foot. The new room will be located in the approximate site of the existing cement patio. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because applicants' lot is the smallest lot in Section 63 Block 2 of the Town of Southold. (See attached tax map.) The neighbors to the ~est, Peter .1. Orattsn, .Ir. & wf, own a 5,445+ square foot lot which is improved by a 1,0464- square foot house, to which a second-floor dormer was added in 197,7, and a 12x28 foot above-ground pool which was built in 1985 and a 5x20 foot deck. The pool area, which is adjacent to applicants' rear yard, is surrounded by a 6 foot high stockade fence. Total lot coverage of the house, pool and deck is 1,482+ square feet or 27.2%. Applicants' neighbors to the east, William Zukas & wf, own a 21,780+ flag shaped lot which is improved by a house, deck and garage comprising 1,460± square feet. The Zukas property also has a 12x24 foot above-ground pool which was added in 1986. Total lot coverage oftha house, garage, pool and deck is 1,7484- square feet. To the north lies a 0.628 acre lot owned by Edward J. Walicki, Jr. & wf which is improved by a two-story, two-family dwelling and a garage. Those structures cover approximately 2,062+ square feet. (See attached copies of Town of Southold Property Record Cards and coverage calculations.) 3. The Variance would observe the spirit of the Ordinance and WOULD'NOT CHANGE THE CHARACTER OF THE DISTRICT because applicents seek merely to construct an additional room on their home. That addition will not change the residential character of the northerly side of Hummel Avenue. Across the street from the applicants' home is Southold Lumber which runs approximately one-half the length of the block. The Agway store is located on the westsfly side of the nearby intersection of Hummel Avenue and Youngs Avenue. The problem that the Krepps have with their property is two-fold. One is by leaving the marsh land the way it was and bringing his bulkhead back, there's two neighbors, each one has built up the area in the two sides which he hasn't done to preserve the integrity of the area. Which makes it difficult for him now to have an area to sit in. Being that the house is raised, we're 10 feet from the top of the foundation to the mean high water which it requires of But we're sufficiently high enough that's inconvenient to, if you've seen the property the floor is much harder then the grade so for them to use the backyard with any kind of area for a barbecue or what have you, is almost impossible, so we decided on coming back 12 feet enough so they can have a picnic table and a barbecue incorporated right on the deck. An area to sit out and entertain. I really didn't see any other way that it could possibly be done and the deck is still way above the 8 foot mark, it would be off the 10 feet again, above the high water mark and it shouldn't effect the environment or the integrity of the marsh land around that.
