Box 672 Greenport, NY 11944 Re: Varujan Arslanyan SCTM #1000-52-1-8 Dear Mr. Wiggin: The following action was taken by the Board of Town Trustees during its regular meeting held on Thursday, April 29, 1993 regarding the above matter: WHEREAS, Peconic Associations on behalf of Varujan Arslanyan applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated February 8, 1993 and, WHEREAS said application was referred to the $outhold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on Thursday, April 29, 1993 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that the Board of Trustees approves the application of Peconic Assoc. on behalf of Varujan Arslanyan to construct approx. 95' of bluff protection type bulkhead to connect to existing bulkhead to the east. Jorllng Commissioner TOWN OF OUTHOLD NYSDEC Permit Appll¢ ...... ion #1-4738-00317/00002-0 Varuj an Arslanyan Letter of objection/Notice of Incomplete Application Dear Mr. Wiggin: The Department has reviewed the above referenced permit application. The Department objects to the project as proposed. Although the top of the slope appears to have'been accurately identified in the plans, the existing toe of the slope has not been indicated at all. The proposed bulkhead cuts into a damaged, bUt restorable bluff face. It appears unreasonable to destroy an existing beach grass vegetated slope to install a bulkhead. It is likely that bulkheads on adjacent properties focused the scouring effects of wave .:::~ergy onto the subject property, and the adjacent property to %:!~s west. A bulkhead on the subject parcel would likely further fo-us wave energy to the property to the west and would accelerate ~rosion of the beach, especially after removal of the vegetated Dluff. Thus, the project does not meet the standards for permit issuance found in the Tidal Wetlands Land Use Regulations Part 661.9(c). A bulkhead at the actual toe of the bluff would have the same impacts to the beach as one in the bluff, and therefore, also does not meet the standards for permit issuance. The Department suggests you investigate the following approvable alternative: installation of a revetment, buried in sand, and re- creation of a vegetated slope on its surface (see attached sample cross-section). The buried revetment appears to be capable of protecting the property, reducing erosional scour of the adjacent.tidal wetland and somewhat retain the natural bluff and its contribution to beach processes. Should the applicant decide to modify the proposal to utilize the buried revetment, three copies of revised plans that show the existing bluff top and toe and proposed conditions will be required for approval. Be sure to include the stairs. The project must still comply with the Coastal Erosion Management Permit requirements, as administered by the Town of Southold. The project application is currently also going through a coordinated State Environmental Quality Review. A Lead Agency will be determined, and the review conducted. The application remains incomplete pending either acceptance of a Final Environmental Impact Statement by the Lead Agency, or a Negative Declaration of Significance. The proposed deck will be out of the jurisdiction for tidal wetlands permits. By copy of this letter, I am notifying the Town of Southold of this Department's concerns. Box 590 Mattituck NY 11952 Re: Varujan Arslanyan SCTM #1000-52-1-8 Dear Mr. Whelan: As timing would have it, i was able to briefly discuss Mr. Arslanyan's request with the Zoning Board Chairman, Mr. Goehringer, and Assistant Town Attorney Matt Kiernan on Saturday, April 4, 1992. It would seem that all conditions I set forth in my letter to you of February 20, 1992 are still operable (copy enclosed). In addition, to avoid any confusion in this matter, I must further clarify that letter with the following: 1. The Town Code Chapter 37 will not permit any permanent foundation within the Coastal Erosion Building Hazard area (ie seaward of the Coastal Erosion Hazard area line) and bluff setback zone. 2. A Coastal Erosion Hazard area variance application would be required for any activity written 50' of the bluff on this property as the bluff setback and building hazard area requirements can not be met. At a minimum, the application for such a variance cannot be accepted with any permanent foundation within 50' of the bluff. 3. It is my opinion that the Town Code Chapter 37 variance requirements are such that it would be difficult if not impossible for the Trustees to grant relief for even an unattached open deck any closer than 25' to the bluff. As said deck would have to conform to the lot coverage requirements of the town code, Mr. Arslanyan might be required to build all or a substantial portion of it at ground level. I am very sorry that no allowable alternative exists for Mr. Arslanyan to have a pool at the sound side of his house, excepting possibly a hot tub without a permanent foundation which could be applied for on a variance basis along with the deck.
