WEICK for a Variance to the Zoning Ordinance, Article IIIA, Section 100-30A.4 (100-33) for permission to locate accessory garage building in the front yard area. Location of Property: 20485 Sound View Avenue, Southold, NY; County Tax Map Parcel No. 1000-51-4-10. WHEREAS, after due notice, a public hearing was held on December 3, 1992, and at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, the surrounding areas; and and WHEREAS, the Board made the following findings of fact: 1. This is an appeal of the November 12, 1992 Notice of Disapproval by the Building Inspector for a variance to build a new, detached (accessory) garage in the front yard area of this 27,880+- sq. ft. nonconforming parcel. 2. The premises in question is located in the R-40 Low-Residential Zone District. The survey submitted with the application shows that the premises is improved by a 1-1/2 story frame dwelling situated approximately 100 feet from the front property line along Sound View Avenue. This parcel is a described parcel and is shown on the Suffolk County Tax Maps as Parcel #10 of District 1000, Section 51, Block 4, Lot 10. 3. The garage plan submitted for consideration shows the building to be proposed of a maximum size of 22 ft. wide by 26 ft. deep. The garage will be limited strictly for storage purposes accessory and incidental to the owner-applicant's residence and permitted accessory uses. This building may not be used or operated as a principal use such as a business, Page 2 - December 3, 1992 Appl. No. 4138 - Theodore M. Gold $outhold Town Board of Appeals residence or other type of habitable unit, or for similar gainful purposes (such as rental for non-owner storage, etc.). 4. The location of this accessory garage building is requested at 35 feet, and amended at the hearing to 40 feet from the southerly (front) property line. The westerly side yard setback is proposed at not less than 15 feet. 5. The height of this building is proposed at 12 feet from ground. This building will be one-story construction and is more particularly shown in detail on the construction diagram submitted with this application. 6. It is the position of the Board in considering this application that: (a) the circumstances are uniquely related to the property; the rear yard area is technically that limited upland area of approximately 22 feet between the rear of the dwelling to the top of bank of the Long Island Sound; (b) there is no method feasible for appellant to pursue other than a variance - particularly since the property is a nonconforming lot on the Long Island Sound and alternative locations would necessitate reviews and possible variances from the Town Trustees and N.Y.S. Department of Environmental Conservation under the wetland ordinances and Coastal Zone Management Law; (c) the relief is not substantial in relation to the requirements - particularly in light of the fact that a new law is being proposed for adoption at the December 8, 1992 Town Board meeting, and is expected to become effective within two weeks after its adoption; (d) the variance requested does not involve any increase of dwelling unit density; (e) the relief requested will not cause a substantial effect on available governmental facilities since the structure is for enclosed parking and storage of the owner's own lawn equipment and other items; (f) the relief requested is not unreasonable due to the uniqueness of the property and the immediate area; (g) the variance will not in turn be adverse to the safety, health, welfare, comfort, convenience, or order of the town, or be adverse to neighboring properties since the proposed Page 3 - December 3, 1992 Appl. Gold Southold Town Board of Appeals building will be substantially setback from the front property line at 40 feet - which is the minimum principal setback in this R-40 Zone for substandard lots; Accordingly, on motion by Mr. Goehringer, seconded by Mr. Dinizio, it was RESOLVED, to GRA/qT a Variance to locate a 22 ft. wide by 26 ft. deep accessory garage/storage building in the front yard area SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the setback from the westerly side property line not be less than 15 feet as conditioned by the previous variance; 2. That the setback from the front property line not be less than the normal principal setback at 40 feet (listed at Section 100-244 for nonconforming lots); 3. That the building be limited to an accessory use for garage or storage purposes incidental and related to the principal dwelling use of the owner and not be operated for gainful purposes (not for rental storage or other separate business purposes(, etc.; 4. That there be no cooking facilities, or sleeping or living quarters, as restricted by the accessory provisions of the code in this R-40 Zone District. 5. That electric be permitted on the interior of building only. Vote of the Board: Ayes: Messrs. Dinizio, Villa, Wilton and Goehringer. (Member Doyen of Fishers Island was absent.) THE CHAIRMAN: I have copy of a survey produced by Anthony Lewandowski dated July 9, 1990. We have all visited the site. We have seen the stakes that are in there. We noticed that there is a most natUral driveway on the west side, and that proposed garage is 26 by 22, approximately 15 feet from the westerly property line; and we have a copy of the Suffolk County Tax Map indicating this and surrounding properties in the area. Who would like to be heard? ~ Appearance: Theodore Gold, Owner, Applicant pro se. Well, I am the owner. My name is Theodore Gold, and the gentleman next to me is the builder; and we can answer any questions you might have concerning that. THE CHAIRMAN: The extent of the utility to be placed in this garage would be just electricity? MR. GOLD: Electricity; and I am bringing water to the outside of it. Page 11 - 12/3/92 THE CHAIRMAN: Okay, so you can wash your car, conceivably and so on and so forth? MR. GOLD: Yes. THE CHAIRMAN: It is a one-story structure? MR. GOLD: Yes. THE CHAIRMAN: In the plan, approximate height to the ridge was what, 12 feet or so? MR. GOLD: Less; we are going to revise coming in on the side. THE CHAIRMAN: You are going to come in on the side? MR. GOLD: Yes, because it is lower there. We will' have approximately 3 feet of foundation, in the back, plus-- The ridge will probably be 12 or 13 feet. THE CHAIRMAN: The doors will be on the westerly side or easterly side? MR. GOLD: Easterly. ~ THE CHAIRMAN: My only other question is: Any other questions from anybody? MR. VILLA: Yes, I would like to know, would it be possible to go back 50 feet instead of 35 feet because the front yard offset in an R40 zone is 50 feet, and they are just revising the code to say, you know, that this would be permissible provided you have a --you meet the normal setback requirements. Since the house is so far back, it would probably make it more attractive to the house, there would be less distance between the house and the garage. And it would be back Page 12 12/3/92 from the street the normal setback that a house would be, and I would think it would be more attractive that way. MR. GOLD: I hadn't thought about that. I was trying to keep the minimum distance from the road. I do have a cesspool back in there, a septic field. Between where the front of the garage is going to be and the house. I am not certain how far back in it is. That would be one of my concerns. (Inaudible discussion among Board.) MR. VILLA: I realize that; but if you are going to correct a situation, you have to start someplace. MR. GOLD: As a right. People who live on the water have a problem in that ~hey can't build in their rear yard. MR. DINIZIO: So we worked on this so that you could build this garage anywhere on the buildable area of your property. I had thought it was forty. THE CLERK I think it is. MR. DINIZIO: Because it is a non-conforming lot. So if you moved it back five feet you wouldn't even have to come before us. THE CHAIRMAN:' the revision stage. THE CLERK: He didn't want to wait that long. MR. GOLD: I am afraid to go fifty because I don't know where the leaching holes or anything is. I don't want to get tangled up with that stuff. Once the law is passed. It is still in Page 13 - 12/3/92 MR. DINIZIO: That is really why the law is the way it was, and my understanding was, on the eighth the Town Board was going to vote on it. So I don't know if you would want to wait a few days. But it is certainly a consideration. THE CLERK: Does anybody have a code book? THE CHAIRMAN: I have no qualms about the 40 feet. THE CLERK: Just let me double-check. MR. DINIZIO: I have no problems granting it at 40 feet either. THE CHAIRMAN: We are just checking the actual distances. THE CLERK: It is non-conforming lot in an R40. It is over 20,000. 40 feet would be the front yard. Not 50.
