Application of FUTURE SCREW M3%CHINE PRODUCTS (MR. AND MRS.
WARREN E. HUFE, JR.) Variance to the Zoning Ordinance, Article
VIII, Section 100-82 (and Article XXIV, Section 100-242A) for
permission to construct addition which will increase the degree of
nonconformance in the northerly side yard setback. The setback
from the northerly property line is less than the required 20
feet. Location of Property: 41155 C.R. 49 (and the westerly side
of Kenny's Road, Southold, N~f; County Tax Map Parcel No. 1000-
59-7-33. This property is nonconforming as to total lot area in
this Limited-Business (LB) Zone District.
WHEREAS, a public hearing was held on May 7, 1992 concerning
this application filed on April 27, 1992, and all those who
desired to be heard were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. By this application, appellant is requesting approval of
storage addition at the most north (easterly) corner of the
existing "1 & 2 story frame & Concrete block machine shop"
building. The addition is proposed to be 343 sq. ft. with an
extension of 10 ft. past the building into the easterly front yard
area. The northerly yard setback is proposed to be maintained at
not less than 11.1 feet at its closest point. For reference is a
photocopy of a sketched map prepared by Robert Bayley, A.I.A.
2. The premises in question is nonconforming as exists with
a total lot area and width containing a total area of 13,718.85
feet (.3149 ac.). The building is also nonconforming in the
northerly rear yard (on this corner lot) with a setback of 11.1
feet and the front yard setback from County Road 48 is shown to be
18.4 feet at its closest point.

3. The premises is located in the Limited Business (LB) Zone
District and the existing principal building with addition has
received a Certificate of Occupancy under No. Z6919 dated March 4,
1976. It is noted, however, that the metal truck trailer shown on
the February 5, 1992 survey prepared by Joseph A. Ingegno will
be eliminated, being replaced by the subject addition (and only in
the location more particularly described in paragraph 1 above
(shown on the sketch map).
4. This addition is to be used for the present machine shop
use purposes, and not as a separate use.
5. It is the position of the Board in considering this
application that:
(a) the circumstances are uniquely related to the land
and buildings and are not personal in nature;
(b) the relief is not substantial in relation to the
requirements;
(c) the relief as granted will not cause a substantial
increase in use density and will used strictly for the principal
use existing at the premises;
(d) the relief requested is not unreasonable due to the
uniqueness of the property - a corner lot of a substandard size;
(e) there is no alternative for appellants to pursue
other than a variance {which would be necessary for either an
addition or an accessory building};
(f) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, be adverse to neighboring properties, or alter the essential
character of the neighborhood.
Accordingly, on motion by Mr. Doyen, seconded by
Messrs. Grigonis and Villa, it was
RESOLVED, to GRANT a variance for the proposed (342+- sq.
ft.) addition at the northeasterly corner of the existing
building, maintaining the existing nonconforming setback from the
northerly property line at not less than 11.1 feet at its closest
points, as applied under Appl. No. 4103, in the Matter of FUTURE
SCREW MACHINE PRODUCTS, INC. (MR. AND MRS. WARREN HUFE, JR.).
Vote of the Board: Ayes: Messrs. Grigonis, Doyen, Dinizio,
Villa and Goehringer. This resolution was duly adopted.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following matters
will be held for public hearings before the SOUTHOLD TOWN BOARD
OF APPEALS at the Southold Town Hall, 53095 Main Road, Southold,
New York 11971, on THURSDAY, MAY 7, 1992 commencing at the times
specified below:
1. 7:34 p.m. Appl. No. 4102 - ROBERT AND ELEONORE CAHILL.
This is an Appeal of the April 22, 1992 Notice of Disapproval by
the Building Inspector for a Variance to the Zoning Ordinance,
Article III-A, Section 100-30A.3 for permission to construct
deck addition with an insufficient front yard setback from the
easterly property line (along Cedar Lane, a private road).
Location of Property: 515 East Gillette Drive, East Marion;

1. STRICT APPLICATION OF THE ORDINANCE would produce pmcticaldifflcultiesorunneces-
sowHARDSHIPbecause the machine shop is situated on its site in such a way
that all the heavy machinery is located on the shop floor massed to the
center of the building with storage and service functions located towards
the two outer perimeter sides of the building. A crushed shell access
driveway runs alongside the outer perimeter of the structure. Most shop
raw material is stockpiled in a shed addition along the rear of the
building where it is handy to the perimeter access driveway. Additional
raw material is stored in a truck trailer parked nearby along the access
driveway. In order to improve the appearance of the site the truck must
be removed and replaced with an addition to the shop to make up for the loss
of storage capacity when the truck is eliminated. In order to locate the
new storage area adjacent to the existing storage and alongside the access
driveway it is necessary to penetrate the sideyard setback zone. Yet the
present building already extends to within 11.1 feet of the sideyard
boundary line and the new addition would penetrate no further.
2. The hardshipcreatedis UNIQUEand isnotshored by all prope~ies alike in the immediate
vicinity ofthis property and inthis use district because the machine shop is located on a
relativly small corner'site with limited room to operate wit~ regard to
re-supply and servicing. The only way to add re-supply space to the
facility in such away as'to ensure the normal flow of operations and
to accomodate delivery trucks is to add space at the rear of the building
where the sideyard setback limit would be penetrated. Nevertheless, the
· proposed addition would not increase the'degree of non-conformity ~hile
it would'increase'the "footprint" o~ the building. -.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the present machine shop with its rear
storage area already penetrates the sideyard setback zone. With the
proposed expanded storage shed addition, the new structure would extend
no further into the setback zone than at present, moreover, with the
addition proposed the building would present a much better appearance
from the two public roads and the unsightly parked truck trailer would
be gone from the site.

During 1992 the owners of, the above premises appeared before the
Board of. Appeals-for setback area variances for a storage addition at
the westerly side and for an addition at the northerly yard with the
understanding that the trailer would-be removed immediate}y once the
construction was finalized. The trailer has not been removed and
since it was placed at the premises without permits or approvaLs,for
site plan or otherwise, we ask that you please* notify the property
owners immediately .to remove the trailer.

this application filed on April 27, 1992, and all those who
desired to be heard were heard and their testimony recorded; and

CHAIRMAN GOEHRINGER: I have a copy of a survey dated February 5, 1992.
The nature of this application is a 342 sq.ft, addition, one-story frame
construction to the existing machine shop on the northeasterly side. And
I have a copy of the Suffolk County Tax Map indicating this and
surrounding properties in the area. Mr. Bayley I understand you are
presenting? Any time you are ready.
MR. ROBERT T. BAYLEY: I got some pictures with me to help show the
situation. Right now, this is a panel of existing photos of the machine
shop. And the picture in the lower left hand corner, shows the machine
shop as here from Kenneys Road with the trailer parked on the site. As
you know, and most of the people in the neighborhood know, the trailer is
rather unslightly. It has been parked there for quite a while. The
primary reason for this applicant making an appeal to add on to the
building, is to remove the trailer. The trailer is roughly forty (40)
feet long by eight (8) feet wide and the area that the owners would like
to add to the building is roughly comparable to the area that would be
lost when the trailer is removed from the site. The first thing I would
say is, is well, if you are going to add onto the building, why not add in
such a way that it isn't, that is conforming. The owners would like to do
that, however, the storage facilities right now, in the building are all
along the property line, which is ten (10) feet from existing building
line, which is presently used for storage. And there is an access road on
that side as well. So the deliveries are all made from Kenneys Road along
the back, as you view it from the North Road of the property. So, in
order to continue to service the property away from the busy North Road
and using the existing service drive. This is the logical place to put
the addition. So, that is why it is located in that corner. I also feel,
as an architect, that by putting an addition in that corner, I will just
let this drop, it actually improves the building as well as improve the
site. Improving the site is obvious, because the trailer wili no longer
be there, that is a big improvement. But I think in addition, it is
better for the building because the addition will wrap around the corner.
And let us see, here is another view, there is a very unslightly storage
building on that corner at the rear anyway, the addition will penetrate no
further towards the property line than this existing storage facility
already does.

MR. BAYLEY (eon't): It merely, shall we say, engages the existing
nonconformance. We think that this a modest approach and a modest, a
sensible way to make up for the loss of the trailer. As I said, the space
involved is roughly the same as the trailer and we also realize that this
is an undersized lot, that is to say that the map of addition to the
building, now puts the building at the limit, as far as site coverage, so
I sincerely doubt that the owners will be contemplating adding, because
they would be in excess of the twenty percent (20%) coverage limit on this
site. But, as I say, this does not go beyond the twenty percent (20%) but
it is close to it.

The proposed site plan was reviewed by the Principal
Building Inspector and found to meet all zoning

An Environmental Assessment has been submitted and
reviewed. It was determined that no significant effects to
