Variance to the Zoning Ordinance, Article XXIII, Section 100-239.4B for permission to locate a deck addition with a setback at less than 75 feet from the bulkhead along Baldwin's (Mud) Creek. Location of Property: 950 Strohson Road, Cutchogue, Town of Southold; County Tax Map No. 1000-103-10-24. WHEREAS, a public hearing was held on April 2, 1992, at which time all those who desired to be heard were heard and their testimony recorded; WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. By this application, appellants seek a variance under Article XXIII, Section 100-239.4B for permission to construct a raised, open-deck addition from the rear (easterly end) of the existing dwelling, requesting a reduction in the required setback to the existing bulkhead to 54 feet at its closest point. 2. The premises in question is identified on the Suffolk County Tax Maps as District 1000, Section 103, Block 10, Lot 24 and contains a total lot area of 10,275 sq. ft. 3. The dwelling as exists presently has sideyards totaling 21'9" feet (16'9" & 5), a conforming front yard setback at 61-1/2 feet, a nonconforming setback from the bulkhead at approximately 56 feet (to the small porch step area in the rear) and approximately 63 feet to the existing enclosed porch. These details are shown on the survey prepared by Roderick VanTuyl, P.C. as amended March 10, 1992. The parcel as exists is substandard with 10,275 sq. ft. in total lot area. The lot width along Strohson Drive is nonconforming at 50 feet. Page 2 - App1. No. 4096 Matter of PAT and ROSEANNE IAVARONE Decision Rendered April 2, 1992 4. Article XXIII, Section 100-239.4B of the Zoning Code requires all buildings and structures located on lots upon which a bulkhead, concrete wall, rip-rap or similar structure exists and which is adjacent to tidal water bodies other than the Long Island Sound to be set back not less than seventy-five (75) feet from the bulkhead. 5. In considering this application, the Board finds: (a) the relief requested is not substantial in relation to the existing established nonconforming setbacks; (b) the relief requested is the minimum necessary to afford relief; the construction is for an open, unroofed deck addition without a foundation or basement and without a roof or full enclosure; (c) the relief requested will not alter the essential character of the neighborhood; (d) the practical difficulties imposed are uniquely related to the property and are not personal to the landowner; (e) the grant of the relief as requested will not in turn be adverse to the safety, health, welfare, comfort, convenience or order of the town, or be adverse to the neighboring properties; (f) in view of all the above, the interests of justice will be served by granting the relief as requested and conditionally noted below. Accordingly, on motion by Mr. Goehringer, seconded by Mr. Grigonis, it was RESOLVED, to GRANT a variance for a 28 ft. wide deck with variables at 10 feet deep to the back of the existing enclosed porch and 20 feet in depth to the southeasterly end of the dwelling, plus a step entry (less than 48 sq. ft.) -- all as more particularly shown on the survey prepared by Roderick VanTuyl, P.C. dated March 10, 1992, SUBJECT TO T~E FOLLOWING CONDITIONS: 1. The setback from the bulkhead shall not be less than 54 feet at its closest point, as requested; 2. The open deck construction shall remain unroofed; Page 2 - Appl. It is a beautiful piece of property and I was there on a sunny day and I wanted to stay. MR. PODLAS: Makes two (2) of us. What is that addition that is being put on the north side, it sticks out a couple of feet, that is going up above the roof line? MR. PODLAS: My only involvement is just to apply for a deck. So if there is any building, or adding square footage to the house, I put nothing on the application for it. MEMBER VILLA: You only show a five (5) foot support set on the north side, and yet there is something that is sticking out about a foot and one-half, two (2) feet and it's got two by fours (2 x 4's) just laying down, it goes above the roof. CHAIRMAN GOEHRINGER: You know what that is, that is the chimney. That is a wooden chimney. MEMBER VILL: For what? CHAIRMAN GOEHRINGER: For a stove or a fireplace MEMBER DINIZIO: It has insulated pipe inside. MEMBER VILLA: But it is heating into that five (5) foot offset CHAIRMAN GOEHRINGER: No, it is permitted, even though it is made out of wood. Chimneys and stoops are exempt. MEMBER VILLA: It is not built, I mean it's just framing. CHAIRMAN GOEHRINGER: That is right. MEMBER VILLA: I couldn't figure out what they were doing. CHAIRMAN GOEHRINGER: Also you are probably familiar with our discussion concerning the 280A aspects of this particular right-of-way. Are you familiar with that? (Nodded affirmatively). Okay, and this Board of course in granting this application and I am not pre-supposing that we are granting it. But in any case, we will be putting conditions in reference to some minor updating of the existing driveway area, when I say driveway, I am not referring to the driveway on site, but the private road area. (E.D.S.T.) upon application of Esther R. Taylor, Strohson Road, Cutchogue, New York (Abigail Wickham, Esq.) for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide property with insufficient width and area. Location of property: Little Neck Road and Strohson Road, Cutchogue, New York, bounded on the north by Browning; east by Stepnoski; south by Strohson Road; west by Little Neck Road and Comer. The chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, notice to the appli- cant, and disapproval from the Building Inspector. The Chairman also read statement from the Town Clerk that notification by certified mail had been made to: Jonathan C. Browning; Steve Stepnowski; Miriam M. Comer. Fee paid - $15.00. THE CHAIRMAN: The County tax map indicates that what the applicant says is correct in every detail. Is there anyone present who wishes to speak for this application? ABIGAIL WICKHAM, ESQ.: I'd like to make a note that the notice of disapproval states that neither lot will have 150' width whereas the tax map shows, and the deed also shows, that the larger lot has 159' frontage. THE CHAIRMAN: On this copy of the County tax map it only shows 59'. The "1" is missing. ABIGAIL WICKHAM, ESQ.: It is 159'. THE CHAIRMAN: There's one lot of about 35,000 at the bottom of the "L", the other lot consists of sq. ft. sq. ft. with, about 15,000 ABIGAIL WICKHAM, ESQ.: With 100' frontage, although it's similar to several of the other lots in that block. THE CHAIRMAN: Each fronting on separate roads. ABIGAIL WICKHAM, ESQ.: Yes. THE CHAIRMAN: Are there any structures on this property? ABIGAIL WICKHAM, ESQ.: No, the area's heavily wooded and there's nothing on there right now. THE CHAIRMAN: The lots across the street are ... Total lot area: 6.039 acres. The premises is located in the R-80 Zone District. WHEREAS, a public hearing was held on April 13, 1989, in the Matter of the Application of MARION ROBINS under Appeal No. 3787; and WHEREAS, at said hearing all those who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located in the R-80 Low Density Residential Zoning District and is identified on the Suffolk County Tax Maps as District 1000, Section 103, Block 10, Lot 2. 2. The subject premises as exists is vacant, contains a total lot area of 6.039 acres with minimum frontages (or more) along three streets: Little Neck Road, Baldwin Place, Strohson Road. By this application, appellant requests Variances from the Zoning Code for approval of insufficient lot area for: (a) proposed Parcel No. 1 of 69,621 sq. ft., {b) proposed Parcel No. 2 of 62,771 sq. ft., (c) insufficient lot area for proposed Parcel No. 3 of 66,691 sq. ft., and (d) proposed Parcel No. 4 of 63,993 sq. ft. 4. Article III, Section 100-32, Bulk Schedule, of the Zoning Code requires a minimum lot area of 80,000 sq. ft. for parcels in the R-80 Zone District. 5. In viewing the immediate area of the subject property in Section 103 of the County Tax Maps, the following parcel numbers, lot sizes, and/or Zone Districts are noted: (a) immediately to the north lot now in the ownership of Doris Bernhard and Lorraine Dunhuber, 9.9 acres (common ownership of Block 5, Lots 3 & 4 with Block 10, Lot 1; (b) the westerly, easterly and southerly boundary lines are each bordered by a street; (c) those lots opposite the adjacent streets are located in the R-40 Zone District. 6. In considering this application, the Board finds and determines: (a) that it is the burden of the landowner to prove that the area restrictions as applied to his land imposes "significant economic injury"; and the burden of proof has not been substantiated; {Matter of Cowan v. Kern, 41 N.Y. 2d 591 (1977); Matter of Fulling v. Palumbo, 21 N.Y. 2d 30}; (b that the relief requested is substantial in relation to the requirements, being a variance of approximately 22 percent, or 17,229 sq. ft. {Lot %2} less than the requirement; (c) that the premises has been located in the minimum 80,000-sq.ft. zoning district since May 1983, and upon information and belief, has never previously been divided {particularly prior to May 1983 when the minimum zoning requirement was 40,000 sq. ft.}; (d) that the difficulties claimed are not sufficient to warrant a grant of the relief requested; (e) there will be an adverse effect of increased dwelling density thus produced on available governmental facilities by the creation of precedents if the variance were allowed; Southold Town Board of Appeals -3- April 27, 1989 Special Meeting (Appl.
