Upon application filed by THE NORTH FORK BANK & TRUST
COMPANY for a variance to the Zoning Ordinance, Article IX,
Section 100-92 for permission to construct addition with an
insufficient front yard setback along Sound Avenue. Location of
Property: 750 Pacific Street at intersection with Sound Avenue,
Mattituck, NY; County Tax Map Parcel No. 1000-144-4-24.
Subject premises is located in the Hamlet-Business (HB) Zone
District.
WHEREAS, a public hearing was held on September 10, 1992,
and at said hearing all those who desired to be heard were heard
and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is located in the Hamlet "HB" Business Zoning
District, is identified on the Suffolk County Tax Maps as
District 1000, Section 141, Block 4, Lot 24, and contains a
total area of approximately 51,226 sq. ft;
(b) is improved with a principal one-story stucco
building having been used as a banking and mortgage company, and
a separate stucco garage building used for accessory storage and
garage purposes incidental to the main use of the premises which
is located in the southerly (rear) yard area. (See survey
revised on September 18, 1989, prepared by Young & Young, L.S.}
(c) the setbacks of the existing principal building
are presently 21 feet from the northerly property line, 23 feet

from the northerly concrete curb, 29.8 feet from the westerly
front property line, 39 feet from the westerly concrete curb,
42.8 feet from the easterly property line, and 177+- feet to the
southerly property line, all at its closest points.
2. The application before the Board is related to the
recent occupancy by the Town of Southold of the Nutrition
Center, or Human Resource Center, (which has been relocated from
its site at St. Agnes Hall in Greenport) and involves an
expansion extending 14 feet from the existing closest setback,
and 24 feet from the further setback. This expansion is
specifically necessary for this Town Service Center, and will be
a kitchen work/food-service area, and two lavatories. The
application is being made for the Town of Southold by the North
Fork Bank & Trust Company. It should be noted that if the
acquisition of this property by Town of Southold was finalized
by this date, the Town would have been exempt from the zoning
setback requirements. Due to time constraints, the Bank is
assisting the Town in its efforts to acquire and occupy the
premises with the new extension.
3. For the record, it is also noted:
(a) that the yard area which is the subject of this
variance is at the northerly side of the principal building;
(b) that the setback proposed for the new kitchen
area is shown to be approximately 13 feet from the existing
concrete curb along Sound Avenue (also known as the old North
Road) approximately 80 feet from the existing concrete curb
along Pacific Street to the west.
(c) that there are other front yard setbacks to the
west and to the south, in the immediate area of this property,
which have similar reduced front yard setbacks;
(d) that the allowance of an addition at the
northerly front yard area, as applied, will not be adverse or
create a dangerous or adverse conditions, and will not interfere
with visibility or manueverability along these side streets;
(e) that the aesthetics of the front yard area will
not be changed since the addition will not exceed one-story
height (variable 14-17 feet), the front yard landscaping will
remain and will be a non-traffic area; and the parking area
will remain located at the south of the principal building with
dual access points (from Pacific Street and from Sound Avenue at
the northeast side of the building), as previously existed and
still exists.

(f the new floor area for this extension is shown to
be 1120+- square feet. The existing floor area of the building
is shown on the town records to be 4965+- square feet.
5. In considering this application, the Board also finds':
(a) that the relief, as conditionally noted below,
will not be adverse to the essential character of the neighbor-
hood;
(b) that the relief, as conditionally noted below,
will not in turn be adverse to the safety, health, welfare,
comfort, convenience or order of the town, or be adverse to
neighboring properties;
(c) that the relief herein will not be an increase in
density, or cause a substantial effect on available governmental
facilities;
(d) that although the amount of relief requested is
substantial in relation to the requirements, the setback will be
similar to others existing in the area;

RESOLVED, to GRANT a variance for a proposed one-story
kitchen addition as applied and shown on the plans prepared for
the Southold Town Human Resource Center (Nutrition Center) by
the Southold Town Engineering Department dated May 22, 1992,
subject to approval of the Town Building Inspector under all
state building and construction codes.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Dinizio, and Villa. This resolution was duly adopted.

for sale to the Town of Southold. The extension requires a variance due to insufficient
front yard.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulti~e~lj~l~le[lfledeu~.~
sor¥ HARDSHIP becausethe layout of the building and parking/driveway areas makes the
kitchen addition most feasible in the proposed location. Since the property is a corner
lot and the building is located near the corner, an extension will intrude into the
setback area. However, to locate the addition on the South side of the building would
require major relocation of the parking area and driveway, site plan review, and possible
relocation of cesspools and drywells installed by the Town of Southold with the owner's
permission to collect road run-off.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because the building is situated near the corner,
and the property is a corner lot.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the front yard along Pacific Street will maintain its
current setback; the addition will be one story designed to blend with the existing
building; and there is an additional 12 feet beyond the property line to the curb so
that the set back will appear to exceed 20 feet.

Notice and application for the record.)
THE CHAIRMAN: I have a copy of a site plan which is
the nature of this application which refers to a proposed
addition which extends out from the existing mortgage center of
North Fork Bank, past mortgage center of North Fork Bank, to
(indistinguishable) Avenue approximately six feet from the
property line as it exists now; and I have a copy of the Suffolk
County Tax Map indicating this and surrounding properties in the
area. Miss Wickham, would you like to be heard?
Appearance: Gail Wickham, Esq., for the Applicant
MISS WICKHAM: Thank you. The location of this
proposed addition and its contents, which as you can see from
the plan is primarily kitchen and staff facilities, were provided
to us by the Town of Southold in connection with the pending
sale to the Town for use as their Nutrition Center. If you have
any questions, I would be glad to answer them for you.
THE CHAIRMAN: I know you are answering questions for
the municipality; but is there any reason why they chose to go
toward Old Sound Avenue and not into the parking lot, since
there certainly was more adequate parking. Ail you had to do
was take grass away --in other words, flipping the kitchen.
MISS WICKHAM: Let me first say, I was hoping someone
from the Town would be here tonight; but maybe Ron can help
answer that question. My understanding is that when they looked
at the layout of the building where they wanted the kitchen to
be relative to the access of the driveway for service people and
whatnot, and also having people being to able to walk in from
the parking lot into the main areas without having to go through
a kitchen area, I presume that is why they did it that way. The
other thing I understand is that there are some pools in that
grass area for drainage.
MR. RON BOGOVICH: It was also the most economical way
because the plumbing line is on that side of the building. The
rest rooms are there and there is a small kitchen facility on
that side.
THE CHAIRMAN: Is this building a slab? Or does it
have a basement?
MR. BOGOVICH: It has a basement in maybe one-fifth of
the building.
MISS WICKHAM: The addition I understand will be on a
slab.
THE CHAIRMAN: we have no idea for the hearing
purposes how many people they serve on a daily basis, both
take-out and in.
MISS WICKHAM: No. I had asked the plumber,because I
knew you would ask questions, but I'm sorry I don't know.

MR. DINIZIO: The number thrown me at
today was 450 meals daily.

THE CHAIRMAN: Let me understand: The Town is
contract-vendee or potential contract-vendee, predicated on this
particular variance for the construction of this particular
addition. If this variance is worded in such a way so as to be
used exclusively for this contractual relationship and no other
contractual relationship, you as a representative of the North
Fork Bank have no problems.
MISS WICKHAM:, I have no problems.
THE CHAIRMAN: Have all the facilities of North Fork
Bank used for this particular purpose in this building, mortgage
center, computerization, hard drives and soft drives and all the
rest-- has that all been removed?
MISS WICKHAM: There is some furniture still there.
There may be some pieces of equipment, but I think all the
fixtures have been removed, haven't they?
MR. BOGOVICH:

The only thing then being utilized at
the storage area for the maintenance
MR. BOGOVICH: No, the Town is storing their proposed
kitchen equipment in the garage.
THE CHAIRMAN:

I see, because I had seen a North Fork
and that is why I asked.
The bank I think has nothing in the
garage any more except a lawnmower that they use to cut the
grass there so that --
THE CHAIRMAN:
Bob?
Does anybody have any other question?
MR. VILLA: No; in my inquiry into this is the reason
the Town is asking North Fork Bank to do it is because it is a
turn-key operation; and if the Town were to take it over first,
and construct this, they would not actually need any variances
because it is a Town operation; but then they would be subject
to going out for bids and time delays; and they thought the
speediest way of doing it was a turn-key operation. That was my
gathering of what transpired.
THE CHAIRMAN: Is North Fork Bank building this?
MISS WICKHAM: We are, yes. We have been advised the
Town wants it and we will obtain permits and build it, and sell
it on completion.

An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13{a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2('3j)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.
