ACTION OF THE BOARD OF APPEALS
Appl. No. 4089:
Matter of EVELYN P. TURCHIANO. Variance to the Zoning
Ordinance, Article IIIA, Section 100-30A.4 (100-33) for
permission to locate a new accessory garage building in the
front yard area. Location of Property: 450 (westerly side)
Deep Hole Drive, Mattituck, Town of Southold, NY; County Tax
Map Parcel No. 1000-115-12-5. This parcel is substandard in
size and is located in an R-40 Zone District.
WHEREAS, after due notice, a public hearing was held on
April 2, 1992, and at said hearing all those who desired to be
heard were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, Board Members have personally viewed and are
familiar with the premises in question, its present zoning,
the surrounding areas; and
and
WHEREAS, the Board made the following findings of fact:
1. ~his is an application for an appeal based upon a
Notice of Disapproval issued by the Building Inspector on
January 28, 1992 for a proposed accessory building in the front
yard area of the applicants/owners.
2. In this application, a 20 ft. by 20 ft. accessory
building for garage and storage purposes incidental to the
existing single-family residential use is proposed in a location
other than the required rear yard, and more particularly in the
easterly (front) yard area not closer than 20 feet from the
front property line along Deep Hole Drive and not closer than
five (5') feet the southerly (side) property line.
3. The premises in question is located in the R-40 Zone
Low-Residential Density Zone District and contains a total area
of approximately 11,830 sq. ft. The parcel is a nonconforming
parcel which has preexisted the zoning amendments from 12,500

zoning to 40,000 sq. ft. zoning in 1971 (and subsequent zoning
changes). A copy of an August 30, 1989 survey prepared by
Roderick VanTuyl, P.C. has been submitted for consideration with
the accessory building sketched thereon, together with general
construction plans.
4. The general construction plan of the subject garage
shows the height proposed at 16 feet (one-story) from ground
level and the vehicle door(s) facing north (facing the side yard
rather than the street). Electrical utilities are proposed.
Plumbing is not proposed. There is an on-site driveway
turnaround area that will be used (to eliminate backing out onto
the street).
5. Section 100-33 as amended April 10, 1990 provides that
accessory buildings shall be located in the rear yard.
6. In viewing the property, it has been found that the
rear yard area is that area to the west of the existing house
extending to Deep Hole Creek. The rear yard area is limited,
and is not buildable in many respects to to the timber walls and
bulkhead areas. To locate a garage structure in the rear yard
would require substantial relief under Section 100-239 of the
zoning code concerning setbacks from wetland or bulkhead areas.
It is not unreasonable to locate a proposed accessory garage in
the front yard area as an alternative to the rear yard under the
circumstances.
7. It is the position of the Board in considering this
application that:
(a) the circumstances are uniquely related to this
property particularly due to the nature of its nonconforming
size and characteristics, and are not personal to the landowner;
(b) the difficulties claimed have not been created by
the landowners since the land and buildings preexist the present
zoning requirements;
(c) the relief is substantial in relation to the
requirements, however, there is no alternative for appellants to
pursue other than a variance;
(d) the relief as granted does not involve any
increase of dwelling unit density and will not cause a
substantial effect on available governmental facilities since
the structure will be limited to garage and storage uses
incidential to the existing residence and will not be operated
for gainful purposes or as a separate principal use;

(e) the relief requested will not essentially change
the character of the neighborhood;
(f) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, or be adverse to neighboring properties,
(g) in view of the manner in which the difficulties arose
and in consideration of all the above factors, the interests of
justice will be served by allowing the variance, as
conditionally noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was
RESOLVED, to GRANT the relief requested under Appl. No.
4089to locate an accessory garage building in the front yard
area, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the variance is limited to the general
construction as planned and considered for a 20 ft. by 20 ft.
garage (major changes to the plans will require reconsideration
by the ZBA Chairman as to appropriateness under the variance);
2. That the building be limited to the height requested at
less than 18 feet (16 ft. height proposed);
3. That the only utility shall be electrical (with no
plumbing facilities), as proposed;
4. That the garage building be located no closer than five
feet to the southerly (side) property line and no closer than 20
feet to the front property line along Deep Hole Drive, as
requested. (including all overhangs and similar protrusions).
Vote of the Board: Ayes: Messrs. Doyen,
Dinizio, and Goehringer. Nay: Mr. Villa.

Deep Hole Creek. For practical purposes we hare always considered the Creek side of
our property as the front of~F~/~g~dth of the lot, the location of the
house, the location of the Septic system, and the location of the well all make it
impossible to place an accessory building in the "rear yard" as defined by the Building Code.
2. The hardship created is UNIQUE and is not shored by all properties alike in the immediote
vicinity of this property and in this use district because The house as built by us on a legal
building lot in 1969. New lots are usually wider and would permit the construction of
an accessory building in the rear yard.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because Legal building lots bordering Deep Hole Creek are mostly
narrow and long. We are submitting with our application for variance 15 photographs of
properties bordering the creek with accessory garages in the "Front Yard". We wish to
convert the existing one car garage into a den, and extend the front of the house to
include a living-room and a new front entrance. If we connected a new garage to the
existing building it would block the entire front of the house. It would not be
attractive and would make,new living-room dark and uninviting.

The Chairman opened the hearing at 7:52 p.m. and read the
Notice of Hearing and the application for the record.
CHAIRF~N GOEHRINGER: I have a copy a survey dated August 30,
1989 indicating the parcel in question with a two (2) story
frame house, almost directly located in the center of the
property from the high water mark. And a copy of the Suffolk
County Tax Map indicating this and surrounding properties in the
area. Is there somebody who would like to be heard concerning
this application?
MR. TURCHIANO: I am Mr. Turchiano.
CHAIRM~/~ GOEHRINGER: How do you do sir. Is there anything
you would like to add to the record?
MR. TURCHIANO: Mr. Chairman we are located on the water, Deep
Hole Creek, a very narrow piece of property, it is fifty (50)
feet wide. We would like to put this accessory garage on the
road side of the house and have the doors facing away from the
road, so that we have a place to pull in and turn and turn to
drive out, instead of backing out. We do have a small garage, a
one (1) car garage and the house, but we would like to put an
extension on the front of our house. The house was built, I
built the house 1969 and we have been occupying it since. We
would like to put a formal front entrance in the front of the
house with a living room. Now, if we tried to put a garage on
the front of the house, that is twenty (20) foot wide, you are
not going to see the house anymore and it will block the
sunlight out of the living room and everything.
So, we would like to put the garage up on the road, detached
from the house. That is pretty much our argument.
CHAIRMAN GOEHRINGER: Am I pronouncing your name correctly.
MR. TURCHIANO: Tur-chi-ano.
CHAIRMAN GOEHRINGER: I noticed that you had some really great
ground cover in that area. Are you going to continue with that
ground cover to hide the garage to the best of your ability?

MR. TURCHIANO: Yes. The front trees are going to remain
where they are. The entrance is going to be pretty much where
the driveway is now and will make that turn into the garage.
The doors will not face the road.
MRS. TURCHIANO: Excuse me, we will have the trees and the
shrubs there to continue that look, ~o keep the look.
CHAIRMAN GOEHRINGER: What is the approximate height of the
garage to the ridge, do you have any idea?
MR. TURCHIANO: It will be about sixteen (16) feet high.
CHAIRMAN GOEHRINGER: And as for utilities, electricity only?
MR. TURCHIANO: We will bring electricity into it, yes.
CHAIRMAN GOEHRINGER: I have no objection to this, I understand
your particular hardship and it is not unkind of many lots of
this particular nature. I do live in Mattituck and are very
familiar with Deep Hole Drive and I was there on a very beastly
Saturday, you weren't there.
MR. TURCHIANO: We took a lot of pictures of .....
CHAIRMAN GOEHRINGER: No, I appreciate that, that is very
helpful. Thank you very much. Is there anybody else who would
like to speak in favor of this application? I just want to
measure something. Anybody like to speak against the applica-
tion? We will wait and see if Mr. Villa has any questions.
MEMBER VILLA: Mr. Turchiano you said you were going to put an
addition on in front of the house?
MR. TURCHIANO: I intend to apply for a permit to put an
addition on the front of the house.
MEMBER VILLA: How far will that stick out.
MR. TURCHIANO: It will extend out about twenty (20) feet. It
is going to be a living room and a formal entrance. Right now
our entrance is, to the house, is on the water side. And we
have always considered the water side as the front of the
house. But this is what we want to do. We want to make it a
formal entrance.
CHAIRMAN GOEHRINGER: Any further questions from any Board
members? Does anybody have any specific objections to this

CHAIRMAN GOEHRINGER (con't.): particular application? I don't
have any objections either. In light of that, I offer a
resolution to grant this as applied for, with the following
restrictions, that the only utility be used in the garage is
that of electricity and that the garage be placed no closer than
five (5) feet to the... I would assume, if we are facing west
it probably pretty much south, southeast, southeasterly property
line and it not exceed the height it has been applied for, I ara
sorry the width that is has been applied for, which is twenty by
twenty (20 x 20) and approximately sixteen (16) feet in height.
I offer that as a resolution gentlemen and only be used as a
garage only, not habital, no bunkhouse, no sleeping quarters, no
anything of that nature.

implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law ~44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Sect~ion 617.13{a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.
