A variance is requested under Article XXIV, Section 100-244 and Article XXIII, Section 100-239.A for permission to construct addition to dwelling with reduced yard setbacks and within 100 feet from the top of the L.I. Sound bluff. This parcel contains a total lot area of 25,135+- sq. ft. and is located in the R-40 Zone District. Location of Property: 645 Glen Court, Cutchogue, NY; also referred to as Lot No. 1, Map of Vista Bluff filed on March 15, 1968 as map No. 5060; County Tax Map Designation: 1000-83-1-7. WHEREAS, after due notice, a public hearing was held on June 4, 1992, at which time all persons who desired to be heard were heard and their testimony recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, the previous zoning determination rendered May 23, 1991 under Appl. No. 3988; and WHEREAS, the Board made the following findings of fact: 1. The premises in question is located in the "Low-Density Residential R-40" Zone District and is referred to as District 1000, Section 83, Block 1, Lot 17, as a nonconforming, substandard lot of 25,500 sq. ft. and lot width (frontage along the north side Glen Court) of 100 feet. 2. The subject premises is improved with a one and one-half story single-family dwelling structure set back at its closest point 35 feet from the front, southerly property line; 15.5 feet and 20.8 feet from the easterly side property line, 17 feet and 22.8 feet from the westerly side property line, and approximately 55 feet from the northerly rear property line. The setbacks requested in this variance application are 13.8 feet from the easterly side yard for total sideyards at 30.8 feet, a front yard setback at 29 feet, and a distance of not less than 80 feet to the top of the bluff (see sketch submitted May 21, 1992 with cover letter from Abigail A. Wickham, attorney for the applicants). 5. It is the board's majority opinion that this application is not reasonable and agree with the reasoning of the applicant, except that the side yard setback at not less than 14 feet, and front yard setback at not less than 30 feet, is the minimum necessary to afford the applicants relief. 6. In considering this application, the Board also finds and determines: (a) the relief as granted will not in turn increase the dwelling unit density; (b) the evidence submitted and practical difficulties claimed are sufficient to warrant a grant of this variance, as alternatively granted; (c) there will be no substantial change in the character of the immediate neighborhood or detriment to adjoining properties; (d) the difficulties cannot be obviated reasonably with some method feasible to the appellant to pursue, other than a variance; (e) that in view of the manner in which the difficulties arose, and in considering all the above factors, the ~nterests of justice will be served by granting the variances requested and as conditionally noted below. Accordingly, on motion by Mr. Villa, seconded by Mr. Grigonis, it was RESOLVED, to GRANT ALTERNATIVE RELIEF with: (a) a setback from the easterly side property line at not less than fourteen (14) feet {instead of the requested 13.8 feet}; (b) a setback from the southerly front property line at not less than 30 feet (instead of the requested 29 feet); and (c) a one-story height limitation of the proposed garage addition, as proposed herein. vote of the Board Ayes: R~tri~onis. The side yards and front yard are too narrow to construct a conforming structure. The existing frame shed in the rear yard will be removed. Although the construction would be within 100 feet of the bluff, a variance is requested as to this matter because it affects the portion of the residence furthest from the bluff. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate viOn,ty of this property and in this use district because once the shed is removed, there will be no storage area. Other houses in the district have sheds and/or garages. 3 The Var,once would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the tax map reveals that the lots along Glen Court are all approximately 100 feet wide, and a physical inspection reveals that the houses in the district contain garages. The privacy of the neighbor to the East is protected by the existing hedge. The proposed addition would not increase the size of the structure to a degree greater than houses generally in the area. I like to just indicate that if you, when you made a visual inspection of the property and saw the stakes, it seems to me that the proposed extension is not going to really dramatically change the overall picture of the property. There is another house a little bit further east of this on a cul-de-sac. It seems to be very, very close to the road and I think that this distance of twenty-nine (29) feet from the front yard is well back from that location. And there is almost a fourteen (14) foot setback proposed on the east side. I realiy don't have anything to add to the application but if you have any questions, the Vangi's are here. CHAIRMAN GOEHRINGER: As you know, we don't have architectuai review, however, how is this going to blend into the existing dwelling? MS. WICKHAM: Well, they have given an awful lot of thought to that and they do want to create a roof line and a frontage, oh, I am sorry, front, that will blend into the existing house and make it look compatible and not look like it was something stuck there. CHAIRMAN GOEHRINGER: The doors on this, this is basically an addition to the house, but it is going to be used as a storage area. MS. WICKHAM: They need it as a storage area, because they want to get rid of that shed. And the doors will be on the side, or on the back. Any place. CHAIRMAN GOEHRINGER: Any place. Probably the best bet would be to put them on the back. MS. WICKHAM: Wherever they look the best, right. CHAIRMAN GOEHRINGER: Meaning the water side so that you didn't even see it. The neighbors on the east side have been spoken to, they are aware of this application. MS. WICKHAM: Yes, in fact we faxed them the application and the map. CHAIRMAN GOEHRINGER: And they don't have a particular problem with it. Okay, great. MS. WICKHAM: No. That was a .... CHAIRMAN GOEHRINGER: Loreta, yea, is that Dr. Loreta? MS. WICKHAM: Yes. Dr. Loreta and, I think you have an affidavit service in the file that we did send the map and aiso an expianation. I think I sent him a copy of a letter I sent to you. of CHAIRMAN GOEHRINGER: Now, this is a one (1) story addition. This is not to exceed what in height? Eight, ten, twelve (8, 10, 12) you got a guesstamate on it. MS. WICKHAM: An estimate would be ten (10) feet, possibly, depending on how they would have to structure the roof line. I think you can tell from the property, they are kind of concerned about how their property looks. CHAIRMAN GOEHRINGER: Well, it is a beautiful piece of property. And their house is gorgeous too. I mean... MS. WICKHAM: I mean, Mrs. Vangi has given a lot of thought to where put an extension, so it didn't impair the integrity. We do the normal cut and dry, is there anybody in the audience who would like to speak either for or against this application?
