ACTION OF THE BOARD OF APPEALS
Appeal No. 4148:
Application of CHRISTOPHER AND HEIDEMARIE GRATTAN for a
Variance to the Zoning Ordinance, Article III-A, Section
100-30A.3 for permission to construct addition (garage and
attached deck) to existing dwelling with a reduced (southerly
front yard) setback from a private right-of-way which intersects
with Horton's Lane. The subject premises is a corner lot as
defined by Section 100-13 of the Zoning Code and contains a
total lot area of 51,603 sq. ft. in this R-40 Residential Zone
District. This parcel is more particularly identified on the
Suffolk County Tax Maps as District 1000, Section 54, Block 7,
Lot 18.8 (previously part of 18.5 and 18) and is shown on the
Minor Subdivision Map of Louis Ramunni approved May 30, 1973.
Property Location: 6305 Horton's Lane, Southold, NY.
WHEREAS, a public hearing was held on February 23, 1993 and
at said hearing all those who desired to be heard were heard and
their testimony recorded (no opposition was received); and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is a parcel of land situate along the westerly
side of Horton's Lane, Southold, Town of Southold, improved with
a single-family, two-story frame house constructed during 1984
under Building Permit No. 12972;
(b) contains a total lot area of 52,200+- sq. ft.
with 156.37 ft. frontage along Horton's Lane; 315.87 ft.
frontage along a proposed private road to the south (southeast);

(c) is situated along a proposed private road to the
south which was the subject of an application under New York
Town Law, Section 280-A before the Board of Appeals July 1, 1980
(Appl. No. 2708 - Louis Ramunni);
(d) is located in the R-40 Zone District as
effectuated by the Master Plan revisions enacted January 10,
1989.
2. By this application, relief is requested to reduce the
yard setback to the south, which is technicaly front yard area
as defined in the zoning regulations, from the required 50 feet
to 45 feet for a new garage addition 22 ft. wide by 24 ft.
deep. A deck is also to be proposed maintaining the same 45 ft.
southerly (front) yard setback. The height is proposed at 19
feet, which is less than the height limitation for a principal
building.
3. It is noted that a survey lastly dated September 8,
1992 has been submitted by the owners showing the dwelling as
exists to be situated, at its closest points: 67.9 feet from
the southerly-front property line, 34.5 feet from the northerly
side property line, 82.1 feet from the easterly-front property
line, and 213.7 feet from the westerly-rear property line.
4. When subtracting the proposed width of the garage at 22
feet from the southerly setback at 67.9 feet, the difference is
45.9 feet. The amount of relief requested by this application
is permitted for this addition, being minimal at not more than a
five (5) foot reduction from the south side of the house.
5. In considering this application, the Board also finds:
(a) the benefit to the applicant is greater, as
weighed against the detriment to the health, safety, welfare of
the community;
(b) the benefit sought by the applicant is not
unreasonable;
(c) the relief is not substantial in relation to the
requirements;
(d) the relief requested will not have an adverse
effect or impact on the physical or environmental conditions in
the neighborhood or district;

(e) the relief as granted will not be adverse to the
preservation and protection of the character of the neighborhood
and the health, safety, and welfare of the community.
(f) the addition is for a garage and later a deck;
this new project is not a major activity and will not create an
increase in dwelling unit density or cause a substantial effect
on available governmental facilities;
(g) in considering all of the above factors, the
interests of justice will be served by granting the relief as
requested and further noted below.
Accordingly, on motion by Member Dinizio, seconded by
Member Wilton, it was
RESOLVED, to GRANT approval of the proposed 22 ft. wide
garage addition, as requested, with a setback from the southerly
(front) property line at not less than 45 feet.
VOTE OF THE BOARD: Ayes: Messrs. Doyen, Dinizio, Villa
Wilton and Goehringer. This resolution was duly adopted.

This Notice is issued pursuant to Part 617 of the
implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type I1 classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990}.
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)}, this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

MR. GRATTAN: I would just like to also say we may add
a deck at some time. I haven't got the money to do it at this
time. I am just going to do the garage.

MR. GRATTAN: When I was thinking about it, I said if
I have to go through this process again, I would rather not, for
the same four feet again. If I could get an application that
included that, I would be happy.

THE CHAIRMAN: I don't think you are going to be
running into that problem because you are going to be adding
onto the garage probably. You are going to be abutting the deck
to the garage? To the rear of the garage?
MR. GRATTAN: Yes, it would be the rear of the garage,
but it would be short of the 4 feet probably. It would be even
with the garage.
THE CHAIRMAN: Well, I think we can probably take care
of that tonight, all right?
MR. GRATTAN: Thank you.
THE CHAIRMAN: You're welcome. How high is the
proposed garage going to be to the ridge? Can you tell us?
MR. GRATTAN: No, I can't. It is an attached garage.
It is in the plans, the original plans.
THE CHAIRMAN: I had probably read it a long time
ago. We just have the problem writing decisions when we don't
have all that information, so what you could do, if you wouldn't
mind, just give us a call tomorrow with the height to the top of
the ridge, the additional, and that would take care of the whole
problem.
THE CLERK: It is probably less than 18 feet, right?
THE CHAIRMAN: What are you going to use

MR. GRATTAN: It could be, up to 35 feet,

THE CHAIRMAN: Only for the decision, that's all, you
are requesting a one-story. It is a two-story house, right?
THE CLERK: He doesn't want a variance for the
height. It is for the extension.
MR. GRATTAN: It is just the four feet.
THE CHAIRMAN: So we won't put it in then. I just
wanted to write it in for the decision. That's all. Mr.
Dinizto is making the decision to approve it as applied for.

Appeal No. 4148:
Application of CHRISTOPHER AND HEIDEMARIE GRATTAN for a
Variance to the Zoning Ordinance, Article III-A, Section
100-30A.3 for permission to construct addition (garage and
attached deck) to existing dwelling with a reduced (southerly
front yard) setback from a private right-of-way which intersects
with Horton's Lane. The subject premises is a corner lot as
defined by Section 100-13 of the Zoning Code and contains a
total lot area of 51,603 sq. ft. in this R-40 Residential Zone
District. This parcel is more particularly identified on the
Suffolk County Tax Maps as District 1000, Section 54, Block 7,
Lot 18.8 (previously part of 18.5 and 18) and is shown on the
Minor Subdivision Map of Louis Ramunni approved May 30, 1973.
Property Location: 6305 Horton's Lane, Southold, NY.
WHEREAS, a public hearing was held on February 23, 1993 and
at said hearing all those who desired to be heard were heard and
their testimony recorded (no opposition was received); and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is a parcel of land situate along the westerly
side of Horton's Lane, $outhold, Town of Southold, improved with
a single-family, two-story frame house constructed during 1984
under Building Permit No. 12972;
(b) contains a total lot area of 52,200+- sq. ft.
with 156.37 ft. frontage along Horton's Lane; 315.87 ft.
frontage along a proposed private road to the south (southeast);

(c) is situated along a proposed private road to the
south which was the subject of an application under New York
Town Law, Section 280-A before the Board of Appeals July 1, 1980
(Appl. No. 2708 - Louis Ramunni);
(d) is located in the R-40 Zone District as
effectuated by the Master Plan revisions enacted January 10,
1989.
2. By this application, relief is requested to reduce the
yard setback to the south, which is technicaly front yard area
as defined in the zoning regulations, from the required 50 feet
to 45 feet for a new garage addition 22 ft. wide by 24 ft.
deep. A deck is also to be proposed maintaining the same 45 ft.
southerly (front) yard setback. The height is proposed at 19
feet, which is less than the height limitation for a principal
building.
3. It is noted that a survey lastly dated September 8,
1992 has been submitted by the owners showing the dwelling as
exists to be situated, at its closest points: 67.9 feet from
the southerly-front property line, 34.5 feet from the northerly
side property line, 82.1 feet from the easterly-front property
line, and 213.7 feet from the westerly-rear property line.
4. When subtracting the proposed width of the garage at 22
feet from the southerly setback at 67.9 feet, the difference is
45.9 feet. The amount of relief requested by this application
is permitted for this addition, being minimal at not more than a
five (5) foot reduction from the south side of the house.
5. In considering this application, the Board also finds:
(a) the benefit to the applicant is greater, as
weighed against the detriment to the health, safety, welfare of
the community;
(b) the benefit sought by the applicant is not
unreasonable;
(c) the relief is not substantial in relation to the
requirements;
(d) the relief requested will not have an adverse
effect or impact on the physical or environmental conditions in
the neighborhood or district;

After investigation and inspection, the Board finds
that applicant is requesting approval of an access road,
which is presently 50-feet in width and appears to be access-
ible for four lots in the "Minor Subdivision of'Louis Ramunni"
granted by the Planning Board May 30, 1973. The Board feels
that applicant's request for approval of access is not unreason-'
able and certainly agree to the granting.thereof.
The Board finds that the circumstances present in this
case are unique, and that strict application of the law
would produce practical difficulties or unnecessary hardship.
The Board believes that the granting of a variance in this
case will not change the character of the neighborhood and
will. observe the spirit of the ordinance.
On motion by Mr. Grigonis, seconded by Mr. Douglass, it

pursuant to New York Town Law Section 280A, SUBJECT TO THE
FOLLOWING CONDITIONS:
(1) That such access road have a Width ofnot less tkan
50 feet, and shall be cleared of all trees, brush and other
obstructions to a width of 15 feet.

(2) That s~lch access road be improved 15-feet wide in
EITHER of the following methods:
(a) Surfaced with a minimum depth of 4 inches of
packed 3/4-inch stone blend so as to afford access for emer-
gency and other vehicles. Such stone blend may be either
applied to the ground surface and shaped, or the surface may
be excavated to permit the application of packed blend to a
depth of 4 inches; OR
(b) Top soil shall be removed to a depth of 8 inches
and then filled with 8 inches of good-grade stone and sand
bank run. The surface shall then be covered with a layer of
2 to 4 inches of 3/4 stone blend, or in the alternative oiled
with a minimum of 4/i0ths of a gallon of road oil per square yard.
(3) Where the terrain of the land over which such access
road is such that drainage problems may occur, applicant shall
be required to construct drainage facilities to correct same as
may be recommended by the Town Building Inspector or Town
Engineer.
(4) Ail work required as hereinbefore set~ f~rth shall be
performed under the supervision of the Town Building Inspector
and no building permits or certificates of occupancy shall be
i~sued until same has been certified by the Town Building
Inspector that such access road has been constructed in accord-
ance herein.
(5) The Board of Appeals may in its discretion make ~ny
reasonable exception as it deems appropriate to the subject
circumstances, by formal resolution and proper notification
to applicant herein.
