The issuance of an Administrative Permit allows for the operations as indicated on the project plan submitted by James F. Haag, Jr., received on March 23, 2016 and stamped approved on April 20, 2016. § 275-5 Permit procedures. (i) Cutting of common reed (Phragmites australis) to within 12 inches of the soil surface landward of the wetland boundary. This does not include mowing to ground level. Special Conditions: Do not disturb native vegetation during the hand cutting of Common Reed (Phragmites australis), including but not limited to; Eastern Red Cedar(Juniperus virginiana), Northern Bayberry (Myrica pensylvanica), Marsh Elder(Iva frutescens), and Groundsel Bush (Baccharis halimfolia). The approved operations must be commenced within two (2) years from the date of the resolution. It is much appreciated. • I wanted to let you know the action I have taken on a complaint I received February 20 from Constable O'Leary and my next steps given my heavy work travel schedule. ( I told him I had a heavy work travel schedule over the next two months so he extended my summons deadline until April 25). • I explained to the Constable that we had removed some dead or damaged trees at the very end of our property, the corner of Orchard Street and Narrow River Road in Orient. This damage was caused by vandalism and by Hurricane Sandy. The vandalism was handled by the police some years ago after a local youth drove his car through that area of the property and knocked down trees and brush. Once the person was identified, it was suggested by the police that we should not press charges as this was a troubled teen....so we did not. We also did not clean up the damage at the time. Hurricane Sandy caused further substantial damage to that end of the property. • We decided to pull a few obviously dead or damaged trees out this January so the area could be rejuvenated and so we did not step on any new growth in the spring. We did not know we needed a permit for this. If we had known we would have asked for one right after Sandy. My apologies for that and now we are most aware.There is no further work planned. • The Constable suggested that I call The Trustees office the week following our meeting February 20 and explain what had happened. • I called Mr. Bredemeyer right way that Monday as I was quite concerned that I do the right thing and wanted to follow up quickly. We spoke later in the day. • I explained the situation to Mr. Bredemeyer and he suggested that I file for a wetlands permit and attach a survey showing where any trees were pulled. He also kindly suggested that I identify the types of damaged trees that were taken out as that might help when we meet at the hearing. I mentioned that I will return from three domestic and overseas business trips on March 22 and that I would stop by as soon as I return to complete the application. I am intending on doing that March 23. I will personally pick it up and return it the same day, if possible. • I followed up that call today and spoke with Diane in the Trustees office since I was curious when an April hearing might be scheduled as I wanted to free up my schedule to be available. She suggested to call the Town Attorney's office and I did and spoke with Mr. Kiely. • I explained the above situation to him and he understood my travel commitments but wanted to make sure the Trustees knew what was delaying my response as far as filing for the permit. I told him I had mentioned my timing to Mr. Bredemeyer-- but he suggested I put this in writing so the Trustees knew that I was responding to everyone the right way and in a very timely manner. • Indeed, I am doing my very best here every step of the way and please be assured this is uppermost in my mind. I always try and do the right thing and please know that this is a major priority for me. • If there is a date or timeframe I should set aside in April for a hearing after the permit is submitted March 23, please let me know. We spoke later in the day. • I explained the situation to Mr. Bredemeyer and he suggested that I file for a wetlands permit and attach a survey showing where any trees were pulled. He also kindly suggested that I identify the types of damaged trees that were taken out as that might help when we meet at the hearing. I mentioned that I will return from three domestic and overseas business trips on March 22 and that'I would stop by as soon as I return to complete the application. I am intending on doing that March 23. I will personally pick it up and return it the same day, if possible. • I followed up that call today and spoke with Diane in the Trustees office since I was curious when an April hearing might be scheduled as I wanted to free up my schedule to be available. She suggested to call the Town Attorney's office and I did and spoke with Mr, Kiely. - • I explained the above situation to him and he understood my travel commitments but wanted to make sure the Trustees knew what was delaying my response as far as filing for the permit. I told him I had mentioned my timing to Mr. Bredemeyer-- but he suggested I put this in writing so the,Trustees knew that I was responding to everyone the right way and in a very timely manner. • Indeed, I am doing my very best here every step of the way and please be assured this is uppermost in my mind.
