LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 21,455 square foot parcel located in an R- 40 zone. The parcel has an irregular shape. There is 60 feet of frontage on Village Lane. The parcel runs 92.36 feet on the North side then turns North and runs 16.16 feet on the West side and then turns and runs an additional 85.57 feet on the North side. The parcel runs 194.38 feet on the East side. The parcel runs 79.43 feet on the South side, then turns and runs 90.49 feet on the West side and finally turns and runs 95.65 feet on the South side. The parcel is improved with a 2-story frame house, an in-ground pool, an accessory garage, and a second accessory structure labeled "building" on the survey, all as shown on a survey by John Metzger L.L.S. dated May 13, 2015 and last updated January 28,2015. BASIS OF APPLICATION: Request for Variance(s)from Sections 280-124 and the Building inspector's February 17, 2016 Notice of Disapproval based on an application for building permit to construct screened porch addition to existing single family dwelling at; 1)less than the code required side yard setback of 15 feet,2) following proposed construction existing accessory garage will be located in other than code required rear yard. RELIEF REQUESTED: The applicant requests a variances to build a screened porch which will result in a side yard setback of 7.2 feet and which will place the existing accessory garage, currently located in conforming rear yard, partially in a non-conforming side yard. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 7,2015 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 of 3—April 21,2016 ZBA#6942—Kane SCTM#1000-25-2-4.13 1. Town Law §267-b(3)(b)(1). Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The current side yard setback for the south side of the property is 7.8 feet. The resulting side yard setback created by the covered porch is not a significant increase in the existing non-conformity. The proposed addition will not be visible from the street and is completely screened from the adjacent neighbor by an existing 6 foot high stockade fence. The location of the existing garage, which pre- dates zoning, will not be altered by the porch addition, but it will become partially located in a side yard without any adverse impacts. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The existing house has a non-conforming side yard setback. The accessory garage is currently in a conforming rear yard but the proposed porch addition on the back of the dwelling will subsequently render the garage partially in a side yard.Therefore,variances are required. 3. Town Law $267-b(3)(b)(3). The variance(s) granted herein for the side yard setback is mathematically substantial, representing 52% relief from the code. The variance granted for the partially non-conforming location for the garage is mathematically substantial representing 100% relief from the code. However, the side yard non- conformity already exists and the proposed additions and alterations will not change the location of the existing accessory garage. 4. Town Law $267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance(s) as applied for, and shown on the Architectural plans by Mark Schwartz, Architect and the survey by John Metzger L.L.S. dated May 13, 2015 and last updated January 28, 2015. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Page 3 of 3—April 21,2016 ZBA#6942—Kane SCTM#1000-25-2-4.13 Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The Board determination of April 21,2016 granted the construction of this screened-in porch addition reducing the side yard setback to 7.2 feet which is less than the code required of 15 feet. In your letter you explain that the owners of the premises were advised by their contractor to install windows and convert the porch into habitable conditioned space to be used as a family room. This decision came about because a first floor front room was converted into a bedroom for one of their children in what-you termed as a small house. I reviewed your letter and corresponding file,and have determined that it is the Board's long standing practice, that the proposed change of the"screened in"unconditioned porch to conditioned habitable space is not de i minimus in•nature. Should you wish to pursue an approval for the conditioned habitable living area,you will need variance relief with a new application and a public hearing. Mark Schwartz, cc:d here, asked me to pass along an explanation regarding the variance issue that is related to the rear porch at our house. I've attached as a separate letter, but here's the body of it: "In 2015-2016 we renovated and restored our house at 335 Village Lane in Orient. At the time, we also planned on adding a screened-in porch to the existing structure,for which we received a variance. Our contractor at the time suggested adding windows and heat to the porch,since the house is small, and we needed to use the 1st floor front room of the existing structure as a bedroom for one of our children. This way we could use the porch for a longer duration as a family room, while we also had our bedroom on the 1St floor, to be close to our son. Not reahz'-lng this was�n-occ ered�y th�orrgirrafvarranze�rre agreed:Had vve known,vve would-have-obtained-the-correct approvals. Fast forward to the present, we've got a signed contract for the sale of our house to new owners who are looking to close on or around Friday July 16tH Unaware that we might need an amended variance, we discovered this when John the town inspector visited for a final inspection for the original CO, which was re-opened to get final approval a few weeks ago. He asked that we re-submit amended plans to reflect the windows, that that would be the only issue. But once we submitted the amended plans, the Building Dept then asked that we contact the Zoning Board-re:obtaining deminimus approval, which is why we are asking for your consideration here.
