Variance to the Zoning Ordinance, Article XXIII, Section 100-239. 4A for permission to locate dwelling structure with a reduced setback from the bank or bluff of the L.I. Sound. Property Location: 58235 C.R. 48 , Greenport, NY; County Tax Map Parcel No. 1000-44-2-11. This parcel is nonconforming at 5,775 sq. ft. in this R-40 Zone District. WHEREAS, this proposed dwelling is proposed seaward of the Coastal Zone Management boundary which is restricted, and documentation required concerning the Coastal Zone Management Agency reviews of the Town of Southold (Office of the Trustees) was submitted on June 10, 1993 ; WHEREAS, after due notice and publication as required by law, a public hearing on this setback application was held on July 22, 1993 ; and WHEREAS, at said hearing those who desired to be heard were . heard and their testimony recorded (no opposition was submitted) ; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application; and WHEREAS, the Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of fact: 1. The premises which is the subject of this application is identified on the County Tax Maps as Lot 11, Block 2, Section 44, District, and contains a total lot vacant land area of 4,050 square feet, a portion of which consists of low beach areas, subject to flooding, and the remainder with variable contours shown on the March 23 , 1993 survey map to be between 6 feet and 11 feet above mean sea level. The dimensions of the lot are as follow: (a) the frontage along Middle Road is shown to be 50. 09 feet, (b) width at the low bank near the ordinary highwater Page 2 - Appl. No. 060 • Decision Rendered July 22, 1993 Application of SUSAN TASKER mark at 50.37 feet as observed by the surveyor February 22, 1991 (c) the average depth of the property is 81+- feet. It is also noted that the premises is in the V-9 Flood Zone (min. el. 13 feet above mean sea level for utility area at lowest floor elevation) . 3 . Appellant is requesting permission to construct a dwelling with a livable floor area of 550 square feet ( 25 ft. wide by 22 ft. deep) , plus an open, unenclosed deck at the north side, all within a proposed footprint of 25 ft. wide, 32 feet dep at the westerly side and 27 feet wide at the easterly side. The proposed -new dwelling with open deck will meet the minimum side yard requirements of 10 feet and 15 feet on both sides for a total of 25 feet, and 20 feet front yard setback (average established frontyard setback appears to be less, at 16+- feet) . 4. Article XXIV, . Section 100-239. 4 of the zoning code provides for a setback at not less than 100 feet feet the L.I. Sound bank or bluff, or 100 feet from the ordinary highwater line, whichever is closer. 5. The percentage of relief requested in this application is 62% of the requirement, for a 38 ft. setback to the ordinary highwater (tie line) . A proposed revetment ( stone retaining wall) is proposed between the bulkhead to the west and the stone retaining wall to the east, for the full length of this property along the bank. Details for this retaining wall and proposed setbacks are all shown on the May 18, 1993 survey (as amended) prepared by Roderick VanTuyl, P.C. 6. For the record it is noted that the Town Trustees have issued a Coastal Zone Management Permit and Variance under Permit No. 44-2-11 and Wetlands Permit No. 4167 issued May 26, 1993 , and the Suffolk County Department of Health Services permit under No. 92-SO-82. 7. In considering this application, the Board also finds and determines " (a) the neighboring dwellings on each side of the subject parcel have similar setbacks to that proposed by this application and the setback relief willOt ave an adverse effect p.ia ;3 or impact on the physical or environmental conditions in the neighborhood or district; (b) the uniqueness of the property with its size and character of the property lend to the difficulties in this proposal; Page 3 - Appl. No. 60 • Decision Rendered Any 22, 1993 Application of SUSAN TASKER (c) the percentage of relief requested for a reduction of 62% of the requirements is substantial - although not personal to the landowner; (d) the variance requested is the minimum necessary to afford relief and there is no alternative available due to the limited size of the property; (e) the grant of the relief requested will not afford a benefit greater to the applicant and which will not be detrimental to the health, safety, or welfare of the community; and it will provide a benefit for the property owner to use his land for a zoning use allowable in this R-40 Low-Density Residential Zone District; (f) the conditions established by all agency permits and approvals in this project must carefully and faithfully be followed by the property owner and her agents in order to prevent runoff or other discharge onto neighboring lands and to prevent any possible disturbance to the physical or environmental conditions in this location; (g) the- appellant' s requests are not unreasonable in light of the limited upland area available for a residence, and the difficulties claimed are related to the land rather than a personal hardship of the property owner; (h) in light of all the above, the interests of justice will best be served by granting a variance, as further noted below. Accordingly, on motion by Member Dinizio, seconded by Member Wilton, it was RESOLVED, to GRANT the relief requested under Appeal No. 4160 in the matter of the Application of SUSAN TASKER for an insufficient setback from the edge of the tie line of the ordinary highwater mark of the L.I . Sound, SUBJECT TO THE FOLLOWING CONDITIONS: 1) Minimum side yard setback for all construction at not less than ten ( 10) feet from the westerly side property line; 2) The westerly sideyard must remain open a distance of 10 feet at all times, without the construction of steps or any type of obstructions; 3 ) Minimum total sideyards for dwelling construction shall not be less than 25 feet total for both sides; S Page 4 - Appl. No. 060 Decision Rendered July 22, 1993 Application of SUSAN TASKER 4) Minimum setback of 38 feet for the enclosed construction (dwelling/livable floor area) , and open deck addition not closer than 8 feet to the edge of proposed revetment and not closer than 32 feet to the ordinary highwater mark, all as shown on the survey amended May 18, 1993 submitted for consideration under this application. 5) No building construction activities will be permitted until compliance with all other agency approvals and issuance of permits by the Southold Town Building Inspector' s Office, N.Y.S. Department of Environmental Conservation, etc. No other construction activities until all agency permits applicable are in full force and effect. Vote of the Board: Ayes: Messrs. Some things can be in only one spot. We have the house that is shown, is of very modest dimensions . It is in a location which is similar to those not only adjacent, but in the general vicinity with regard to both their setback from the southerly property line that is facing on Middle Road, and also a similar setback from the water. We do propose to protect the property with a stone revetment which was the recommendation of the Southold Trustees rather than a bulkhead, and that was approved. That would go across from adjacent bulkhead to adjacent stone retaining wall on the east to stabilize that line. THE CHAIRMAN: Is that an encompassed rip-rap type of-- MR HAJE: It will be rip-rap, yes . Following that, the property will be backfilled to even it out with the upland grass area that is there now; and upon -that combined property will be built the house. THE CHAIRMAN: On pilings. MR. These --of course, the easterly sideyard is the, has the greatest width in reference to work, but of course that is where most of the cesspool and septic tank area is-- . To what degree will these be buried? Will heavy equipment be able to traverse these or this is probably going to be a shallow pool system anyway, right? MR. HAJE: Well, it doesn't have to be that shallow because we do have some elevation there, so we don't have to go to the shallowest (one word inaudible) pool. An application for permits under Town Code Chapter 37 and 97 was received on September 8, 1992. 2. Prior to the SEQRA determination the applicant modified the plans to reflect a house on pilings eliminating the need for a variance for a house on a permanent foundation. 4. On March 18, 1993 the Southold Trustees issued a conditioned negative declaration for this proposed action which is an unlisted action pursuant to NYCPR Part 617 and Town Code Chapter 44. 5. On April 29, 1993 a public hearing was held pursuant to the Coastal Erosion Hazard Area Variance requested as herein outlined. No one spoke in opposition to the Variance requested. The comments of the Conservation Advisory Council were noted for the record. 6. On April 29, 1993 the Coastal Erosion Variance request was approved subject to conditions and the determinations of the Trustees after a Town Wetland Permit public hearing. 7. On May 26, 1993 a public hearing pursuant to the Town Wetland Ordinance was held at which time persons spoke in opposition to the wetland permit. The comments of the Conservation Advisory Council were noted for the record. DETERMINATION The aforementioned variances requested are approved subject to the conditions of a Coastal Erosion Hazard Area Permit as; 1. No reasonable prudent alternative site or method is available. 2. The adverse environmental impacts anticipated have been considered under the SEQRA review and are incorporated into the special conditions. 3. The variances requested are the minimum necessary to overcome the practical difficulties of siting a house in this location. 4. The proposal is reasonably safe from flood and erosion damage the lot in question not having sustained any measurable loss due to major coastal storms of December 11, 19993 and March 13, 1993 . 5. There are no public funds utilized for the project SPECIAL CONDITIONS OF THE COASTAL EROSION AND WETLAND PERMITS: The following conditions are equally in effect for the Town Wetland and Coastal Erosion Hazard Area Variance permits. 1. A licensed survey consistent with the plan of En-Consultants dated May 13, 1993 shall be submitted to the Trustees office prior to permit issuance. (Licensed survey date May 18 , 1993 received May 26, 1993 ) . 2. This permit shall expire two years from the issuance date. 3 . All construction shall comply with the requirements of the Federal Emergency Management Agency for the V-9 (EL 13 ' 0" ) flood zone. The house shall be constructed on open timber or concrete pilings properly jetted or driven into the ground. 4. The aforesaid pilings shall be designed according to accepted engineering practice and constructed such that they have a 30 year useful life expectancy. 5. There shall be no conventional foundation or concrete slab anywhere on this lot including but not limited to house steps and walkways. 6. Retaining walls and the concrete elements required by the sanitary system shall be the minimum necessary for a Suffolk County Department of Health approval. 7. All deck construction shall be on open pilings and be of wood. 8. The site shall employ native salt tolerant vegetation to the maximum extend practical. 9. Drywells shall be provided for roof-runoff. 10. The driveway shall be of a pervious surface. 11. All provisions of your Tidal Wetlands ECL permit are equally in effect for this permit, the more stringent or protective interpretations prevailing. 12. Revetment employing 1 1/2 to 2 ton cap stone shall be the only acceptable erosion control structure for this site. 13 . Native unconsolidated beach materials up to a depth of 2 feet on the site which might otherwise become entombed by upland derived fill are to be removed and stockpiled for use to nourish the beach in front of the revetment and bulkheads of the adjoining neighbors. No such stockpiled material shall leave the site or be used under the revetment. 14. Construction shall be of continuous operation. 15. Two inspections shall be required: The first to confirm that the beach materials are being saved as per condition #13 , the second after final grading has been completed. 16.
