Upon application of SALVATORE VINDIGNI. Variance to the
Zoning Ordinance, Article IIIA, Section 100-30A.3 for permission
to construct addition whichwill exceed the 20% lot coverage
limitation. Location of Property: 1440 Gillette Drive, East
Marion, NY; County Tax Map District 1000, Section 38, Block 2,
Lot 15; also referred to as Lot No. 19 on the Map of Marion
Manor filed March 18, 1953 in the Suffolk County Clerk's
Office. This property is located in the R~40 Low-Density
Residential Zone District and has a total lot area of 10,000 sq.
ft.
WHEREAS, a public hearing was held and concluded on
December 8, 1993; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning and
the surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
1. This application is for a variance from the lot
coverage requirements of the zoning code limitation at twenty
(20%) percent of the total lot area.
2. Proposed in this project is a fully enclosed addition
of 410 square feet, dimensions for which are 12 feet deep by 31
feet long, exclusive of step area which may be permitted as per
Section 100-230C.
3. The Board finds: ~
(a) the circumstances are unique t6~the~property'
which is due to its size of 10,000 square feet, as approved by
the Southold Town Planning Board, (ref: Map of Marion Manor,
Lot No~ 19);

(d) there is no other method feasible for appellants
to pursue other than a variance;
(e) the benefit, when weighed,
applicant and is the minimum necessary;
is greater to
(f) the relief requested will not create an
undesirable change in the character of the neighborhood or a
detriment to nearby properties by the grant of the variance
since the addition is in line with the established rear yard
setback of the existing dwelling;
(g) the proposed variance will not have an adverse
effect or impact on the physical or environmental conditions in
the neighborhood or district since there are no sensitive
wetland areas in close proximity and there is no plan to
increase use density on this property;
(h) in view of all the above factors, the interests
of justice will be served by granting the relief requested for
an additional 410 square feet, plus if necessary a step area of
up to 60 sq. ft.
Accordingly', on motion by Member Dinizio, seconded by
Chairman Goehringer, it was
RESOLVED to GRANT the variance for a fully enclosed 410 sq.
ft. addition to dwelling (for living area or porch area as may
be needed) under Appeal No. 4205.
Vote of the Board: Ayes: Messrs. Goehringer, Dinizio,
Doyen, Villa and Wilton. This resolution was duly adopted.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, that the following
public hearings will be held by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold,
New York 11971, on WEDNESDAY, DECEMBER 8, 1993 commencing at
the times specified below:
1. 7:32 p.m. Appl. No. 4202 - ROBERT AND JACQUELYN
OBERLIN. Variance to the Zoning Ordinance, Article IIIA,
Section 100-30A.4 <100-33> for approval of an existing accessory
utility storage shed which is located in the southerly front
yard area. The subject premises is not a corner lot but fronts
along two streets. This property technically does not have an
established "rear yard" defined by the code. Location of
Property: 805 Oak Avenue, Goose Bay Estates, Southold, NY;
County Tax Map District 1000, Section 77, Block 2, Lot 20.1.
The subject premises is located in the R-40 Zone and contains an
area of 19,200+- square feet.

in existing building and proposed building. The site plan shows
that the property is situated along the south side of C.R. 48,
Cutchogue, NY, is zoned A-C Agricultural-conservation and is
identified on the Suffolk County Tax Maps as District 1000,
Section 96, Block 4, Lot 4.3.

Sea-Land Engineers dated May 15, 1986, indicating the two-story
structure with a two-car garage attached. It is not a
structure, it is a dwelling. The nature of this construction is
penned in, which is an area in the rear of the dwelling and
squaring off, and I have a copy of the Suffolk County Tax Map
indicating this and surrounding properties

MR. HALLOCK: My name is Matthew Hallock, and I will
be the contractor if the job is approved.
THE CHAIRMAN: Okay. The nature of the construction
is what? Is it going to be a complete addition? Because one of
the members came back and said that a portion of it is going to
be a deck area, and then it will be partially'enclosed.
MR. HALLOCK: Yeah, we have a roofed-over area that is
proposed with screens. The screens have not been decided upon
as to whether or not they will be installed at the time of the
project, and one thing else that we did not mention on it that
we would like to ask for --is the possibility of closing that
whole area in with windows at some time in the future if they so
decide to do that.
THE CHAIRMAN: So, in other words, it is going to be a
total addition? There is no portion of it that maybe for a
little or a short period of time--
MR. HALLOCK (interposing): That area will be covered
with deck initially, and the roofed-over structure will be put
on with posts. That would be the definite initial step; and, as
of now, the screens would be put in. That would be the most
likely plan for now, as far as filling in between the posts; and
in the future, there would be a possible-- They would like to
have approval for the possibility to put in solid panels if they
decided tu close it in completsly.

THE CHAIRMAN: Okay, it is an addition to the building
anyway. Unless it was strictly a deck, we would say that that
was the situation. We would ask for it not to be roofed; but
you are asking for something that is going to be roofed anyway,
or a portion of it. So we are really asking for an addition,
no matter how you slice it. Okay, does anybody have any
questions of this gentleman, Bob?
MEMBER VILLA: Out of curiosity, I am trying to put it
together in my mind -- The proposed new deck, that is going to
be between the existing house that sticks out, and this new
piece that is going to be screened in --
MR. HALLOCK: The deck will go underneath that new
area as well. There is nothing there.
MEMBER VILLA: It is going to be wood deck?
MR. HALLOCK: That's right. As of now, that is a wood
deck that will go there, all 31 feet, I believe.

Application of WAYNE L. MAZZAFERRO for a Variance to the
Zoning Ordinance, Article XXIV, Section 100-244, and Article
III-A, Section 100-30A.3 for permission for approval of existing
swimmingpool with deck areas which will have an insufficient
rearyard setback when attached by a raised deck to the rear of
the existing dwelling. Lot area of premises is nonconforming at
10,000 sq. ft. in this R-40 Zone District. Location of

h~-IEREAS, a public hearing was held and concluded on
April 13, 1989 in the Matter of the Application of WAYNE L.
MAZZAFERRO under Appeal No. 3837; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the west side
of Gillette Drive in the Hamlet of East Marion, Town of
Southold, and is identified on the Suffolk County Tax Maps as
District 1000, Section 038, Block 2, Parcel 17.
2. The subject premises contains a total lot area of
10,000 sq. ft., road frontage of 100.0 feet and lot depth of
100.0 feet, as more particularly shown on the survey map
prepared by Roderick VanTuyl, P.C. August 4, 1978.

3. The subject parcel is improved with a single-family,
1-1/2-story frame house, and inground swimmingpool with decks
and fence enclosure constructed under Building Permit No. 16728Z
(issued February 5, 1988).
4. By this application, appellant requests a variance for
approval of the construction of step area between the existing
pool decks and existing dwelling structure, thereby changing the
status of the entire pool construction from accessory to part of
the principal structure (see Notice of Disapproval from Building
Inspector issued March 3, 1989).
5. This parcel and the immediately surrounding parcels are
located in the R-40 Zone District with nonconforming lot areas.
6. For the record it is noted that the subject parcel is
known and referred to as Lot No. 17 on the filed Subdivision Map
of "Marion Manor," which is and has been included on the list of
"exceptions" pertaining to lot size.
7. Article III-A, Section 100-32-A and Column ii of the
Bulk Schedule, of the Zoning Code requires a minimum rear yard
setback at 50 feet for a principal structure. Accessory
structures are permitted under Section 100-33 to be located in
the rear yard with a minimum setback from all property lines at
not less than three feet.
8. Article XXIV, Section 100-244B permits a rearyard
reduction for a principal structure to 35 feet for lots
containing less than 20,000 sq. ft. in area, which of course is
applicable in this case since this lot contains a lot area of
10,000 sq. ft. and there is no question that the lot has been
held in single and separate ownership as required by statute.
9. By Building Permit No. 16728Z, issued February 5, 1988,
approval was granted by the Building Department authorizing the
construction of steps leading to the pool area, authorizing pool
construction and fence enclosure. The diagram submitted on the
building permit application does indicate these proposed
structures, all detached from the dwelling. All have been
constructed and are detached from the dwelling; however, the
bottom step, although not physically attached, was built very
closely to the raised deck around the pool. This type of
construction is not unusual in the Town of Southold.

Decision Rendered April 13, 1989
10. It is the opinion of the Board that the difference
between an accessory structure and an addition to the principal
structure is the separation between the steps and the pool deck
areas. The alternative to distinctly separate the two
structures is not feasible considering all the above facts and
events.
11. In considering this application, the Board also finds
and determines:
(a) the relief to allow the bottom step to remain as
constructed is not unreasonable under the circumstances;
(b) the variance requested is uniquely related to the
property and the circumstances under the application for the
building permit;
(c) the variance requested is the minimal necessary
to afford relief and is not substantial;
(d) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience, or order of the
town, or be adverse to neighboring properties;
(e) in view of all the above, the interests of
justice will be Served by granting the relief, as requested.
On motion by Mr. Dinizio, seconded by Mr. Sawicki, it was
RESOLVED, to GRANT the relief requested for construction of
steps leading to deck between the rear of the existing dwelling
structure and the existing swimmingpool construction, as applied
in the Matter of WAYNE L. MAZZAFERRO under Appl. No. 3837.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis, Sawicki and Dinizio. This resolution was duly adopted.

New York, for a variance in accordance with the Zoning Ordinance,
Article ~I~, Section 307, for permission to construct addition to
existing dwelling with lnsuffficient side yard area. Location of
property: west side of Gillette Drive, East Marion, New York,
-~ubdivision Map of Marion Manor, Lo~ ~ 19. Fee paid $5.00.
The Chairman opened the hearing by reading the application
for a variance, legal notice of heaving, affidavit attosting to
its publication in the official newspapers, and notice to the
applicant.

THE CHAIRMAN: The proposed addition in on the south side of
the house located on Gillette Drive. The lot is one on the
approved filed map which is part of the zoning ordinance, which
makes it a special case. Ordinarily, the Building Inspector can
grant but where the lot frontage is 100 feet, it has to go before
this Board. The proposal is to add 10 feet which will reduce
the side yard on the south side to 12 feet. You already have a
ten foot side yard on the north side of the house.

After investigation and inspection the Board finds that the
applicant requests permission to construct addition to existing
dwelling with insufficient side yard a~ea located west side of
Gillette Drive, East Marion, New ~ork. The Board finds that the
applicant requires additional space and that this space is
permitted under the present zoning ordinance.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship is unique and would not be shared by all properties
alike in the immediate vicinity of this property and in the same
use distriotl and the variance will not change the character of
the neighborhood and will observe the spirit of the Ordinance.
