do es hereby (rant and release unto the parties of the second part,
their heirs and assigns forever, all that certain tract or parcel of
land situate, lying and being at Mattituck, Town of Southold, Suffolk
County, New York, bounded and described as follows:
BEGINNING at a point in the westerly line of Maryls Road.,
which point is distant 150.02 feet from the intersection of the
northerly line of Pike Street and the westerly line of Maryls Road;
running thence from said point of beginning along land now or formerly
of Edward and Tessie Berkoski and lands of the party of the first part
a distance of 173.05 feet to other lands of the party of the first part
thence running along other lands of the party of the first part in a
generally northerly direction a distance of 50 feet to a point and othe
lands of the party of the first part; thence running in a generally
easterly direction along other lands of the party of the first part a
distance of 173.92 feet to the westerly line of Mary' s Road; thence
running in a generally southerly direction along the westerly line of
Maryts_Road-..a_distance of 50.01 feet to the point or place of beginning
TOGETIMR with all the right, title and interest of the party
of the first part of, in and to Mary' s Road adjacent to said premises
to the center line thereof.
AND the parties of the second part, for their heirs and
assigns, in consideration of this conveyance, do covenant with the (1)
her heirs and assigns, that the said parties of the second part, their
heirs and assigns, shall not at any time hereafter erect or cause or
procure or permit or suffer to be erected upon said premises, or any
part thereof, any building other than two private dwellings for the
use and occupancy of not more than one family each and two private
garages. Any dwelling erected thereon shall cost not less than 1k3000.
NO nuisance shall be created or allowed on the said premises
and no use shall be made thereof w1nich shall be dangerous to the health
of or offensive to the senses of sight or smell of the (1) or her heirs
or assigns, as o,�rners of the premises adjoining on the west and the
premises on the northerly side of Pike Street.
