Application of MARY P. FURLONG and others for a Variance
to the Zoning Ordinance, Article IIIA, Section 100-30A.3 for
approval of a porch addition with an insufficient rear yard (as
built in 1966). Property Location: 1745 Nakomis Road at
Laughing Waters, Southold, NY; County Tax Map District 1000,
Section 78, Block 3, Lot 35. This parcel is preexisting with
nonconformities as to total lot area in this R-40 Zone District.
WHEREAS, a public hearing was held on February 23, 1993 and
at said hearing all those who desired to be heard were heard and
their testimony recorded (no opposition was received); and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, the present use and zone
district, and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question:
(a) is a parcel of land situate along the easterly
side of a Nokomis Road, approximately 700 feet south of
Hiawathas Path, Laughing Waters, Southold;
(b) is improved with a single-family dwelling
structure situated 44.5+- feet from the front property line,
24.5 feet from the rear property line (including the subject
porch), and width sideyards at 21+- feet and 29+- feet, at its
closest points.
(c) is located in the R-40 Zone District as adopted
in the Master Plan revisions dated January 10, 1989.
2. By this application, appellants have requested approval
of an enclosed porch (21 x 16+-) attached to the rear of the
existing dwelling. The dwelling was built between 1964 and

1966, and the porch shortly thereafter (1968+-). The porch does
not meet today's requirements for a 35-ft. rear yard setback.
The applicant states that the porch was built in 1968 and she
believes no building permit was obtained for the porch since it
was built on an already existing concrete patio by adding cement
blocks around it and then screens. Copies of the builder's
contract and specifications have been submitted for considera-
tion.
3. Today's setback requirement, under Article XXIV,
Section 100-244B requires a minimum rear yard setback at 35
feet. In 1968, the rearyard requirement was 25 feet as
provided by the Zoning Code in effect in 1968 (see Section 308),
and which also provided for further relief for a 15 feet setback
(copy of 1968 zoning regulations have been made a part of this
file for reference).
4. The amount of relief requested by this application is a
reduction from the 1968 requirements of one-half (1/2) foot, and
15.5 feet reduction from today's requirements, for a 24.5 ft.
rear yard setback.
5. The need for this relief would not be alleviated if the
subject porch construction were to be located in any other
manner on the premises.
6. In considering this application, the Board also finds:
(a) that the porch has not been and is not adversely
impacting the essential character of the neighborhood;
(b) that the relief requested will not have an
adverse effect or impact on the physical or environmental
conditions in the neighborhood or district;
(c) that the construction under consideration
involves an porch (enclosed patio) as exists and shown on the
September 18, 1992 survey prepared by Roderick VanTuyl, P.C. and
the grant this variance does not cause or create an increase in
any dwelling unit density pertaining to this property or cause a
substantial effect on available governmental facilities;
(d) that there is no other alternative feasible for
appellants to pursue;
(e) that the benefit to the applicant will not be
detrimental or cause any adverse effects to the health, safety
and welfare of the community;

ATTACHMENT FOR REASON OF APPEAL No 1.
The structure in question is a porch built about early 1968 (soon after the
original house was completed, see Certificate of occupancy #Z 2522 dated 9/6f66)
by the then owner who thought that no C/O was required. The "porch" was built
on the existing concrete patio that was constructed when the house was built.
Attached hereto and made a part hereof is an Affidavit of Guido P Molino and
Elizabeth C. Molino who built the original house and porch in 1966 & 1968.
It was in their belief that the law in 1968 did not require a C/O for what they
did.
Attached hereto and made a part hereof is the building contract by the Molinos
and their contractor Baker & Fickeissen indicating that the concrete patio is
included in the 1966 plans.
Applicant had to close (purchase the premises) when she did without the C/O or
her mortgage commitment would have expired. She also needed a place to live and
could not affprd not purchasing the property. The issue of the C/O only came
when applicant's attorney obtained a new survey (copies attached) which showed
the insufficient rear gard set back.
If the application is denied, applicant would suffer substantial hardship in that
the value of the property would be severely diminished. She would lose a major
living area of the house (good weather permitting) and be in violation of her
mortgage.
It should be noted that in granting this variance:
a) no undesirable change will be produced in the character of the
neighborhood or be a detriment to nearby properties.
b) there is no other equitable method of achieving the relief requested
other than an area variance
c) the requested variance is not substantial. The porch has existed for
at least 25 years.
d) the variance will have no adverse effect or impact on the physical
or environmental conditions in the neighborhood or district.
e) the condition was not a self created hardship by the applicant or
prior owner in that at the time it was created,the then owners thought they
were complying with the law, had a reputable local builder do the work and expec-
ted it to be in accordance with the law as it existed then (1968).

THE CHAIRMAN: The next appeal is in behalf of Mary P.
Furlong and others for a variance to the Zoning Ordinance. It
is Appeal No. 4155. I have a copy of the survey dated September
28, 1992, indicating the porch, which is approximately 24 1/2
feet from the rear property line, and has embodied within the
legal notice, which it was built in 1966. And I have a copy of
the Suffolk County Tax Map indicating this and surrounding

I can see, a very easy application. That is so

MR. BRUER: Yes, for a change. I think the
application pretty well spelled out the situation that exists
here. Before I forget, with respect to the neighbors, we sent
out notices to all the neighbors. I have here a consent from
Mr. Concensio.
THE CHAIRMAN: Thank you.
MR. BRUER: I spoke to Louis Forer (phonetic, no
spelling supplied record), who is really Laughing Waters, too,
and he said he had no objections, and I did not hear from the
other two neighbors.
THE CHAIRMAN: Okay.
MR. BRUER: What you have is a house that was built in
1966 by a local builder. It was Baker and Fickeissen. Soon
thereafter they constructed the porch on top of the concrete
patio which existed with the original house. It is concrete I
believe. It is seeded I believe, it is screened around it, and
it is attached obviously to the house. It was done, based upon
the affidavit that is attached to the application, by the people
who built the property. It was done, as far as they were
concerned, in accordance with the laws at the time. In fact,
they were not aware of the fact that it was not properly done
until that survey that you mentioned showed that it existed that
way, and we went in for a certificate of occupancy for the total
property. It was at that time that they said to me that they
first learned of the impropriety of the porch, which is the

purpose of this application. I believe --without taking too
much of the Board's time-- the application fairly fits in with
the statute and I don't think we create any undue hardship if
the Board grants it. The request is minimal in terms of the
property. Conformity to the neighborhood is obvious in that the
porch, as it exists, has been there some 25 years, if not more.
If you have any questions, Mrs. Furlong is here; and I would be
happy to answer anything you might have.
THE CHAIRMAN: No, a gentleman was very gracious to
show me the place. From the house I walked right through their
house and looked at it -- very, very nice. I had no problems
understanding it, and we will see what develops.
MR. BRUER: Obviously we are in deep trouble, with the
Town, with our mortgage, and everything else.
THE CHAIRMAN: I don't see that that is going to be a
possibility at this point, and I am not speaking for the other
four gentlemen on this Board but-- While you are standing
there, is there anybody else who would like to speak in favor of
this application? Yes, the applicant, right? I just have to go
through this formality. Sometimes I don't.

to what we granted with the next-door neighbor?
MR. BURST: Yes.
THE CHAIRMAN: The upstairs storage area that you are
referring to is to be used for dead storage only. While you are

MR. BURST: The overhang is approximately one foot, I
believe. I just didn't want to go right in the middle of the

REGULATIONS.For the purpose of

outside of the Incorporated Villages,
is hereby divided into three (3) classes
of districts which shall be desi~nated

said districts are, hereby established
as shown upon the Building Zone Maps
which accompany and which, with all
notations, references and uther matter

matters and Olings set forth by said
map were all fully described herein.
SECTION 202--No building shall bo
erected, altered or used, and no prem-
ises shall be used for eny other than a
purpose permitted in the zone in which
such building or ~'emises is located.

SECTION 300---In the "A" Residen-
tial and Agricultural District, no build-
ing or premises shall bo used and no
building shall bo hereafter erected or
altered .unless otherwise ~revided in
this Ordinance, except for one (1) or
more of the following uses:
1--One (1) fan~ly dwellings.
2--Churches, schools, libraries.
3---Non-commersial parks, play-
grounds, athletic fields, bathing
beaches, bathhouses or boathouses.
4--Agricultural farms, poultry farms,
nurseries, greenhouses and truck gard-
ening (does not include farms for the
raising or breeding of ducks)
~cinbe. fraternity houses and golf
courses, except where the principal
tivities are casried on as a business.
6--Railway passenger stations.
'/--Accessory buildings, including one
(I) private garage, when located nut
less than lffty (§0) feet from the front
lot line or a private garage within or
attached to the dwelling.
8~Uses customarily incidental to any
of the above uses when located on the
same lot and not involving the con-
duct of a separate business. This shall
be understood to include the profes-
sional office or studio of a doctor,
dentist, teacher, artist, architect, en-

premises and no sign or advertisement
is shown other than a sign not larger

bearing only the name and occupation
(words only) of the practitioner.

the vicinity is partly built up with

five (35) feet has been established, no
buildings, hereafter erected or altered,
shall project beyond the line of the
. average setback so established.
SECTION 306~In cs~e of a comer
lot of record at the time of the pas-
sage of this Ordinance, a front yard
shall be required; same to be on a line
with the average setback lines on beth
streets produced to a point of inter-
section and if no average setback has
been established then a front yard,
thirty-five (33) feet deep, shall be re-
quired on each street front, or may be
decreased as a special exception by the
Board of Appeals as hereinafter pro-
vided.
SECTION 30T--"A" SIDE YAP, DS--
In the "A" Residential and Agrisultural
District, there shall be two (2) side
yards, 'one (1) on each side of the
buildings, the total aggregate of both
sides to be twenty*five (25) feet und
no one (1) side yard to be less than
ten (10) feet wide.
PROVIDED that, in the case of a
lot held in single and separate owner-
ship at the effective date o! this Or-
dinance, of a width less than one hun-
dred (100) feet or of an area lees than
twelve thousand five hundred (12.503)
feet, a single family dwelling may be
built thereon with side yards reduced
fifty (50) percent and when further re-
duced a.s a special exception by the
Board of Appeals as hereinafter pro-
vided.
SECTION 308~"A" REAR YARD~
In the "A" Residential and Agricultur-
al District, there shall be a rear yard
having a minimum depth of twenty-
five (25) feet.
PROVIDED that, in case of a lot
rear yard of less than twenty-five (25)
feet, when authorized as a special ex-
ception by the Board of Appeals aa
hereinafter provided and PROVIDED
lurther that in no case shall the rear
yard be less than fifteen (15) feet.
SECTION. 309--"A" ACCESSORY
BUILDINGS--In the "A' Residential
and Agricultural District, accessory
buildings may occupy forty (40) per-
cent of the required rear yard up to
an average height o~ eighteen (18) feet.
The yard area allowed by such ac-
cessory buildings shall be included in
computing the percentage of lot area
to be built upon and PROVIDED
further that no building of any kind
or nature shall be built within three
(3) feet of any lot line.
SECTION 310--OFF- STRudel' pARK-
lNG AREA--In "A" Residential and
Agricultural Districts, no building shall
be hereafter erected or altered or
added to in excess of fifty (50) percent
of its area prior to the adoption of
this Ordinance. unless not less than
one (1) parking space for each family
unit therein ~hall be provided for. For
all places of public assembly including
auditeriun~, churches and similar pub-
llc gathering places erected, there shall
be provided not less than one (1) park-
ing space for each seven ('D permanent
seats in such buildings or for each
part of the total area within such
· building or structure as is or may be
made available for seven (7) perman-
ent or tomporary seats. The formula
for providing an adequate parking
area is an area of three hundred thirty-
four (534) square feet per required mo-
tor vehicle unit
ARTICLE IV
'B" Business District
SECTION 40e~In the "B" Busine~
District, no building or premises shall
be used. and no building shall be here-
-after erected or altered unless other-
wise provided th this Ordinance, ex-
cept for one (1) or more of the
lowing uses:
1--One (1) family or tw~ (2) family
dwellings; multiple family dwellings
(provided all requirements as are out-
lined in "A" Residential and Agricui-
tural District are complied with).
2--All permitted uses as outlined in
'A" residential and Agricultural Dis-
trict.
· --Hoteis, motels, motor lo'algas,
boarding houses and similar establish-
ments.
4--Hespitals and clinics, other than
those for infectious or contagious dis-
eases, or Insanity or mental diseases,
or liquor or drug addicts.
5---Offlcss, banks, financial institu-
tions, telephone, telegraph, gus or elec-
tric business.
'/--Places of amusement,
8--Rsstauranls, bakery chops, con-
fectlonery or ice cream shops or fac-
tories.
~Publle garages or automobile ser-
vice stations when approved as a spec-
ial exception by the Board of Appeal~
as hereinafter provided.

carting or hauling offices or stations,
Ice manufacturing, yards for storage

variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13{a) as amended

! THAT we are the owners of premises known as 1745 Nakomis Road, Laughing Waters,
Southold, New York, SCTM #1000 - 78 - 3 - 35;
THAT on this date we are conveying the property to MARY P. FURLONG. In the course
of our sale to Ms. F~rlong, we discovered that the "porch" attached to our house needs
a C.O. To obtain the C.O., a variance is needed since it is in the rear yard and only
24½ feet from the rear line;
The porch was built soon after the house was constructed - probably 1968±;
THAT your deponents believed that no C.O. or building permit was required as the
porch is built on an already existing concrete patio by adding cement blocks around
it and then screens. The roof is plastic and no electric runs to the patio except
that which is attached to the building and part of the original construction;
THAT no one has ever questioned us about the porch, which we believed to be in
accordance with the Town Law;
THAT we believe thAt~in 1968 when the porch was added, a building permit and C.O.
were not required and that we built it in good faith and no way intended to avoid the
Law. Attached hereto is copy of building contract by Baker & Fickeissen, showing
patio (porch).

roads abutting the above described premises to the center lines thereof; TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises; TO
HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the paty of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
