Pursuant to the request made by Mr. Joseph Henderson for a
determination of jurisdiction for the above property, please be
advised that this matter has been reviewed and it has been
determined that as proposed the work will be out of the Trustees
jurisdiction as long as all work is kept 75' back from the tidal
wetlands and that a snow fence and staked hay bales are to be
employed around the perimeter of the work site to prevent any
leaching of sediments into the wetlands.
Please be advised that this determination is not meant to be
a determination that this property is an approved building lot.
(See attachment from the Bldg. Dept.) We would suggest that you
contact that Department at the earliest possible date regarding
this property.

The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to parsons
and property resuIting from such operations. By such acceptance, the applicant a~so agrees to indemni-
fy and save harmless the Town, end its officers, agents and employees from an,/and all cia[ms arising
from operations under this permit and any and all acts or omissions of ~ppiicant, his agent and
employees,
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
make such inspections as the Town may deem necessaw to insure that such operations 8re being son-
ducted in conformiw with this permit,

Cause damage from erosion, turbidity or siitatfon.
C. Cause saltwater intrusion into the fresh water resources of the town.

E. Increase the danger of flood and storm-tide damage.
F. Adversdy affect navfgation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
Weaken or undermine tho lateral support of other lands in the vicinity.
Otherwise adversely affect the health, safety and general welfare of the peopte of the town.

The following action was taken by .the Board of Town Trustees during
their regular'meeting held on September 24, 1987 regarding the above matter.
WHEREAS, The Land Use Company on behalf of Joseph W. Henderson applied to the
Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated July 17, 1987, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on September 24, 1987 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and '
WHEREAS, the Board has' Considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that The Land Use Company on behalf of Joseph W. Henderson BE AND
HEREBY IS GRANTED PERMISSION 'UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO:
Construct' a fixed dock 6: x 20', ramp 3' x 16' and float 8T x 20T on property located
on a private r.o.w., E~st End Road, Fishers Island.

This permit will expire on September 24, 1989 if work has
not commenced by said date. There are two inspections required and
the Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk, the applicant
shall file with the Clerk a certificate that he has public liability
insurance policies insuring against any liability which may arise
in the' performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. .Please take further noiice that
this declaration should not be considered a determination made for
any other .department or agency which may also l~aye an application
pending for the same or similar project.
PLEASE RETURN TO THE BUILDING DEPT. FOR A DETERMINATION ON THE

Dear Mr. 'Kujawski
This parcel was inspected on two occasions, the last time occurring
when there was foliage on the trees. Because of the steepness of the
slope where it enters the waters of Inner Bay, and because the soils are'
relatively well drained, the wetland vegetation is confined to the very
bottom of the bank save for occasional outtiers. Taking a cautious and"
conservative view it is our view that the wetland vegetation is confined
to below the'6' contour line. ConseqUently, the proPosed building in
all places is more than 75~ back from the wetlands according to measurements
made on .the Richard Strouse survey for the site dated 26 of May, 1988.
Thus it would appear that the project structure is outside the jurisdiction
of the wetland permit .your Board administers under the Town code.
However, we find that the proposed additional contoUrs.requiring
fill and/or regrading 9n the site northeast side (see above survey) intrude..
upon the 75" separation between edge of work site and wetland, said work
seemingly requiring the permit. It may be possible for the applicant to
limit this site regrading such that the part oflthe, parcel to be disturbed
is at all points at least 75' from the wetland edge~ (We should remind the
Boardthat in the majority of cases~ the proposal of ~r. Henderson would
not require a N.Y.State DEC tidal wetlands permit inthat all. of it is
well above the 10-foot contour line.)
In any event, we would recommend that a project limiting fence (i,e., snow
fence)and staked hay bales be employed around the perimeter of the work
site such that sediments are not washed from the site into the jurisdictional
area and into the waters of Inner Bay during the work phase of the project.

I would like to request an inspection for determination of
jurisdiction for the single family house my wife and I intend to build
. on Fishers Island.
Enclosed you will .find nine copies· of the plat of my wife's
lot on 'the island. Chandler, Palmer & King have drawn the footprint
of the house and its attendant septic system.· Test hole data shows
the substrate to. consist of fine sand. We will be using town water.
The dock indicated on the plan has already received your approval,
as well as DEC, and the Army Corps of Engineers.
One of the things that attracted us to this site was the
lovely stand of shad trees around the shore, with mosses and ferns
below. Accordingly, we have taken care to situate the house well
back from the water to preserve the natural beauty of the site. The
site is oddly configured. However, in arriving at the present plan we
have tried to work within all the guidelines, regulations and codes.
My hope is that this plan will be found to qualify for a
letter of non-jurisdiction. Thank you for your attention to this
matter. Let me know if there is anything further you require.

I am a property owner on Fishers Island. I intend
to build a single family home on the island. I have discussed
my intentions with Mr. Larry Penny and have sent him
materials on my intentions.I understand that Mr. Penny will
be writing to you to seek advice as to the necessity of
securing a wetlands permit from the town.
I hope that you will do what you can to ensure
that low impact single family dwellings, which follow the
setback rules, have a minimum of paperwork to complete and
processing delays. My own viewpoint is that the building
permit requirements, and health regulations as to sanitary
systems, amply protect the public interest. Of course, it should
be kept in mind that some projects have a large potential
impact and others have a small impact. I hope that you keep
a weather eye for the large ones.

Steve Malinowski: John Clavin advised lhat this project takes up a very large area
that is set aside for future moorings for .sail boats. The proposal does not reflect
the project accurately. This is a commercial venture and it will encroach on a
town mooring site (fulure) and it is not the best place for this project. Has
problems with this location. He will submit something in writing on this one.
