Appl. No. 4230 SE.
Upon Application of ALEX and AFRODITE BOUKAS. This is a
request for a Special Exception under Article VII, Section 100-
71B(2) for the proposed conversion of an existing single-family
dwelling to professional office(s) in this Residential-Office Zone
District. Location of Property: 695 Main Road, Mattituck, NY;
County Tax Map Parcel No. 1000-114-8-5.
WHEREAS, a public hearing was held on May 4, 1994, at which
time those persons who desired to be heard were heard and their
testimony recorded (see separate verbatim transcript of hearing);
and
WHEREAS, the Board has carefully considered all testimony and
documentation submitting concerning this application; and
WHEREAS, Board Members have personally viewed and are familiar
with the premises in question, its present zoning, and the
surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
l. By this applicant, applicants request the issuance of a
Special Exception (Special Permit) pursuant to Article VII, Section
100-7lB, subsection 2, for the creation of a professional office
building in the existing building which has since the inception of
zoning been utilized as a single-family residence. The subject
premises was zoned residential prior to January 1989, and since
1989 has been re-zoned Residential and Office (R-O).
2. Article VII, Section 100-71B of the Zoning Code authorizes
professional offices, without the need for owner occupancy, by
approval of the Board of Appeals (and subject to site plan approval
by the Planning Board).
3. The applicants, Dr. Alex and Afrodite Boukas, acquired the
subject premises on February 4, 1994 from Bruce E. and Lee A.
Maynard. The entire premises consists of a total lot area of
21,051 sq. ft. with street frontage along the northerly side of the

Main Road (a/k/a State Route 25) of 97.76 feet. The subject
premises commences at a point 80 feet easterly of the intersection
of Maple Avenue and the Main Road, Mattituck, and is identified on
the Suffolk County Tax Maps as District 1000, Section 114, Block 8,
Lot 5. The subject premises has existed with a total nonconforming
lot area of 21,051 sq. ft. since prior to the inception of zoning
in 1957. (Also see separate area variance application
simultaneously considered and determination rendered this date
concerning Appeal No. 4231.)
4. The applicants have submitted a survey plan dated Febru-
ary 18, 1994, which is presently or shortly will be before the
Southold Town Planning Board at this time for site-plan approval.
5. The February 18, 1994 survey plan shows an existing two-
story frame dwelling structure which is the subject of this Special
Exception use (to be converted for professional office use). A
total of six (6) parking spaces proposed, and the two existing
separate driveways will remain for egress and ingress. The
existing floor area of the first floor is shown on the Town's
assessment records as 891 sq. ft. The existing accessory garage in
the rear yard will continue.
6. As part of the special exception and site plan reviews,
the applicants have assured the Board of their intentions to comply
with all provisions of the Zoning, State Fire and Building Code,
and other regulations pertaining to this "professional office
building."
7. In considering this application, the Board also finds and
determines: (1) the proposed use will not prevent the orderly and
reasonable use of adjacent properties or of properties in adjacent
use districts; (2) the use will not adversely affect the safety,
welfare, comfort, convenience or order of the Town; (3) the use
is in harmony with and will promote the general purposes and intent
of zoning. The Board has also considered subsections (a) through
(1) of Article XXVI, Section 100-263 A through F ("standards")
applicable to special exception reviews. The Board agrees that the
use of the buildings, as proposed herein, meet all the standards
and conditions prescribed in the Southold Town Zoning Code for such
land use.
Accordingly, on motion by Chairman Goehringer, seconded by
Member Dinizio, it was
RESOLVED, to GRANT a Special Exception (Special Permit) for a
professional office building at premises identified on the Suffolk
County Tax Maps as District 1000, Section 114, Block 8, Lot 5,

The conversion and use of the existing building must comply
with all regulations pertaining to such use, including but not

Department permit(s) and approvals.

documentation submitting concerning this application; and
WHEREAS, Board Members have personally viewed and are familiar
with the premises in question, its present zoning, and the
surrounding areas; and
WHEREAS, the Board made the following Findings of Fact:
I. By this applicant, applicants request an area variance as
provided by New York Town Law, Section 267 amended July 1992, for
the proposed conversion {creation) of professional office use in
the existing building which has since the inception of zoning been
utilized as a single-family residence. The subject premises was
zoned residential prior to January 1989, and since 1989 has been
re-zoned Residential and Office {R-O).
2. Article VII, Section 100~71B of the Zoning Code authorizes
professional offices, without the need for owner occupancy, by
approval of the Board of Appeals (and subject to site plan approval
by the Planning Board), provided 40,000 sq. ft. of land area is
applied to each use category. The applicants' use category is
requested to be changed from residential to offices.
3. The applicants, Dr. Alex and Afrodite Boukas, acquired the
subject premises on February 4, 1994 from Bruce E. and Lee A.

3. The applicants, Dr. Alex and Afrodite Boukas, acquired the
subject premises on February 4, 1994 from Bruce E. and Lee A.
Maynard. The entire premises consists of a total lot area of
21,051 sq. ft. with street frontage along the northerly side of the
Main Road (a/k/a State Route 25) of 97.76 feet. The subject
premises commences at a point 80 feet easterly of the intersection
of Maple Avenue and the Main Road, Mattituck, and is identified on
the Suffolk County Tax Maps as District 1000, Section 114, Block 8,
Lot 5. The subject premises has existed with a total nonconforming
lot area of 21,051 sq. ft. since prior to the inception of zoning
in 1957. (Also see separate area variance application
simultaneously considered and determination rendered this date
concerning Appeal No. 4231.)
4. The applicants have submitted a survey plan dated Febru-
ary 18, 1994, which is presently or shortly will be before the
Southold Town Planning Board at this time for site-plan approval.
5. The February 18, 1994 survey plan shows an existing two-
story frame dwelling structure which is the subject of this Special
Exception use (to be converted for professional office use). A
total of six (6) parking spaces proposed, and the two existing
separate driveways will remain for egress and ingress. The
existing floor area of the first floor is shown on the Town's
assessment records as 891 sq. ft. The existing accessory garage in
the rear yard will continue.
6. As part of the special exception, area variance, and site
plan reviews, the applicants have assured the Board of their
intentions to comply with all provisions of the Zoning, State Fire
and Building Code, and other regulations pertaining to this
"professional office building."
7. In considering this application, the Board also finds and
determines:
a) the relief requested is the minimum necessary to afford
relief since there is no additional land available to comply with the 40,000 sq.
ft. requirement; and the 9rant of the variance will not be adverse to the protec-
tion and preservation of the character of this community;
b) the difficulties claimed are not personal and are directly
related to the uniqueness of the land;
c) the grant of this area variance will not be detrimental to the
health, safety or welfare of the community si~c~ it still would provide a
reasonable benefit for the property owner to use his land (balancing concept) l
d) the relief as granted will not create an undesirable change or
detriment to nearby properties;
e) the area variance is not substantial in relation to those lots
generally existin9 in the neighborhood and the fact that the lot preexisted
this RO zoning provision (enacted in 1989);

7. (f) the difficulty claimed was not self-created.
(g) in considering all the above factors, the interests of justice
will best be served by granting the variance, as requested and further
noted below.

with a lot area of 21,051 sq. ft. in area and 97.76 feet in lot

The conversion and use of the existing building must comply
with all regulations pertaining to such use, including but not
limited to: (a) site plan approval from the Southold Town Planning

It is possible that the Town may opt for a less-involved site plan

Dear Mr. Raynor:
This letter will acknowledge that we have reviewed the above
documentation submitted by you as agent for Alex and Afrodite
Boukas for a Special Exception.
Upon receipt of the following documents, we will be in a
position to file the application with the Town Clerk's Office
and commence reviews, inspections, and advertise the same for a
public hearing:
(a) A variance will be necessary under Section 100-71B(2) due
to the size of the property at less than 40,000 sq. ft. A set
of variance application forms is attached for your use. You
will note that a Notice of Disapproval from the Building
Inspector is not being required in this instance since the
Special Exception and Variance will be processed together.
(b) An additional $200.00 filing fee will be required for the
variance documentation, to be filed and processed with the
Special Exception request;
(c) Copies of Certificates of Occupancy for all existing
buildings were not attached to the application - please furnish;
(d) Copy of the current deed of the property <does not have to
show county recording information>;
(e) Copies of a proposed floor plan for the entire building, as
modified - please also show whether or not the dwelling and
sleeping areas will be discontinued and the new use of those
rooms. Please also label the rooms for the proposed office use.

(g) A separate, detailed diagram showing the number, dimensions
and location of the parking sp~ces, and landscaping buffer
around the parking areas or th~ rear yard generally. <Article
XXI of the Zoning Code requires a minimum of five (5) spaces per
dentist or physician and certain landscaping buffer areas
between the zone districts.> Please also label proposed
entrance and exit drives. You should note that it appears this
project will require an application to the Building Inspector
for the proposed changes to the site, building conversion, and
new structural changes/additions. It is expected that he will
determine the Code requires site plan approval from the Planning
Board (similar to that done for the Fischetti parcel in Southold
and Centonze at C.R. 48 in Mattituck).
(h) The Special Exception form must contain a description of
the use proposed on the property rather than as noted.
Please let us know whether or not you will be able to file
the above documents on or before February 14th and whether or
not we should return the original Special Exception form for the
correction.
