This is a request for a Special Exception under Article VII, Section 100- 71B(2) for the proposed conversion of an existing single-family dwelling to professional office(s) in this Residential-Office Zone District. Location of Property: 695 Main Road, Mattituck, NY; County Tax Map Parcel No. 1000-114-8-5. WHEREAS, a public hearing was held on May 4, 1994, at which time those persons who desired to be heard were heard and their testimony recorded (see separate verbatim transcript of hearing); and WHEREAS, the Board has carefully considered all testimony and documentation submitting concerning this application; and WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following Findings of Fact: l. By this applicant, applicants request the issuance of a Special Exception (Special Permit) pursuant to Article VII, Section 100-7lB, subsection 2, for the creation of a professional office building in the existing building which has since the inception of zoning been utilized as a single-family residence. The subject premises was zoned residential prior to January 1989, and since 1989 has been re-zoned Residential and Office (R-O). 2. Article VII, Section 100-71B of the Zoning Code authorizes professional offices, without the need for owner occupancy, by approval of the Board of Appeals (and subject to site plan approval by the Planning Board). 3. The applicants, Dr. Alex and Afrodite Boukas, acquired the subject premises on February 4, 1994 from Bruce E. and Lee A. Maynard. The entire premises consists of a total lot area of 21,051 sq. ft. with street frontage along the northerly side of the Page 2 - Appl. The subject premises commences at a point 80 feet easterly of the intersection of Maple Avenue and the Main Road, Mattituck, and is identified on the Suffolk County Tax Maps as District 1000, Section 114, Block 8, Lot 5. The subject premises has existed with a total nonconforming lot area of 21,051 sq. ft. since prior to the inception of zoning in 1957. (Also see separate area variance application simultaneously considered and determination rendered this date concerning Appeal No. 4231.) 4. The applicants have submitted a survey plan dated Febru- ary 18, 1994, which is presently or shortly will be before the Southold Town Planning Board at this time for site-plan approval. 5. The February 18, 1994 survey plan shows an existing two- story frame dwelling structure which is the subject of this Special Exception use (to be converted for professional office use). A total of six (6) parking spaces proposed, and the two existing separate driveways will remain for egress and ingress. The existing floor area of the first floor is shown on the Town's assessment records as 891 sq. ft. The existing accessory garage in the rear yard will continue. 6. As part of the special exception and site plan reviews, the applicants have assured the Board of their intentions to comply with all provisions of the Zoning, State Fire and Building Code, and other regulations pertaining to this "professional office building." 7. In considering this application, the Board also finds and determines: (1) the proposed use will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts; (2) the use will not adversely affect the safety, welfare, comfort, convenience or order of the Town; (3) the use is in harmony with and will promote the general purposes and intent of zoning. The Board has also considered subsections (a) through (1) of Article XXVI, Section 100-263 A through F ("standards") applicable to special exception reviews. The Board agrees that the use of the buildings, as proposed herein, meet all the standards and conditions prescribed in the Southold Town Zoning Code for such land use. Accordingly, on motion by Chairman Goehringer, seconded by Member Dinizio, it was RESOLVED, to GRANT a Special Exception (Special Permit) for a professional office building at premises identified on the Suffolk County Tax Maps as District 1000, Section 114, Block 8, Lot 5, Page 3- Appl, No, Application of Dr. Decision Rendered 4230SE and Mrs. Alex Boukas May 4, 1994 as applied, SUBJECT TO: The conversion and use of the existing building must comply with all regulations pertaining to such use, including but not limited to: (a) site plan approval from the Southold Town Planning Board, (b) Building and Fire Code regulations, (c) Suffolk County Health Department regulations, (d) Southold Town Building Department permit(s) and approvals. The applicants, Dr. Alex and Afrodite Boukas, acquired the subject premises on February 4, 1994 from Bruce E. and Lee A. Maynard. The entire premises consists of a total lot area of 21,051 sq. ft. with street frontage along the northerly side of the Main Road (a/k/a State Route 25) of 97.76 feet. The February 18, 1994 survey plan shows an existing two- story frame dwelling structure which is the subject of this Special Exception use (to be converted for professional office use). A total of six (6) parking spaces proposed, and the two existing separate driveways will remain for egress and ingress. The existing floor area of the first floor is shown on the Town's assessment records as 891 sq. ft. The existing accessory garage in the rear yard will continue. 6. As part of the special exception, area variance, and site plan reviews, the applicants have assured the Board of their intentions to comply with all provisions of the Zoning, State Fire and Building Code, and other regulations pertaining to this "professional office building." 7.
